WIPO Internet Domain Name Process

Report: Brasil regional consultation

The third meeting of the second series of regional consultations in the framework of the WIPO Internet Domain Name Process was held in Rio de Janeiro, Brazil on February 2, 1999. The consultation was organized with the support of the Brazilian Ministry of Science and Technology, the Brazilian Association of Internet Service Providers, the Brazilian Patent and Trademark Institute and the Brazilian Internet Steering Committee, and was held at the Teleporto Convention Center.

Roberto Castelo, Deputy Director General, Christopher Gibson, Head of the Electronic Commerce Section, Office of Legal and Organization Affairs and Patricia Simão, Consultant, attended the meeting on behalf of WIPO. The panel of experts was represented by Professor Michael Froomkin (University of Miami School of Law), Santiago Bustamante (President of the Inter-American Association of Industrial Property –ASIPI), Oscar Sznajder (Co-founder and member of the Latin American and Caribbean Top Level Domains Organization – LACTLD) and Ken Fockler (Board of Trustees of the American Registry for Internet Numbers – ARIN).

Opening remarks were presented by Mr. Castelo and Mr. Gibson, on behalf of WIPO, Mr. Roberto Pinto Martins, Secretary of the Ministry of Science and Technology, Mr. Jorge Machado, President of the Brazilian Patent and Trademark Institute and Mr. Fabio Marinho, President of Brazilian Association of Internet Service Providers.

The presentations and open discussions covered the four main topics to be addressed by the WIPO Internet Domain Name Process:

  • Best practices designed to minimize conflicts arising out of domain name registrations
  • The need for uniform dispute resolution procedures
  • Protection for famous and well-known marks
  • The impact of adding new top-level domains on intellectual property

Issues that attracted particular attention were the desirability of the exclusion mechanism for famous and well-known marks; defining carefully the concept of cybersquatting; and the desirability of distinguishing between commercial and non-commercial domains.
