Saudi Domain Names Dispute Resolution Regulations

Relevant differences between the UDRP and the .SA Policy

The .SA Policy applies to domain names that are identical or confusingly similar, not only to trademarks or service marks, but also to trade names. However, it does not apply to domain names registered by government entities and any other entities associated with them, according to Article 3 of the Rules.

It is sufficient to prove that either registration or use of the domain name by the registrant is in bad faith, whereas the UDRP requires the complainant to prove both.

Courts of the Kingdom of Saudi Arabia

The language of the proceeding is Arabic, but the Complainant may submit a Complaint in English (i) if there is an agreement between the Parties to use English as the language of the proceeding or (ii) in the absence of an agreement, Complainant should indicate the reasons why the proceeding should be in English and Arabic.

The Complainant may submit a complaint directly to SaudiNIC via the means dedicated for this purpose as published on the SaudiNIC’s Website prior to filing a procedure with WIPO. Within 10 business days, SaudiNIC will study the complaint, determine the appropriate methods of treatment, including negotiation, and strive to reach an agreement by mutual consent between the parties. When filing a complaint with the Center, please indicate if SaudiNIC has been contacted before the submission of the complaint.

The Center shall notify SaudiNIC of the Panel’s recommendation. Then, the Communications, Space and Technology Commission (CST) will issue the decision of the proceeding.

Eligibility Criteria

Registration of .SA and السعودية. domain names is restricted.

      An entity physically located in Saudi Arabia;
      A natural person, not underage, with a Saudi national identification card or equivalent document issued by the Ministry of Interior of Saudi Arabia;
      An entity with a registration or license issued by a pertinent authority in Saudi Arabia;
      An owner of a trademark or trade name that is registered in Saudi Arabia.
