Year of Version 2006 Dates Amended up to: February 4, 2006 Entry into force: January 20, 1982 Published: January 20, 1982 Adopted: January 11, 1982 Type of Text Constitution/Basic Law Subject Matter Other Notes The Political Constitution of Honduras was enacted on January 11, 1982 and came into force on January 20, 1982. The Constitution establishes that the form of government is republican, democratic, and representative and consists of of three branches: legislative, executive and judicial, which are complementary, independent, and not subordinate to each other (Article 4). The legislative branch is exercised by a Congress of Deputies (the unicameral National Congress of Honduras), which is elected by direct vote. The executive branch is vested in the President. The President participates in the enactment of laws by introducing bills in the National Congress through the cabinet of ministers. The President has the power to sanction, veto, or promulgate and publish any laws approved by the National Congress. The judicial branch is comprised of the Supreme Court of Justice, courts of appeals, courts of first instance, and justices of the peace. The legal system of Honduras is based on Roman and Spanish civil law with increasing influence of English common law. The Constitution contains provisions concerning the intellectual property rights. Article 108 states that 'Every author, inventor, producer or trader shall enjoy the exclusive ownership of his work, invention, trademark or trade name under the law'. Moreover, Article 133 guarantees that ‘Independent intellectual workers and the product of their work must be covered by protecting legislation.' This consolidated version of the Political Constitution takes into account amendments up to Decree No. 381-2005 of January 20, 2006, that was published in the Official Gazette No. 30.920 of February 4, 2006.
