Act No. 68/1995 on the Lugano Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters

Article 1

Ratification is authorized on behalf of Iceland of the Convention on jurisdiction and the enforcement of judgments in civil and commercial matters, concluded at Lugano 16 September 1988 (the Lugano Convention), with the three Protocols annexed to the Convention and forming an integral part thereof.

The Convention, with its Protocols and Declarations, is attached to this Act in the form of an Annex.

Article 2

The Lugano Convention and its three annexed Protocols shall have the force of law in Iceland.

Article 3

Judgments rendered in another Contracting State on the basis of jurisdiction as provided for in Article 5 (1) and Article 16 (1) (b) of the Lugano Convention shall be recognized and enforced in Iceland, even if the State in question has made the reservation that it will not recognize or enforce Icelandic judgments in similar cases.

Judgments exempted from recognition or enforcement requirements by Article II, the second paragraph, of Protocol 1 to the Convention, shall not have any legal effects in Iceland.

Article 4

The provisions of Article 1 of this Act shal enter into effect immediately.

The other provisions of this Act shall enter into effect when the Lugano Convention enters into force for Iceland.
