Relevant differences between the UDRP and the .PE Policy

Whereas in the UDRP the jurisdiction(s) where the trademark is valid is not considered relevant to panel assessment under the first element, under the procedure for .PE the complainant needs to prove that the domain name in dispute is identical or confusingly similar to a registered trademark or service mark in Peru

Whereas the UDRP is limited to the protection of trademark rights, under the .PE Policy a complainant may also rely on designations or denominations of origin protected in Peru, names of individuals or famous pseudonyms publicly recognized in Peru, names of official entities of the Central, Regional or Local governments of Peru, and names of private entities registered with the Public Registries in Peru

It is sufficient to prove that either registration or use of the domain name by the registrant is in bad faith, whereas the UDRP requires the complainant to prove both

If an Administrative Panel decides that a domain name registration should be canceled or transferred, the Registry will wait 10 calendar days (as opposed to 10 business days under the UDRP) before implementing that decision

Eligibility Criteria

.PE domain names are unrestricted, as well as domain names under “.com.pe”, “.org.pe”, “net.pe”, and “.nom.pe”. Restrictions apply to “.gob.pe”, “.mil.pe”, and “.edu.pe”

Supported characters

.PE domain names support ASCII and IDN characters

  • - may have between 3 and 63 characters;
  • - may include letters, numbers and dashes;
  • - may not include dashes as the first or last characters of the domain name;
  • - may include the characters á, é, í, ó, ú, and ñ
