Organization: NewsBank Inc. newsbank.com Position: IT,IS, software dev, web dev Concerned Personal Domain Owner and ICANN member: The part of this proposal that most bothers me, is the possible abuse of the "trade names" policy. As a domain owner (snowangel.net) I have already received one threat from a California business owner, whose business is called "Snowangel Net". She seemed to feel that "snowangel.net" sounded enough like "Snowangel Net" that this warranted me turning over the domain name. I refused and explained to her that the policies at the time would not justify such action, since I was using the domain for personal, non-profit use. Not to mention that the “net” part of “snowangel.net” is not comparable to the “Net” in “Snowangel Net”. However, I am greatly concerned that this new, much broader policy may be abused to target people like myself, who own personal domains that sound similar to a "trade name". If you wish to implement such a broad policy, please be CERTAIN you can make sure that it is ONLY used against those who wish to profit fr! om a "trade name" domain. It would be a terribly sad day when for example, someone named Joe Heinz were to lose his personal website to Heinz Ketchup. This policy may only succeed in frightening away the non-tech-savvy from the internet. Please consider making this policy less vague. You are leaving internet-ignorant lawyers to fill in the gaps.
