206. Bundesgesetz vom 14. Juli 1949, betreffend Abänderung des Urheberrechtsgesetzes, BGBI.

Nr. 111/1936

Der Nationalrat hat beschlossen:

§ 1. Das Bundesgesetz über das Urheberrecht an Werken der Literatur und der Kunst und über verwandte Schutzrechte (Urheberrechtsgesetz), BGBl. Nr. 111/1936, wird abgeändert wie folgt:

§ 53, Abs. (1), Z. 5, hat zu lauten:

„5. wenn die Aufführung von einer nicht aus Berufsmusikern bestehenden Musikkapelle veranstaltet wird, deren Bestand nach einem von der zuständigen Landesregierung ausgestellten Zeugnis der Pflege volkstümlichen Brauchtums dient und deren Mitglieder nicht um des Erwerbes willen mitwirken; doch darf die Aufführung in Gemeinden mit mehr als 2500 Einwohnern nicht im Betriebe eines Erwerbsunternehmens, in Gemeinden bis zu 2500 Einwohnern nur dann im Betriebe eines Erwerbsunternehmens stattfinden, wenn andere passende Räume nicht zur Verfügung stehen und der Reingewinn nicht dem Erwerbsunternehmen zufließt."

§ 2. Mit der Vollziehung dieses Bundesgesetzes sind die Bundesministerien für Unterricht und für Justiz betraut.
