Name: Mike Lococo Organization: n/a Position: n/a In addition to the issues raised by those who feel that registered domains infringe upon them in some way, the rights of domain name holders need to be considered in arbitration policy. Domain registrants using a domain name in good faith (read: hosting services on the internet like web or e-mail service that are related to the domain name they are hosting under) should absolutely NOT have their domain names yanked from under them because I corporation believes the name is too similar to a registered trademark in an unrelated industry. There attitude of arbitrators toward registered domain holders should be "innocent until proven guilty". Domain names should only be turned over if the plaintiff can demonsrate that the name is being used in bad faith. I do not believe this is happening right now, because a large majority of arbitrations are ruled in favor of the plaintiff, and I have read numerous cases where such a ruling was clearly unjustified.
