After much thought and research, I have still not found a compelling rationale for the New Entity to be involved in either dispute prevention or dispute resolution.
Certainly WIPO can provide an excellent forum for the resolution of disputes when parties consent to use that forum. But why should it be the only forum available to parties involved in a dispute over a domain name?
I see no reason why the New Entity should be charged with the responsibility of trying to define or aniticipate what kind of legitimate disputes may occur. It seems to me that this role would simply increase the chances that this New Entity would itself become embroiled in disputes, and I do not consider this a good thing. It does not contribute to the operational stability of the Internet.
I am speaking both as an individual and as someone hwo has an interest in protecting Speco's trademarks.
