Complaint Preparation and Filing

Create the Complaint

In order to faciliate the filing of a complaint, the WIPO Arbitration and Mediation Center offers a model Complaint (word or electornic form).

Please note that this is optional and you may prepare and submit a Complaint without using these facilities. Using the WIPO model Complaint as a basis for the preparation of a party's submission does not preclude the possibility of the Complaint being found deficient following the WIPO Center's formalities compliance review, nor of the Center or an Administrative Panel requesting the complainant for additional information. In addition, it does not guarantee a complainant's success on the merits.

Submit the Complaint

The Complaint must be sent to the following three entities:

1) The WIPO Arbitration and Mediation Center
2) The Respondent
3) The Registrar

1) The WIPO Arbitration and Mediation Center

a) Electronic format

The Complaint must be submitted in electronic format to the WIPO Arbitration and Mediation Center, which offers two options
a) send an email to domain.disputes@wipo.int - attaching the Complaint, the Complaint Transmittal Coversheet and any annexes
b) complete the WIPO online form and submit directly

b) Hard copies

Send the signed original and four hardcopies of the Complaint and annexes by express mail or courier service to:

2) Respondent

At the same time as the Complaint is submitted to the WIPO Center, send or transmit a copy of the Complaint (including the Complaint Transmittal Coversheet) to the Respondent in accordance with Rules, para. 2(b), i.e., unless the Respondent has specified the method to be used for case-related communications, by fax (with a confirmation of transmission) or postal or courier service (postage pre-paid and return receipt requested) or electronically (provided a record of transmission is available).

3) Registrar

At the same time as the Complaint is submitted to the WIPO Center, send or transmit a copy of the Complaint (including the Complaint Transmittal Coversheet) to the concerned registrar(s). Certain registrars have established specific contact details that should be used for these purposes, which may be obtained by contacting the registrar(s) in question. Network Solutions, Inc. has informed the Center that Complaints should be sent either by e-mail to resolution@netsol.com or by fax to (+1) 703 742 8706.

 

Fees

Submit the required payment to the Center, as specified in Annex D of the WIPO Supplemental Rules for Uniform Domain Name Dispute Resolution Policy; if payment is being submitted by check, it should be included with the hardcopies (see above). If payment is not being submitted with the hardcopies, inform the Center as to how payment is being made when the Complaint is submitted.
