Name: michael h berkens Organization: worldwide media, inc. Position: president Their must be an equal playing field for all participants holding domain names. One can search to see if their is a federal tradmark registered for a name before registering the name one cannot check for unreigstered names. it is inhertently unfair to hold a regsitrant responsible to know what unregistered trade names there my be some where in the world, especially since there is no time element required for someone to claim that a registered name infringes on their mark. Therefore someone could in good faith register a domain name which is not a registered trademark, deveolpe the site for 5 years only to have someone to claim they have a better claim to the name. Likewise changing the rules at this point and taking away domains from those who had have registered domains under the current rules is unfair. If the domain was not in violation of the policy when the domain was registered to take away the domain now is incredible unfair. What protection does anyone have that a later rule change will not cuase there name to be siezed at some later date when the rules change. Imagine buying a home and then 5 years later the city that the home is located in changes their zoning laws to say that no residential property can be located in that zone and the government seizes the property and gives it to a third party. We need to be fair to all parties not just the big corporations that make the giant contributions to these organizations |
