Titular Las aseveraciones de hecho y consideraciones jurídicas en que el Titular funda sus excepciones y defensas son las siguientes: (i) El representante del Promovente no cuenta con facultades expresas para haber promovido el presente procedimiento administrativo ante el Centro ni se comprueba fehacientemente que la persona que firmó la Solicitud sea la misma que figura en la Carta Poder exhibida para acreditar la personalidad con que se ostenta el representante del Promovente; (ii) El Titular registró el nombre de dominio debido a que se encontraba disponible y ha venido usándolo de manera legítima desde entonces, haciendo cambios a dicho nombre de dominio, desarrollando su marca y logotipo propios para diferenciar su actividad; (iii) Actualmente el nombre de dominio en disputa está destinado al desarrollo y uso de una agenda en línea que tiene las capacidades de llevar la agenda orientada a proyectos de manera móvil; (iv) Debido a que el diseño del programa se encuentra aún en etapa de desarrollo y corrección de errores de programación, la página del nombre de dominio no estaba funcionando al momento de la presentación de la Solicitud; (v) El Titular desconocía que la marca WENDY'S se encontraba registrada en México ya que la misma no es una marca notoriamente conocida en México, así como porque no existe ningún establecimiento que use dicha marca a nivel nacional; (vi) La supuesta marca del Promovente es un nombre femenino genérico y que para efectos de dominio no puede ser considerado propiedad exclusiva de aquél, máxime que dicho nombre admite varios usos y propósitos no marcarios; (vii) El nombre de dominio en disputa es tan genérico que una búsqueda de “Wendy” en Google arroja más de 48,300,000 recursos de Internet con dicha referencia y hasta páginas como “www.wendy.com” que no tienen relación alguna con el Promovente y más de 875,000 sitios para el caso de “wendys”; (viii) El Promovente no acreditó que su marca sea notoriamente conocida en México como afirma pues no presentó prueba o evidencia alguna de la que se pudiera concluir que la misma ha alcanzado el estatus de notoria en México; (ix) El Titular cuenta con una marca distintiva de su software derivado del simple uso de este último a pesar de que no se haya obtenido todavía un registro marcario; (x) Atento a lo dispuesto por el párrafo 4(c) de la Política, el Titular ha utilizado el nombre de dominio correspondiente en relación con una oferta de buena fe de productos antes de haber sido notificado de la Solicitud; (xi) El Titular nunca ha tenido la intención de desviar a los consumidores o empañar el buen nombre de la marca del Promovente ya que el mercado del Titular es completamente distinto y sin sinergia alguna con aquél en el que participa el Promovente; (xii) No es posible imputar mala fe al Titular toda vez que este último desconoce si hay establecimientos del Promovente en este territorio y por lo tanto es imposible presumir que el Titular tuviese conocimiento de la marca del Prmovente; (xiii) El Promovente nunca estableció contacto con el Titular para intentar adquirir el nombre de dominio en conflicto, razón por la cual no puede argumentar que el propósito de la posesión del nombre de dominio es sólo la venta o lucro del mismo; (xiv) Si bien la página invitaba a todo aquél interesado en comprar el nombre de dominio a enviar un correo electrónico a la dirección proporcionada, ello no permite concluir que el nombre de dominio se encontrara “fundamentalmente” en venta ya que no había una oferta pública o un precio del mismo; (xv) El Promovente no pudo demostrar la existencia de publicidad en México respecto de la marca WENDY'S para tener por acreditado un conocimiento actual o sustancial de la misma por parte del Titular. 6. ...
