Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Notification by the United States of America of Changes in Fees Charged by the American Type Culture Collection (ATCC)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on June 24, 1986, of the notification of the Government of the United States of America, dated June 18, 1986, stating a change in the fees charged by the American Type Culture Collection (ATCC) as an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977. The text of that notification is attached.

The fees set forth in the said notification will apply as from the thirtieth day following the date (August 31, 1986) of the publication of the said fees in the July/August 1986 issue of Industrial Property/La Propriété industrielle, that is, as from September 30, 1986 (see Rule 12.2(c) of the Regulations under the Budapest Treaty). The said fees will replace the fees for the furnishing of a sample under Rules 11.2 and 11.3, as published in the May 1985 issue of Industrial Property/La Propriété industrielle (see Budapest Notification No. 44 of April 26, 1985).

Text of the Notification of the Government of the United States of America, dated June 18, 1986, stating a change in the fees charged by the American Type Culture Collection (ATCC)

NOTIFICATION

The fee schedule of the American Type Culture Collection (ATCC) as published in the May 1985 issue of Industrial Property is changed as follows in respect of the fees for the furnishing of a sample under Rules 11.2 and 11.3 of the Regulations under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977:

  Algae, animal and plant viruses, bacteria, bacteriophages, fungi, plant tissue cultures, plasmids, protozoa, seeds (25 per sample) and yeasts, (except Preceptrol cultures)

Cell lines ordered in flasks, protozoa ordered in test tubes, and other deposits special ordered in test tubes carry an additional fee of US $35.00.

The minimum invoice is US $45.00. Orders received for lesser amounts will be invoiced at the minimum.
