Name: Andrew Moulden The lists of issues appear to be fairly complete in their scope. In particular: "how do you define bad faith, abusive, misleading or unfair registration and use...?" is a key question, and one which appears to have have several widely differing slants in certain recent adjudications. The issue of more than one organization having a legitimate claim to a domain name where confusing similarity with a trademark, a lack of legitimate interest, and bad faith usage could be proven in respect of both organizations, has not yet, I think, been mentioned. Finally, the issue of different trademark standards in different countries needs to be considered. That "crew" could be registered in the USA was a surprise to me; if in some corner of the globe a government allowed a trademark on the word "business" would $7.5 million have been squandered?! Thank you for extending the opportunity to respond to RFC-1. Andrew Moulden |
