The Executive Directive of the Law No. 15 of 2004 on E-signature and Establishment of the Information Technology Industry Development Authority (ITIDA) ('the Law') was issued on May 15, 2005 by the Decree No. 109 of 2005 of the Ministry of Communication and Information Technology. It contains 24 articles and the Technical Annex, which are attached to the said Decree.
The purpose of the Executive Directive is to develop systems and rules for e-signatures and e-transactions in compliance with the terms stipulated in the Law. The Executive Directive ensures security of providing electronic signature-creation data, among others, by protecting the e-signature against forgery, imitation or any other forms of manipulation, or against the possibility of being created by other than the signer (Article 2); sets out the necessary technical and technological rules for e-signature creation data (Article 3); and stipulates procedures, rules and guarantees for the issuance of the digital certificates by the the Information Technology Industry Development Agency (ITIDA) (Articles 5, 12, 14, 15 & 21).
