Name: Josh Berkus Organization: Aglio Database Solutions Position: Owner WIPO Arbitrators: Upon a brief perusal, I find your new proposed standards far too broad - especially as they apply to existing web sites. While your general policy claims only to apply these rules to domains held in "bad faith," the record of your arbitrators has been to take away domains from those who established them with legitimate reason, should such domains conflict with corporate trademarks. I suggest that you revise your policy as following: 1. I see no good reason for the Geographic Area condition. Remove it. 2. If any broadened rules on trademark are passed, exisiting web sites should be "grandfathered in;" that is, considered immune from the new standards lest the site owners be harmed and deprived of property under guidlines that did not exist when they created the site. 3. Your personal name and trademark guidlines also make no provision for parody and political criticism. In the U.S., the right to use the name of a famous person or trademark for purposes of satire or journalism are protected; they should be protected for domains as well. -Josh Berkus ICANN At Large Member |
