Article 11 of the Code of Advertising provides for factors to be taken into account in determining whether advertising is misleading, which include, among others, the characteristics of the products such as false advertising of geographical or commercial origin of the products (as defined in Section 2a); and the nature, attributes and rights of the advertiser such as his ownership of industrial, commercial or intellectual property rights (as defined in Section 2c).
Article 16 sets out the conditions for permitted comparative advertising. These conditions are based on regulations on advertising, unfair competition and industrial property.
Among others, Article 16(d-h) provides the requirements for the use of a competitor’s trademark, trade name and geographical origin of products and services in comparative advertising.
