 A GREAT point for the clarifying of the issue of "bad faith" any use of a trademark name that leads to a porn site is bad faith. but any use of a trademark name that leads to a site that which either is for, or aginst the trademark holder, is a matter of the 1st amendment of the Constitution of the U.S.- A member of the Human Race should have the right to build a web site that is pro, or con. One should have the right to say" fordsucks and this is why, or I love fords and this is why etc etc. If one belives that using a trademark name in the course of evey day life is some kind of infringement on the trademark holder, then word of mouth advertising about a product, good or bad would lead all of us to court. Please dont confuse the issue of a domain name using a trademark name some place in the name, as "BAD FAITH"- In the end, it will be the WIPO who decides what bad faith is, and not the public who will put it into law, or rules, but it will be the public who will have to pay the price for taking such actions to court. If the World Wide Web is to survive as a form for all people, and all nations, then the laws or rules must be universal, and NOT challenge, nor confuse the current laws of any country. Certainly a trademark holder, or a domain name holder, knows if a similar name is a threat to their business, or a complement to it. No one should have the right to say, there can only be one brand of Toilet paper, or only one brand of Beans, to use or eat, that destroys competition. If I love a certain brand of Toilet Paper I should have the right to build a web site, and proclaim to the World "IsqueezeTheCharmin.com" without the threat of a law suit.
