Bekendtgørelse om henlæggelse af visse beføjelser til Patentdirektoratet (Overførselsbekendtgørelsen)

§ 1. Beføjelser til at fastsætte bestemmelser, som efter følgende

love er tillagt industriministeren, udøves af Patentdirektoratet, jf.

dog § 2:

 1) Patentlov.  2) Lov om brugsmodeller m.v.  3) Varemærkelov.  4) Lov om mønstre.  5) Lov om fællesmærker.  6) Lov om hemmelige patenter.  7) Lov om kommunernes styrelse.  8) Lov om beskyttelse af halvlederprodukters udformning (topografi).

§ 2. Følgende beføjelser henlægges ikke til Patentdirektoratet:

 1) Beføjelser efter § 7, stk. 2 og 4, i patentloven, jf. lovbekendtgørelse nr. 733 af 27. november 1989, om nedsættelse af Patentankenævnet (Ankenævnet for Industriel Ejendomsret) og om betaling af gebyrer.

 2) Beføjelser efter § 47 i lov nr. 130 af 26. februar 1992 om brugsmodeller m.v. til at fastsætte regler om, at frembringelser, der vedrører fremgangsmåder, kan registreres som brugsmodeller.

 3) Beføjelser efter § 17, stk. 1 og 2, i lov nr. 778 af 9. december 1987 om beskyttelse af halvlederprodukters udformning (topografi) om nedsættelse af et ankenævn og om fastsættelse af regler om ankenævnets sammensætning og forretningsorden samt om betaling af gebyrer.

 4) Beføjelse efter § 19 i lov nr. 778 af 9. december 1987 om beskyttelse af halvlederprodukters udformning (topografi) til at fastsætte tidspunktet for ikrafttrædelse af lovens kap. 3 om tvangslicens.

§ 3. Bekendtgørelsen træder i kraft den 1. juli 1992.

Stk. 2. Bekendtgørelse nr. 105 af 3. marts 1988 om henlæggelse af visse beføjelser til Patentdirektoratet ophæves.
