Shields Organization: UtilityKnife.com Position: ceo Barcelona Judgement: I believe that for the most part WIPO is doing a great job with protecting the rights of trademark holders world wide. However my understanding is that no matter how many trademarks there are for the word "Barcelona" they should not be strong enough to stop someone from using Barcelona.com. This word is too common and used by too many other organizations - no one should own exclusivity. (WIPO should understand this well since you often investigate this very issue). I have to agree with others when they say this judgement is against free speech and free market. The right thing would have been for the city of barcelona to use "Barcelona.gov" or create a new TLD.
