Panelist at WIPO and FORUM

The format doesn't allow me to submit the full opinion, even if it's 500 words or less. That's why I'm attaching it in Word. In my opinion, it's important for ICANN to make efforts to raise awareness of the UDRP in Latin America, whether through bootcamps, seminars, workshops, and other activities. The region's ccTLDs, at least in Guatemala, have very limited application of the UDRP. I support the appeal process as an additional safeguard for the parties. It would be ideal to adopt it.

As a team of computer security researchers who recently conducted an in-depth empirical analysis of 90,153 UDRP decisions, we appreciate the opportunity to comment on this valuable report from the WIPO-ICA team. Generally, we believe that the upcoming Phase 2 review of the UDRP should leverage data-driven analyses to complement experts' practical experience. This will ensure that meaningful policy changes are adopted, enhancing the UDRP's fairness and effectiveness.

The quality of pleadings and evidence in UDRP cases are often lacking and, in rare instances, reasonable defenses are not put forth by defaulting respondents. Education of all participants and sufficient notice of disputes are key to promoting the fair and equitable administration of justice through the UDRP which is a critical and efficient but relatively unappreciated Policy outside the niche realm of those who are familiar with domain name disputes.

Provides a helpful roadmap for ICANN to follow.

The first draft of the UDRP was created over 25 years ago. The intervening years have demonstrated many ways that the Policy could be improved to better fulfill its purpose of addressing trademark abuse while protecting the rights of innocent domain name registrants. The WIPO-ICA UDRP review project has identified numerous areas for meaningful improvement. It is time to move forward, and this project provides a roadmap for ICANN to follow.

Like any legitimate court or legitimate institution, the UDRP should encourage scrutiny, not only in words, but also in practice. The simplest way is to codify access to the documentation behind the decisions into statute or law. In Sweden, the first country to ever codify public access to information in the constitution, it has been the law for 266 years. A very proven, pragmatic and successful law.

RAW life PRIMU

I would like to express my appreciation for the ongoing efforts to improve the Uniform Domain Name Dispute Resolution Policy (UDRP). As the founder of RAW Life PRIMU, a global initiative promoting child health and intellectual property protection through innovation, I believe domain name protection is essential for early-stage brands.
I would be honored to contribute to the discussion and share our challenges in securing domain rights for socially impactful projects.
