This letter expresses our intention (hereinafter referred to as the "MoU") is made to pursue a technical cooperation between IAARD and GIZ CSLU (the parties);

Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH, located at Jl. MH. Thamrin I, GIZ office Indonesia — Menara BCA 46th floor, Jakarta 10310 represented by Mr. Sergey Makarov, ASEAN Cluster Coordinator of Deutsche Gesellschaft fur Internationale

Zusammenarbeit GmbH (GIZ CLU) (hereinafter referred to as the GIZ CLU), as the one Party;

And

The Indonesian Agency for Agricultural Research and Development (IAARD), located at Jl Ragunan No 29, Pasar Minggu, Jakarta Selatan, Indonesia represented by Mr. Fadjn,' Djufry, Director General of Indonesian Agency for Agricultural Research and Development, hereinafter referred to as "IAARD", as the other Party;

Referred to together as the "Parties", and individually as a "Party"

CONSIDERING that it is in the interest of both Parties to initiate pilot activities of climate smart land use in ASEAN. The activities are designed to showcase the implementation of ASEAN guidelines that are aligned with the national policy processes on sustainable agriculture and forestry;

RECOGNIZING both institutions have interested to potentially utilize their strengths to establish guideline of climate smart land use;

WHEREAS, GIZ CSI-U and IAARD have complementary objectives and mutual desire to pursue further collaboration in promoting climate-smart land use in the ASEAN region.

REFERRING, to letter dated July 27, 2020;

PURSUANT to the prevailing laws and regulations of both countries;

Have agreed as follows:

ARTICLE I

OBJECTIVES

The objective of the MoU is to undertake, subject to the provisions herein, cooperation for promoting climate change mitigation and adaptation in the land use sectors while enhancing national policymaking and cross-sectoral coordination, in reference to selected ASEAN regional policy products. The demonstration activities are going to be embedded in the ongoing policy initiatives and program implementation in Indonesia.

 

ARTICLE II

EXECUTING INSTITUTIONS

The following institutions will carry out and implement the provisions set out in this MoU:

  1. The Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH represented through the Climate Smart Land Use in ASEAN (CSLU) Project;
  2. The Indonesian Agency for Agricultural Research and Development (IAARD) of the Ministry of Agriculture of the Republic of Indonesia, and its affiliate institutions.

 

ARTICLE III

AREAS OF COOPERATION

The areas of cooperation will focus on climate-smart use approaches amidst the increasing demand for land due to increased economic activities and land and water use competitions in which thereby impacted local food security and forest conservation. The areas of cooperation are in reference to selected regional policy products by ASEAN Ministerial Meeting on Agriculture and Forestry with relevance for climate-smart land use, which cover the topics of agroforestry, climate-smart agriculture and gender mainstreaming.

 

ARTICLE IV

IMPLEMENTATION

  1. Measuring climate impacts of climate-smart practices in the case of agroforestry;
  2. Formulating a policy brief on how agroforestry can contribute to climate change mitigation and adaptation under the lens of food security;
  3. Developing recommendations on ensuring gender equality and the rights of disadvantaged groups in climate policies and processes;
  4. Exchange of technical information, collaboration on research activities, and other forms of technical collaboration that are jointly determined.

 

ARTICLE V

CONTRIBUTIONS AND OBLIGATION

  1. Joint responsibilities of IAARD and GIZ CSLU
  2. Produce joint a research document that can act as a reference for further policymaking purposes in the agreed area of climate smart land use and gender mainstreaming;
  3. Promote trainings to improve food production and agriculture competitiveness amidst challenges of climate change;
  4. Disseminate the obtained knowledge through events, policy briefs and other means of information sharing on food security and impacts of agroforestry practices on climate change mitigation and adaptation;
  5. Document local practices of agroforestry and sustainable agriculture activities aiming at piloting food crop cultivation diversification strategies;
  6. Responsibilities of IAARD
  7. Provide technical capacities in relation to the agreed research area;
  8. Provide guidance in how to utilize the research document as a meaningful input to the national policy process;
  9. In-kind contributions to support the mainstreaming of selected ASEAN guidelines into national policies g. trainers if circumstances allow;
  10. Responsibilities of GIZ CSLU
  11. Provide technical services of compiling the research document;
  12. Bear the main cost of the compilation and production of the knowledge products;
  13. Organize workshops, discussions and training in support of the agreed focus area of climate smart practices.

 

 

ARTICLE VI

FINANCIAL RESOURCES OF THE PROJECT

Funding allocated to deliver the output will be provided by GIZ through the CSLU project through an at cost mechanism. In-kind contribution will be provided by IAARD through providing guidance in utilizing research documents, technical capacities in relation to the agreed research areas, and other implementation activities of mainstreaming ASEAN guidelines related to sustainable agriculture and social forestry.

 

ARTICLE VII

PUBLICATION

  1. The results of the cooperation will be reported to the Parties prior to joint publishing under the condition that both Parties have agreed in advance upon disclosure to the public.
  2. The personnel involved under this cooperation will not disclose or publish any program information without the prior written approval of both Parties.
  3. Data and information obtained during the research cooperation will be made accessible to both Parties.

 

ARTICLE VIII

SETTLEMENT OF DISPUTE

Any difference or dispute arising out of interpretation or implementation of this MoU shall be settled amicably through consultations and/or negotiations between the Parties.

 

ARTICLE IX

INTELLECTUAL PROPERTIES

IAARD and GIZ CSLU shall jointly own proprietary outputs from this MoU including reports and publications released based on the activities implemented. Both parties will also ensure that IAARD and GIZ CSLU are acknowledged in any press releases about the project.

 

ARTICLE X

AMENDMENTS

This MoU can be reviewed or amended at any time by mutual written consent by the Parties. Such revisions or amendments shall enter into force on such date as determined by the Parties and shall form as an integral part of this MoU.

 

ARTICLE XI

ENTRY INTO FORCE, EFFECTIVITY AND DURATION

  1. This MoU shall enter into force on the date of its signing;
  2. This MoU shall remain in force until April 2021 or when the CSLU project has been completed, and may be extended by mutual consent of the Parties;
  3. This MoU may be terminated at any time by giving written notification to the other Party at least 30 days in advance of each termination to the other Party
  4. The termination of this MoU shall not affect the validity and duration of any on-going activities or projects made under this MoU until the completion of such activities or projects.
  5. This MoU in no way restricts either Partner from pursuing similar activities on its own or from participating in similar activities with other public or private agencies, organizations, and individuals and shall not provide exclusivity between the Partners in the scope of any cooperation.

 

IN WITNESS WHEREOF, this MoU is done in ………..,………… on …………….. and shall be effective as the Effective Date and is executed in two identical counterparts which are equally valid. The parties to this MoU have thoroughly read and certified this to be in accordance with their desires in all aspects that relevant signatures are set to be of evidence at the presence of the witness thereof and each copy held by the Parties.
