Tucows Public Comment: WIPO-ICA UDRP Review Report

The format doesn't allow me to submit the full opinion, even if it's 500 words or less. That's why I'm attaching it in Word. In my opinion, it's important for ICANN to make efforts to raise awareness of the UDRP in Latin America, whether through bootcamps, seminars, workshops, and other activities. The region's ccTLDs, at least in Guatemala, have very limited application of the UDRP. I support the appeal process as an additional safeguard for the parties. It would be ideal to adopt it.

We are a group of academics and civil liberties attorneys specializing in intellectual property, free speech, fair use and fair dealing, unfair competition, and domain names, and we have many concerns about this Report and the process for writing and presenting it. Overall, our concerns include: Lack of data, lack of structural separation, bypassing of clear free speech concerns in certain recommendations provided. Our full comment is attached.

It was a great pleasure to present to the Project Coordinators on my recommendations for the UDRP and thank you for your work. My extensive research, conducted through Maastricht University focuses, inter alia, on an improved UDRP and is expected to soon be published (Oct 2025 expected) as: Raj Sachdev, Digital Trademarks and Brands: Towards an Improved UDRP and Platform Policies, Kluwer Law International BV, (forthcoming 2025).

Origin Italia – Italian Association of Geographical Indication Consortia brings together the protection consortia of PDO and PGI agri-food products. Origin Italia currently includes 87 consortia involved in PDO and PGI production, as well as two associations of consortia: Afidop (Association of Italian PDO and PGI Cheeses) and Salumitalia – Consortia for Geographical Indication. Altogether, it represents over 95 of Italy’s Geographical Indication production.

As a team of computer security researchers who recently conducted an in-depth empirical analysis of 90,153 UDRP decisions, we appreciate the opportunity to comment on this valuable report from the WIPO-ICA team. Generally, we believe that the upcoming Phase 2 review of the UDRP should leverage data-driven analyses to complement experts' practical experience. This will ensure that meaningful policy changes are adopted, enhancing the UDRP's fairness and effectiveness.

BNIC regrets the exclusion of GIs from the UDRP review, despite their recognition as IP rights. Given the rise in online abuse, we call for their reintegration into the review, recognition as valid rights, and the involvement of GI stakeholders. Origin Italia – Italian Association of Geographical Indication Consortia brings together the protection consortia of PDO and PGI agri-food products. PALSO, the French producers' group for the PGI Canard à foie gras du Sud-Ouest, represents 1,400 duck farmers and 140 processors. As a GI rights holder, we wish to comment on WIPO-ICA’s UDRP review draft. While recognizing the UDRP's success, we regret the recommendation not to consider expanding its scope to include legitimate rights like GIs in ICANN’s Phase 2 Review.

I appreciate the efforts of the review team in preparing the initial report of the WIPO-ICA UDRP review. My comments are as attached.

The quality of pleadings and evidence in UDRP cases are often lacking and, in rare instances, reasonable defenses are not put forth by defaulting respondents. Education of all participants and sufficient notice of disputes are key to promoting the fair and equitable administration of justice through the UDRP which is a critical and efficient but relatively unappreciated Policy outside the niche realm of those who are familiar with domain name disputes.

The Business Constituency (BC) appreciates the opportunity to comment on the WIPO-ICA UDRP Review Initial Report. We commend WIPO, the ICA, and the Project Team for their expert-led, inclusive approach. The BC values this contribution as a model of multistakeholder collaboration and a strong foundation for future UDRP-related policy discussions.

The Spanish Ministry of Agriculture, Fisheries and Food considers it is necessary that Geographical Indications be considered as intellectual property rights in ICANN's dispute resolution system.

AIM, the European Brands Association, commends WIPO and the ICA for this initiative. The UDRP is globally recognised as the most efficient and practical brand protection tool in the Domain Name System, and as ICANN’s most successful consensus policy. Any potential review must therefore be conducted with the utmost care. We would strongly support the GNSO Council accepting the Final Report as a key input to any eventual review of the UDRP.

The Consorzio del Prosciutto di Parma was set up in 1963, on the initiative of 23 producers with the objectives of safeguarding the genuine product, its tradition and the image represented by the designation ‘Parma’. Since 1970, when the first law on Parma Ham was passed, it is the official body in charge for safeguarding, protecting and promoting the the Designation of Origin “Prosciutto di Parma”. Nowadays the Consortium associates the 127 producers of Parma Ham.

Consortium PDO Fontina calls on ICANN and WIPO to review the initial report and to seize on the ongoing work to start discussing the inclusion of GIs in ICANN’s Phase 2 Review of the UDRP with a view to recognize GIs as IP rights eligible for protection under the UDRP.

A GI (Geographic Indication) should be considered as an IP. Therefore, the managing offices of GIs should be able to veto a domain name.

The recommendation that the potential expansion of the Uniform Domain Name Dispute Resolution Policy (UDRP) to include Geographical Indications (GIs) should not be considered in ICANN's upcoming Phase 2 Review represents a serious missed opportunity.

I welcome the WIPO – ICA initiative to review the UDRP. The first draft of the UDRP was created over 25 years ago. The intervening years have demonstrated many ways that the Policy could be improved to better fulfill its purpose of addressing trademark abuse while protecting the rights of innocent domain name registrants. The WIPO-ICA UDRP review project has identified numerous areas for meaningful improvement. It is time to move forward, and this project provides a roadmap for ICANN to follow.

I support the hard work and dedication that it took to put together this thorough review of the WIPO-ICA UDRP Review Project and think that this paper will serve as a springboard to further discussions on the topic, which I would very much like to participate in when the time comes.

Like any legitimate court or legitimate institution, the UDRP should encourage scrutiny, not only in words, but also in practice. The simplest way is to codify access to the documentation behind the decisions into statute or law. In Sweden, the first country to ever codify public access to information in the constitution, it has been the law for 266 years. A very proven, pragmatic and successful law.
