Article 1 of this Law provides that the State recognizes, regulates and guarantees the intellectual property rights acquired in accordance with the law, the decisions of the Andean Community Commission and the international conventions in force in Ecuador.

According to Article 1 of this Law, intellectual property shall include rights relating to (1) copyright and related rights; (2) industrial property, which shall comprise, inter alia, rights relating to inventions; industrial designs; layout designs (topographies) of integrated circuits; undisclosed information and trade secrets; trademarks, service marks and commercial slogans; distinctive appearance of business and commercial establishments; trade names, geographical indications; and any other intellectual creation intended for agricultural, industrial or commercial use; and (3) plant varieties.

The Ecuadorian Institute of Intellectual Property (IEPI) is recognized under Article 3 of the Law as the administrative body responsible for promoting and protecting, on behalf of the State, the intellectual property rights.

Section 2 of 'Final Provisions' of this Law states: 'The provisions of this Law, the amendments thereto and the repealing provisions thereof shall be in force from the relevant dates of publication in the Official Register.'
