This strikes me as being designed so that big business can rake the little guy over the proverbial coals.
Picture this: I'm running small firm, or a start up, and I put up a web site with my own domain. A larger company notices me, decides that I'm cutting in on their action, and demands my domain name. Under your rules, who has the valid claim to the domain name is irrelevant. It's a matter of who can financially afford the fight. And if I surrender my domain name to the larger company, they are then free to set up a competing business, including web pages that look just like mine, and compete against me.
If you don't believe this scenario, then take a closer look at the cases that have already happened. Archie comics going after veronica.org. Or the recent attempts by Earth Shoes on earth.com.
You are meddling in laws to benefit large corporations at the expense of the people. As one of those people, I don't like that!!!
