Section 86 of the Act deals with patent, industrial design or utility model claims in aircraft.
Section 86 exempts aircraft registered in countries that Botswana has committed to protect under the 1944 Chicago Convention on International Civil Aviation from seizure, detention, or any interference in Botswana on the ground that the construction, mechanism, parts, accessories of or operation of the aircraft infringes a patent, design or model.
The Minister responsible for civil aviation may, by Order published in the Gazette, specify other aircraft that are also exempted from seizure.
The exemption applies to aircraft entering Botswana, with or without landing. Other foreign aircraft (not protected by Botswana's obligations under the Chicago Convention or exempted by the Minister) may be detained in Botswana for alleged infringement of a patented invention, industrial design or utility model which is protected in Botswana.
