Year of Version 2007 Dates Entry into force: April 18, 2007 Issued: February 6, 2007 Type of Text Implementing Rules/Regulations   Subject Matter Patents (Inventions), Plant Variety Protection, Genetic Resources, Traditional Knowledge (TK) Subject Matter (secondary) IP Regulatory Body Notes This Decree was issued pursuant to Articles 62 and 69 of Law No. 7788 on Biodiversity. It regulates the access to genetic and biochemical elements and resources of biodiversity, whether they are wild, domesticated, terrestrial, marine, from fresh water or aerial, in ex-situ conditions, existing in collections of natural or legal persons, both public and private, in any part of the national territory. The Decree explicitly requires the applicant to follow a Code of Conduct for Access to Genetic Resources (see Annex II of the Decree).
