关于第1条第(4)款的议定声明:《伯尔尼公约》第9条所规定的复制权及其所允许的例外,完全适用于数字环境,尤其是以数字形式使用作品的情况。不言而喻,在电子媒体中以数字形式存储受保护的作品,构成《伯尔尼公约》第9条意义下的复制。

关于第3条的议定声明:不言而喻,在适用本条约第3条时,《伯尔尼公约》第2至6条中的"本联盟成员国",在把《伯尔尼公约》的这些条款适用于本条约所规定的保护中,将被视为如同系指本条约的缔约方。另外,不言而喻,《伯尔尼公约》这些条款中的"非本联盟成员国",在同样的情况下,应被视为如同系指非本条约缔约方的国家,《伯尔尼公约》第2条第(8)款、第2条之二第(2)款、第3、4和5条中的"本公约",将被视为如同系指《伯尔尼公约》和本条约。最后,不言而喻,《伯尔尼公约》第3至6条中所指的"本联盟成员国之一的国民",在把这些条款适用于本条约时,对于系本条约缔约方的政府间组织,指系该组织成员的国家之一的国民。

关于第4条的议定声明:按第2条的解释,依本条约第4条规定的计算机程序保护的范围,与《伯尔尼公约》第2条的规定一致,并与TRIPS协定的有关规定相同。

关于第5条的议定声明:按第2条的解释,依本条约第5条规定的数据汇编(数据库)保护的范围,与《伯尔尼公约》第2条的规定一致,并与TRIPS协定的有关规定相同。

关于第6和7条的议定声明:该两条中的用语"复制品"和"原件和复制品",受该两条中发行权和出租权的约束,专指可作为有形物品投放流通的固定的复制品。

关于第7条的议定声明:不言而喻,第7条第(1)款规定的义务不要求缔约方对依照该缔约方法律未授予其对录音制品权利的作者规定商业性出租的专有权。这一义务应被理解为与TRIPS协定第14条第(4)款相一致。

关于第8条的议定声明:不言而喻,仅仅为促成或进行传播提供实物设施不致构成本条约或《伯尔尼公约》意义下的传播。并且,第8条中的任何内容均不得理解为阻止缔约方适用第11条之二第(2)款。

关于第10条的议定声明:不言而喻,第10条的规定允许缔约各方将其国内法中依《伯尔尼公约》被认为可接受的限制与例外继续适用并适当地延伸到数字环境中。同样,这些规定应被理解为允许缔约方制定对数字网络环境适宜的新的例外与限制。

另外,不言而喻,第10条第(2)款既不缩小也不延伸由《伯尔尼公约》所允许的限制与例外的可适用性范围。

关于第12条的议定声明:不言而喻,"对本条约或《伯尔尼公约》所涵盖的任何权利的侵犯"的提法既包括专有权,也包括获得报酬的权利。

此外,不言而喻,缔约各方不会依赖本条来制定或实施要求履行为《伯尔尼公约》或本条约所不允许的手续的权利管理制度,从而阻止商品的自由流通或妨碍享有依本条约规定的权利。
