This law while not a dedicated intellectual property law, contains the statutory provisions for the protection of trade secrets (other than trade secrets as understood in Article 39.3 of the TRIPS Agreement) and unregistered trade marks, as well as provision for certain preliminary remedies, applicable also in intellectual property matters, including pre-trial seizures of infringing items and freezing of assets. Protection for confidential test data of the sort referred to in TRIPS Article 39.3 is protected pursuant to Paragraph 47D of the Pharmacists Ordinance.
