 The National Office for the Information Economy (NOIE) 38 Sydney Avenue, Forrest Act 2603 GPO Box 2154, Canberra ACT 2600 Australia September 8, 2000 Dear Dr Gurry In response to the 'Request for Comments on Terms of Reference, Procedures and Timetable' for the Second World Intellectual Property Organization (WIPO) Internet Domain Name Process, the National Office for the Information Economy (NOIE) wishes to commend WIPO on its draft Terms of Reference (ToR). The issues outlined in the ToR are consistent with the focus of the letter to WIPO from the Minister for Communications, Information Technology and the Arts, Senator the Hon. Richard Alston (and which was endorsed by a number of WIPO Member states). The letter requested WIPO to initiate a study of, and develop recommendations in relation to areas of continuing concern with regard to Internet domain names. There is definite value in the exploration of the issues raised, in the domain name space, inter alia by bad faith, abusive, misleading or unfair use of: - personal names; - international nonproprietary names (INN) for pharmaceutical substances; - names and acronyms of international intergovernmental organisations; - geographical indications, geographical terms, or indications of source; and - tradenames.
