BİRİNCİ BÖLÜM Amaç, Kapsam, Tanımlar Ve Korumadan Yararlanacak Kişiler
Amaç ve kapsam Madde 1 - Bu Kanun Hükmünde Kararnamenin amacı, bu Kanun Hükmünde Kararname hükümlerine uygun olarak tescil edilen markaların korunmasını sağlamaktır.
Bu Kanun Hükmünde Kararname, markaların korunmasına ilişkin esasları, kuralları ve şartları kapsar.
Tanımlar Madde 2 - Bu Kanun Hükmünde Kararnamede geçen: a) "Marka", ortak markalar ve garanti markaları dahil ticaret markaları veya hizmet markalarını, b) "Paris Sözleşmesi", Sınai Mülkiyetin Himayesine Mahsus Milletlerarası Bir İttihat İhdas Edilmesine Dair 20 Mart 1883 Tarihli Mukavele ile Türkiye tarafından onaylanmış değişikliklerini, c) "Enstitü", 544 sayılı Kanun Hükmünde Kararname ile kurulan Türk Patent Enstitüsü'nü, d) "Marka Vekili", bu Kanun Hükmünde Kararnamede belirtilen haklarla ilgili konularda, ilgili kişileri Enstitü nezdinde temsil eden, danışmanlık yapan ve haklarının korunması için Enstitü nezdinde gerekli girişimlerde bulunan ve işlemleri yürüten kişileri, ifade eder.
Korumadan yararlanacak kişiler Madde 3 - Bu Kanun Hükmünde Kararnamenin öngördüğü koruma; Türkiye Cumhuriyeti sınırları içinde ikametgahı olan veya sınai veya ticari faaliyette bulunan gerçek veya tüzel kişilerce veya Paris Sözleşmesi yahut Dünya Ticaret Örgütü Kuruluş Anlaşması hükümleri dahilinde başvuru hakkına sahip kişilerce elde edilir.
Bu Kanun Hükmünde Kararname kapsamına girmemekle beraber, Türkiye Cumhuriyeti uyruğundaki kişilere kanunen veya fiilen marka koruması tanımış yabancı devletlerin gerçek veya tüzel kişileri de karşılıklılık ilkesi uyarınca Türkiye'de marka korunmasından aynı şekilde yararlanır.
Milletlerarası anlaşmaların öncelikle uygulanması Madde 4 - Türkiye Cumhuriyeti kanunlarına göre yürürlüğe konulmuş milletlerarası anlaşma hükümlerinin bu Kanun Hükmünde Kararname hükümlerinden daha elverişli olması halinde, 3 üncü maddede belirtilen kişiler, elverişli hükümlerin uygulanmasını talep etme hakkına sahiptir.
İKİNCİ BÖLÜM Markanın İçereceği İşaretler Ve Markanın Elde Edilmesi
Markanın içereceği işaretler Madde 5 - Marka, bir teşebbüsün mal veya hizmetlerini bir başka teşebbüsün mal veya hizmetlerinden ayırt etmeyi sağlaması koşuluyla, kişi adları dahil, özellikle sözcükler, şekiller, harfler, sayılar (Ek ibare: 4128 - 3.11.1995) "malların biçimi veya (Değişik ibare: 5194 - 22.6.2004 /m.12) "ambalajları"" gibi çizimle görüntülenebilen veya benzer biçimde ifade edilebilen, baskı yoluyla yayınlanabilen ve çoğaltılabilen her türlü işaretleri içerir.
Marka, mal veya ambalajı ile birlikte tescil ettirilebilir. Bu durumda mal veya ambalajın tescili marka sahibine mal veya ambalaj için inhisari bir hak sağlamaz. (Ek cümle: 5194 - 22.6.2004 / m.12) "İnhisari hak sağlamayan bu tür unsurlar tescil belgesi üzerinde açıkça belirtilir."
Marka hakkının elde edilmesi Madde 6 - Bu Kanun Hükmünde Kararname ile sağlanan marka koruması tescil yoluyla elde edilir.
Marka tescilinde red için mutlak nedenler Madde 7 - Aşağıda yazılı işaretler marka olarak tescil edilemez: a) 5 inci madde kapsamına girmeyen işaretler, b) (Değişik: 5194 - 22.6.2004 /m.13) Aynı veya aynı türdeki mal veya hizmetle ilgili olarak tescil edilmiş veya daha önce tescil için başvurusu yapılmış bir marka ile aynı veya ayırt edilemeyecek kadar benzer markalar, c) Ticaret alanında cins, çeşit, (Ek ibare: 4128 - 3.11.1995 / m.5) "vasıf", kalite, miktar, amaç, değer, coğrafi kaynak belirten veya malların üretildiği, hizmetlerin yapıldığı zamanı gösteren veya malların ve hizmetlerin diğer karakteristik özelliklerini belirten işaret ve adlandırmaları münhasıran veya esas unsur olarak içeren markalar, d) Ticaret alanında herkes tarafından kullanılan veya belirli bir meslek, sanat veya ticaret grubuna mensup olanları ayırt etmeye yarayan işaret ve adları münhasıran veya esas unsur olarak içeren markalar, e) Malın özgün doğal yapısından ortaya çıkan şeklini veya bir teknik sonucu elde etmek için zorunlu olan, kendine malın şeklini veya mala asli değerini veren şekli içeren işaretler, f) Mal veya hizmeti niteliği, kalitesi veya üretim yeri, coğrafi kaynığı gibi konularda halkı yanıltacak markalar, g) Yetkili mercilerden kullanmak için izin alınmamış ve dolayısıyla Paris Sözleşmesinin 2 nci mükerrer 6 ncı maddesine göre reddedilecek markalar, h) Paris Sözleşmesinin 2 nci mükerrer 6 ncı maddesi kapsamı dışında kalan ancak kamuyu ilgilendiren, tarihi, kültürel değerler bakımından halka mal olmuş ve ilgili mercilerin tescil izni vermediği diğer armalar, amblemler veya nişanlar içeren markalar, ı) Sahibi tarafından izin verilmeyen Paris Sözleşmesinin 1 inci mükerrer 6 ncı maddesine göre tanınmış markalar, j) Dini değerleri ve sembolleri içeren markalar, k) Kamu düzenine ve genel ahlaka aykırı markalar.
(Değişik 2. fıkra: 5194 - 22.6.2004 / m.13) Bir marka tescil tarihinden önce kullanılmış ve tescile konu mallar veya hizmetlerle ilgili olarak bu kullanım sonucu ayırt edici bir nitelik kazanmış ise (a), (c) ve (d) bentlerine göre tescili reddedilemez.
Marka tescilinde red için nispi nedenler Madde 8 - Tescil edilmiş veya tescil için başvuru yapılmış bir markanın sahibi tarafından itiraz yapılması durumunda, aşağıdaki hallerde marka tescil edilemez:
a) Tescil için başvurusu yapılan marka, tescil edilmiş veya tescil için daha önce başvurusu yapılmış bir marka ile aynı ise ve aynı mal veya hizmetleri kapsıyorsa, b) Tescil için başvurusu yapılan marka, tescil edilmiş veya tescil için daha önce başvurusu yapılmış bir marka ile aynı veya benzer ise ve tescil edilmiş veya tescil için başvurusu yapılmış bir markanın kapsadığı mal veya hizmetlerle aynı veya benzer ise, tescil edilmiş veya tescil için başvurusu yapılmış markanın halk tarafından karıştırılma ihtimali varsa ve bu karıştırılma ihtimali tescil edilmiş veya tescil için başvurusu yapılmış bir marka ile ilişkili olduğu ihtimalini de kapsıyorsa.
Marka sahibinin ticari vekili veya temsilcisi tarafından markanın kendi adına tescili için, marka sahibinin izni olmadan ve geçerli bir gerekçe gösterilmeden yapılan başvuru, marka sahibinin itirazı üzerine red edilir.
Tescilsiz bir markanın veya ticaret sırasında kulanılan bir başka işaretin sahibinin itiraz etmesi üzerine, tescili istenen marka, aşağıdaki hallerde tescil edilmez. a) Markanın tescili için yapılan başvuru tarihinden önce veya markanın tescili için yapılan başvuruda belirtilen rüçhan tarihinden önce bu işaret için hak elde edilmiş ise, b) Belirtilen işaret, sahibine daha sonraki bir markanın kullanımını yasaklama hakkını veriyorsa.
Marka, tescil edilmiş veya tescil için başvurusu daha önce yapılmış bir markanın aynı veya benzeri olmakla birlikte, farklı mallar veya hizmetlerde kullanılabilir. Ancak, tescil edilmiş veya tescil için başvurusu yapılmış markanın, toplumda ulaştığı tanınmışlık düzeyi nedeniyle haksız bir yararın sağlanabileceği, markanın itibarına zarar verebileceği veya tescil için başvurusu yapılmış markanın ayırt edici karakterini zedeleyici sonuçlar doğurabileceği durumda, tescil edilmiş veya tescil için başvurusu daha önce yapılmış bir marka sahibinin itirazı üzerine, farklı mal veya hizmetlerde kullanılacak olsa bile, sonraki markanın tescil başvurusu reddedilir.
Tescil için başvurusu yapılmış markanın, başkasına ait kişi ismi, fotoğrafı, telif hakkı veya herhangi bir sınai mülkiyet hakkını kapsaması halinde, hak sahibinin itirazı üzerine tescil başvurusu reddedilir.
Ortak ve garanti markalarının sona ermesinden itibaren üç yıl içinde ortak marka veya garanti markası ile aynı veya benzeri olan marka tescil başvurusu itiraz üzerine reddedilir.
Bir markanın yenilenmeme nedeniyle koruma süresinin dolmasından sonra iki yıl içerisinde aynı veya benzer markanın, aynı veya benzer mal ve hizmetler için yapılan tescil başvurusu itiraz üzerine reddedilir.
ÜÇÜNCÜ BÖLÜM Markanın Koruma Kapsamı
Marka tescilinden doğan hakların kapsamı Madde 9 – (Değişik: 5833 - 21.01.2009 / m. 1) Marka tescilinden doğan haklar münhasıran marka sahibine aittir. Marka sahibi, aşağıda belirtilen fiillerin önlenmesini talep edebilir:
a) Markanın tescil kapsamına giren aynı mal ve/veya hizmetlerle ilgili olarak, tescilli marka ile aynı olan herhangi bir işaretin kullanılması.
b) Tescilli marka ile aynı veya benzer olan ve tescilli markanın kapsadığı mal ve/veya hizmetlerin aynı veya benzeri mal ve/veya hizmetleri kapsayan ve bu nedenle halk tarafından, işaret ile tescilli marka arasında ilişkilendirilme ihtimali de dahil, karıştırılma ihtimali bulunan herhangi bir işaretin kullanılması.
c) Tescilli marka ile aynı veya benzer olan ve tescilli markanın kapsamına giren mal ve/veya hizmetlerle benzer olmayan, ancak Türkiye'de ulaştığı tanınmışlık düzeyi nedeniyle
tescilli markanın itibarından dolayı haksız bir yarar elde edecek veya tescilli markanın itibarına zarar verecek veya tescilli markanın ayırt edici karakterini zedeleyecek nitelikteki herhangi bir işaretin kullanılması.
Aşağıda belirtilen durumlar, birinci fıkra hükmü uyarınca yasaklanabilir: a) İşaretin mal veya ambalajı üzerine konulması. b) İşareti taşıyan malın piyasaya sürülmesi veya bu amaçla stoklanması, teslim
edilebileceğinin teklif edilmesi veya o işaret altında hizmetlerin sunulması veya sağlanması. c) İşareti taşıyan malın gümrük bölgesine girmesi, gümrükçe onaylanmış bir işlem
veya kullanıma tabi tutulması. d) İşaretin, teşebbüsün iş evrakı ve reklamlarında kullanılması. e) İşareti kullanan kişinin, işaretin kullanımına ilişkin hakkı veya meşru bir bağlantısı
olmaması koşuluyla, işaretin aynı veya benzerinin internet ortamında ticari etki yaratacak biçimde, alan adı, yönlendirici kod, anahtar sözcük veya benzeri biçimlerde kullanılması.
Markanın sahibine sağladığı haklar, üçüncü kişilere karşı marka tescilinin yayın tarihi itibarıyla hüküm ifade eder. Marka tescil başvurusunun bültende yayınlanmasından sonra gerçekleşen ve marka tescilinin ilan edilmesi halinde yasaklanması söz konusu olabilecek fiiller nedeniyle başvuru sahibi, tazminat davası açmaya yetkilidir. Mahkeme, öne sürülen iddiaların geçerliliğine ilişkin olarak tescilin yayınlanmasından önce karar veremez.
Markanın sözlük veya başka başvuru eserlerinde yer alması Madde 10 - Tescilli bir markanın, tescilli olduğu belirtilmeden bir sözlük, ansiklopedi veya bir başka başvuru eserinde, jenerik ad izlenimi verecek şekilde, yayımlanması durumunda, marka sahibinin talebi üzerine yayımcı, yayımın sonraki ilk sayısında yanlışdığı düzeltir.
Ticari vekil veya temsilci adına tescilli markanın kullanımının yasaklanması Madde 11 - Marka sahibinin ticari vekili veya temsilcisi adına, marka sahibinin izni alınmadan marka tescili yapılması halinde; marka sahibi kullanım için yetki vermemiş ise ve ticari vekil veya temsilcinin haklı bir gerekçesi yoksa, marka sahibinin markasının kullanılmasına itiraz etmek hakkı vardır.
Marka tescilinden doğan hakların kapsamında istisna Madde 12 - Dürüstçe ve ticari veya sanayi konularıyla ilgili olarak kullanılmaları koşuluyla üçüncü kişilerin, ad ve adresini, mal veya hizmetlerle ilgili cins, kalite, miktar, kullanım amacı, değer, coğrafi kaynak, üretim veya sunuluş zamanı veya diğer niteliklere ilişkin açıklamaları kullanmaları marka sahibi tarafından engellenemez.
Marka tescilinden doğan hakların tüketilmesi Madde 13 - Tescilli bir markanın tescil kapsamındaki mal üzerine konularak marka sahibi tarafından veya onun izni ile Türkiye'de piyasaya sunulmasından sonra, mallarla ilgili fiiller marka tescilinden doğan hakkın kapsamı dışında kalır.
Marka sahibinin, birinci fıkra hükmüne girmesine rağmen, malın piyasaya sunulmasından sonra, üçüncü kişiler tarafından değiştirilerek veya kötüleştirilerek ticari amaçlı kullanmalarını önleme yetkisi vardır.
DÖRDÜNCÜ BÖLÜM Markanın Kullanılması
Markanın kullanılması Madde 14 - Markanın, tescil tarihinden itibaren beş yıl içinde, haklı bir neden olmadan kullanılma-ması veya bu kullanıma beş yıllık bir süre için kesintisiz ara verilmesi halinde, marka iptal edilir.
Aşağıda belirtilen durumlar markayı kullanma kabul edilir:
a) Tescilli markanın ayırt edici karakterini değiştirmeden markanın farklı unsurlarla kullanılması, b) Markanın yalnız ihracat amacıyla mal ya da ambalajlarında kullanılması, c) Markanın, marka sahibinin izni ile kullanılması, d) Markayı taşıyan malın ithalatı.
BEŞİNCİ BÖLÜM Marka Tescilinden Doğan Haklarla İlgili Hukuki İşlemler
Markanın hukuki işlemlere konu olması Madde 15 - Tescilli bir marka, başkasına devir edilebilir, miras yolu ile intikal edebilir, kullanma hakkı lisans konusu olabilir, rehin edilebilir. Rehin hakkı bakımından Medeni Kanunun rehin hakkına ilişkin hükümleri uygulanır.
Tescilli bir marka üzerindeki sağalararası işlemler yazılı şekle tabidir.
Markanın devri Madde 16 - Marka, tescil edildiği mal veya hizmetlerin tümü veya bir kısmı için devredilebilir.
Bir işletmenin aktif ve pasifleri ile birlikte devri, aksi kararlaştırılmamışsa, işletmeye ait markaların da devrini kapsar. Bu hüküm, işletmenin devrine, sözleşmeden doğan yükümlülük halinde uygulanır.
İkinci fıkra hükmü hariç olmak üzere, bir markanın devri, mahkeme kararının sonucu olan devir hariç, yazılı olarak yapılır ve devir sözleşmesi taraflarca imzalanır. Aksine sözleşmeler hükümsüzdür.
Markanın devri, mal veya hizmetlerin coğrafi kaynağı, kalitesi veya markanın kendisi ile ilgili olarak halkı yanılgıya düşürebilecek nitelikte ise, yeni marka sahibi halkı yanılgıya düşürmeyecek şekilde mal veya hizmetlerde marka tescilinin sınırlı bir hale getirilmesini kabul etmediği takdirde, devir işlemi Enstitü tarafından yapılmaz.
Tescilli bir markanın devri sırasında aynı markanın veya ayırt edilemeyecek derecede benzerinin, aynı veya halkı yanılgıya düşürecek derecede benzeri mallar veya hizmetler için başka marka tescillerinin bulunması halinde, bu markaların da devredilmesi şarttır.
Devir, taraflardan birinin talebi üzerine, sicile kayıt edilir ve yayınlanır.
Devir, sicile kayıt edilmediği sürece, taraflar markanın tescilinden doğan yetkileri iyiniyetli üçüncü kişilere karşı ileri süremez.
Ticari vekil veya temsilci adına tescilli markanın devri Madde 17 - Marka sahibinin izni olmadan onun ticari vekili veya temsilcisi adına marka tescil edilmesi halinde, ticari vekil veya temsilcinin haklı bir gerekçesi yoksa, marka sahibinin söz konusu tescilin kendi lehine devredilmesini isteme yetkisi vardır.
Markanın teminat olarak gösterilmesi Madde 18 - Tescilli bir marka, işletmeden bağımsız olarak, teminat olarak gösterilebilir.
Markanın teminat olarak gösterilmesi, taraflardan birinin talebi üzerine, sicile kayıt edilir ve yayınlanır.
Haciz Madde 19 - Tescilli bir marka işletmeden bağımsız olarak, haciz edilebilir.
Haciz sicile kayıt edilir ve yayınlanır.
Lisans Madde 20 - Tescilli bir markanın kullanım hakkı, tescil edildiği mal veya hizmetlerin bir kısmı veya tamamı için lisans sözleşmesine konu olabilir.
Lisans şartları Madde 21 - Lisans, inhisari lisans veya inhisari olmayan lisans şeklinde verilebilir.
Aksi sözleşmede kararlaştırılmamışsa, lisans inhisari değildir. Lisans veren markayı kendi kullanabileceği gibi, üçüncü kişilere aynı markaya ilişkin başka lisanslar da verebilir.
İnhisari lisans söz konusu olduğu zaman, lisans veren başkasına lisans veremez ve hakkını açıkça saklı tutmadıkça, kendisi de markayı kullanamaz.
Aksi sözleşmede kararlaştırılmamışsa lisans sahipleri, lisanstan doğan haklarını üçüncü kişilere devredemez veya alt lisans veremez.
Aksi sözleşmede kararlaştırılmamışsa lisans hakkını alan kişi, markanın koruma süresinde markanın kullanılmasına ilişkin her türlü tasarufta bulunabilir.
Aksi sözleşmede kararlaştırılmamışsa, inhisari lisansa sahip olan kişi, üçüncü bir kişi tarafından marka sahibinin markadan doğan haklarına, tecavüz edilmesi durumunda, marka sahibinin bu Kanun Hükmünde Kararname uyarınca açabileceği davaları, kendi adına açabilir. İnhisari olmayan lisans sahiplerinin, dava açma hakları yoktur.
Altıncı fıkra hükümlerine göre, markaya tecavüz dolayısıyla dava açma hakkı olmayan bir lisans alan, noter vasıtasıyla yapacağı bir bildirimle, gereken davayı açmasını marka sahibinden isteyebilir. Marka sahibinin, bu talebi kabul etmemesi veya bildirimin alındığı tarihten itibaren üç ay içinde, gerekli davanın açılmaması halinde, lisans alan yaptığı bildirimi de ekleyerek, kendi adına dava açılabilir. Lisans alan, ciddi bir zarar tehlikesi karşısında ve söz konusu sürenin geçmesinden önce, ihtiyati tedbire karar verilmesini mahkemeden talep edebilir. Lisans alan, dava açtığını marka sahibine bildirir.
Marka sahibi, talimatlarıyla uygunluk içinde, lisans alan tarafından üretilen malın veya sunulan hizmetlerin kalitesini garanti edecek önlemleri alır.
Sözleşme şartlarının lisans alan tarafından ihlali halinde, tescilli bir markadan doğan haklar, lisans alana karşı, dava yoluyla ileri sürülebilir.
Lisans sicile kayıt edilmediği sürece, iyiniyetli üçüncü kişilere karşı ileri sürülemez.
Lisans sözleşmelerinde, bu Kanun Hükmünde Kararname ile konuya ilişkin diğer kanun, tüzük, yönetmelik ve tebliğlere aykırı hükümler bulunamaz. Bu tür düzenlemeler lisans tarihinden sonra yapılsa dahi, lisans sözleşmelerindeki aykırı hükümler geçersiz sayılır.
Hukuki işlemlerin başvurulara uygulanması
Madde 22 - Devir, lisans, intikal, haciz, rehin ve marka sahibi hakkındaki değişiklikler ile ilgili hukuki işlemler marka başvurularına da uygulanır. (Ek fıkra: 5194 - 22.6.2004 / m.14) Bildirim adresinde bir değişiklik olması durumunda, adres değişikliğinin yazılı olarak Enstitüye bildirilmesi zorunludur. Bu bildirimin yapılmaması halinde, Enstitüde mevcut en son adrese yapılmış bildirimler geçerlidir.
İKİNCİ KISIM BAŞVURU
BİRİNCİ BÖLÜM Marka Başvurusu ve Ekleri
Başvuru şartları Madde 23 - Bir markanın tescil edilmesi için, aşağıda belirtilen unsurlar ile başvuruda bulunmak şarttır: a) Şekli ve kapsamı yönetmelikte belirlenen, başvuru sahibinin kimliğine ilişkin bilgileri de içeren başvuru dilekçesi, b) Markanın yayına ve çoğaltmaya elverişli örneği, c) Markanın kullanılacağı malların veya hizmetlerin listesi, d) Başvuru ücretinin ödendiğini gösterir belge aslı, e) Sınıf veya sınıfların ücretinin ödendiğini gösterir belge aslı, f) Marka vekili tayin edilmiş ise vekaletname, g) Başvuru sahibi tüzel kişi ise imza sirküleri, h) Başvuru sahibinin ticaretle uğraştığını gösterir belge.
Bir marka tescil başvurusunun geçerliliği için, başvuru ücretinin başvuru ile birlikte ödenmesi şarttır.
Her marka tescili için ayrı başvuru yapılması zorunludur.
Bir marka başvurusu ile birlikte veya daha sonra Ensititüye verilecek her türlü belge, bu Kanun Hükmünde Kararnameye ilişkin yönetmelikte öngörülen hususları kapsar.
Sınıflandırma Madde 24 - Markaların kullanılacağı mallar veya hizmetler, markaların tescili amaçları için malların veya hizmetlerin uluslararası sınıflandırılmasına ilişkin esaslara göre sınıflandırılır. Sınıflandırma ile ilgili ilkeler yönetmelikte belirtilir.
İKİNCİ BÖLÜM Rüçhan Hakkı
Milletlerarası sözleşmelere dayanan başvurulardan doğan rüçhan hakları Madde 25 - Paris Sözleşmesine dahil ülkelerden birine mensup veya bu ülkelerden birine mensup olmamakla birlikte onlardan birinde ikametgahı veya işler durumda bir ticari müessesesi bulunan gerçek veya tüzel kişiler, bu ülkelerin herhangi birinde yetkili mercilere bir markanın tescili için usulüne uygun olarak yaptıkları başvuru tarihinden itibaren altı ay süreyle aynı marka için tescil belgesi almak üzere Türkiye'de başvuru yapma konusunda rüçhan hakkından yararlanır. Bu süre içinde kullanılmayan rüçhan hakları düşer.
Birinci fıkrada belirtilen süre içinde, rüçhan hakkına dayanılarak başvuru yapıldığı takdirde, rüçhan hakkının doğduğu tarihten itibaren üçüncü kişiler tarafından yapılacak rüçhan hakkına konu olan tescil başvurusunun mal veya hizmetler itibarıyla kapsamındaki başvurular ve bunlar adına yapılacak marka tescilleri hüküm ifade etmez.
Paris Sözleşmesine taraf bir ülke uyruğu olan gerçek veya tüzel kişi, Paris Sözleşmesine taraf olmayan bir ülkede marka tescili için geçerli bir başvuru yapmışsa, bu madde hükmüne göre, söz konusu başvurunun rüçhan hakkından yararlanır.
Sergilerde teşhir hakkından doğan rüçhan hakları Madde 26 - Tescil başvurusundaki markanın kullanılacağı malları veya hizmetleri Türkiye'de açılan milli ve milletlerarası sergilerde veya Paris Sözleşmesine taraf ülkelerde açılan resmi veya resmi olarak tanınan sergilerde teşhir eden 3 üncü maddenin birinci fıkrasında yazılı gerçek veya tüzel kişiler, sergideki teşhir tarihinden itibaren altı ay içinde Türkiye'de marka tescil ettirmek için başvuru yapma konusunda rüçhan hakkından yararlanır.
Tescil başvurusunda belirtilen makanın kullanacağı mallar veya hizmetler, sergide görünür şekilde resmi açılış tarihinden önce sergilenmişse rüçhan süresi, malların sergi yerine konulduğu veya hizmetin sergilendiği tarihten itibaren başlar.
Birinci fıkrada belirtilen sergilerden Türkiye'de açılanların yetkili mercileri, tescil başvurusundaki bir markanın kullanacağı mallarını sergide teşhir edenlere veya hizmeti sergileyenlere, teşhir ettikleri malların çeşidini veya teşhir ettikleri hizmetlerin cinsini açıkça belirten ve malın veya hizmetin sergide görünür şekilde sergilendiği tarihi ve resmi açılış tarihini gösterir bir belge verir.
Yabancı ülkelerde teşhir edilen mallar veya hizmetler için, serginin açıldığı ülkenin yetkili mercileri tarafından düzenlenen ve üçüncü fıkrada yazılı hususları içeren bir belgenin verilmesi şarttır.
Başvurusu yapılmış veya tescil edilmiş bir markanın kullanacağı malların Türkiye'de açılan sergilerde teşhir edilmesine ve sergi bittikten sonra ülkesine geri gönderilmesine engel olunmaz.
Bir sergide teşhir edilmiş, tescil başvurusu bulunan veya tescilli bir markanın kullanılacağı mallar veya hizmetler ile ilgili olarak birden çok başvuru yapılmışsa, bu durumda bu malları veya hizmetleri ilk sergileyen kişi, aynı zamanda sergilenmesi halinde ise ilk başvuruda bulunan kişi, rüçhan hakkından yararlanır.
Rüçhan hakkının hükmü Madde 27 - 25 inci ve 26 ncı madde hükümlerine göre rüçhan hakkının hüküm ve sonuçları, rüçhan hakkının talep edildiği başvurunun tarihi itibariyle doğar.
Rüçhan hakkının talep edilmesi ve belgelendirilmesi Madde 28 - Başvuru sahibi, yararlanmak istediği rüçhan hakkını başvuru ile birlikte talep eder. Bununla ilgili rüçhan hakkı belgesini, başvuru tarihinden itibaren üç ay içinde vermediği takdirde rüçhan hakkından yararlanma talebi yapılmamış sayılır.
Sergi teşhir hakkına dayalı olarak alınmış bir rüçhan, 25 inci maddeye göre verilen rüçhan süresini uzatmaz.
ÜÇÜNCÜ KISIM TESCİL İŞLEMLERİ
BİRİNCİ BÖLÜM Başvurunun İncelenmesi
Şekli inceleme Madde 29 - Enstitü, başvurunun 23 üncü maddede belirtilen şartlara uygunluğunu ve herhangi bir şekli eksikliğin bulunup bulunmadığını inceler. Enstitü 23 üncü maddenin birinci ve ikinci fıkrası hükmü uyarınca herhangi bir eksikliğin olmadığına karar verirse, marka tescil başvurusu başvurunun Enstitüye veya onun yetkili kıldığı makama verildiği tarih, saat ve dakika itibariyle kesinleşir.
Rüçhan hakkı talep edilmişse, Enstitü tarafından 25 inci, 26 ncı ve ve 27 nci madde hükümlerine göre ayrıca inceleme yapılır.
Şekli eksiklerin giderilmesi Madde 30 - Bir başvuruda, 23 üncü maddede yer alan şartların yerine getirilmediği tesbit edilirse, Enstitü söz konusu eksiklerin yönetmelikte öngörülen süre içinde giderilmesini başvuru sahibine bildirir.
Enstitü, 23 üncü maddenin birinci fıkrasının (a) bendinde belirtilen başvuru dilekçesinde başvuru sahibinin kimliğine ilişkin bilgilerin bulunmaması veya eksik bulunması yahut (b), (c), (d) bentlerinde belirtilen belgelerden herhangi birinin verilmemesi halinde, başvuruyu reddeder.
Enstitü tarafından giderilmesi istenen ve 23 üncü maddenini birinci fıkrasının (e), (f), (g) ve (h) bentleri kapsamına giren eksiklerin, yönetmelikte öngörülen süre içinde giderilmiş olması koşuluyla, marka tescil başvurusu, başvurunun ilk yapıldığı tarih itibariyle kesinleşir.
Rüçhan hakkına ilişkin eksiklerin giderilmemesi, sadece rüçhan hakkının yitirilmesi bakımından hüküm ifade eder.
Başvuru yapma hakkı yönünden inceleme Madde 31 - 3 üncü madde kapasımına girmeyen gerçek veya tüzel kişilerin başvurusu reddedilir.
Red için kesin nedenler yönünden inceleme Madde 32 - Enstitü, başvurunun şekli yönden hiç bir eksiği bulunmadığına karar verirse, markanın kullanılacağı ve tescil kapsamına girmesi talep edilen mallar veya hizmetlerin bir kısmı veya tamamı itibariyle başvurunun özellikle 7 nci madde hükümleriyle uygunluğunu inceler. Başvuru 7 nci maddeye göre, uygun görülmeyen mallar veya hizmetlerin tamamı veya bir kısmı itibariyle reddedilir.
İKİNCİ BÖLÜM Başvurunun Yayınlanması
Başvurunun yayınlanması Madde 33 - Başvuru şartları eksiksiz bir şekilde yerine getirilmiş ve 29, 30, 31 ve 32 nci madde hükümlerine göre reddedilmemiş bir marka tescil başvurusu ilgili bültende yayınlanır.
Başvurunun birinci fıkrada belirtilen madde hükümlerine göre reddedilmesine, başvuru yayın- landıktan sonra karar verilirse, başvurunun reddedildiğine ilişkin karar ayrıca yayınlanır.
ÜÇÜNCÜ BÖLÜM Üçüncü Kişilerin Görüş ve İtirazları
Üçüncü kişilerin görüşleri Madde 34 - Marka başvurusunun yayınından sonra, herhangi bir gerçek veya tüzel kişi veya herhangi bir grup veya hizmetleri temin edenler, üreticiler veya imalatçıları temsil eden bir
organ, tacir veya tüketiceler, 7 nci maddeye göre, markanın tescil için yeterli nitelikleri taşımadığını belirten yazılı görüşlerini Enstitüye sunabilir. Ancak bu kişiler, Enstitü nezdinde işlemlere taraf olamaz.
İtiraz Madde 35 - Tescil başvurusu yapılmış markanın 7 nci ve 8 inci madde hükümlerine göre tescil edilmemesi gerektiğine ilişkin itirazlar ile başvurunun kötü niyetle yapıldığına ilişkin itirazlar ilgili kişiler tarafından marka başvurusunun yayınından itibaren üç ay içerisinde yapılır.
8 inci maddenin son fıkrası çerçevesinde yapılacak itiraz, ancak itiraz eden kişinin markasını bu süre içerisinde kullanmaması halinde reddedilir.
İtirazlar yazılı ve gerekçeli olarak yapılır. Enstitü itiraz sahibinden, yönetmelikte öngörülen sürede yerine getirilmek üzere, ek belge, kanıt ve gerekçeler isteyebilir.
Bu süre içerisinde istenilen ek belge, kanıt ve gerekçeler Ensitüye verilmediği takdirde itiraz yapılmamış sayılır.
İtirazın incelenmesi Madde 36 - Enstitü, itirazları incelerken gerekli gördüğü süre ve sıklıkta tarafların itiraz ve karşı görüşlerini ilgili taraflara ilerit ve yazılı görüşlerini alır.
Enstitü gerekli görürse tarafları uzlaşmak için biraraya getirir.
Enstitü, yapılan itirazı geçerli bulmazsa reddeder. İtiraz, başvuruda kullanılacağı belirtilen mallar veya hizmetlerden bir kısmıyla ilgili olarak geçerli bulunursa, bu mallar veya hizmetlere ilişkin olarak kabul edilir.
DÖRDÜNCÜ BÖLÜM Marka Başvurusu İle İlgili Şekli İşlemler
Yanlışlıkların düzeltilmesi Madde 37 - Başvuru sahibinin talebi üzerine, marka başvurusunda içerik, mal veya hizmetlerde değişiklikleri kapsamayan; başvuru sahibinin adı ve adresindeki hatalar, imla hatalarına ilişkin yanlışlıkların düzeltilmesi, başvurunun incelenmesi işlemleri aşamasında yapılır.
Başvurunun geri çekilmesi Mardde 38 - Marka başvurusu, markanın tescil edilmesinden önce, başvuru sahibi tarafından geri çekilebilir.
BEŞİNCİ BÖLÜM Tescil
Tescil Madde 39 - Bu Kanun Hükmünde Kararname ve ilgili yönetmelik hükümlerine göre başvurusunu eksiksiz yapmış veya eksiklerini gidermiş ve süresi içerisinde hakkında itiraz yapılmamış veya yapılan itiraz kesin olarak reddedilmiş bir başvuru, tescil edilerek sicile kaydedilir. Başvuru sahibine "Marka Tescil Belgesi" verilir.
Sicil kaydında; marka örneği, başvuru tarihi, marka tescil numarası, markanın kullanacağ mallar veya hizmetlerin listesi, mal veya hizmetlerin sınıf veya sınıfları, marka sahibinin ve varsa vekilinin adı, soyadı, uyruğu, tüzel kişilerde ticaret ünvanı ve hangi ülkenin kanunlarına
göre kurulu olduğu, adresi, tescil tarihi, marka ve marka hakları ile ilgili bütün değişiklikler ve yönetmelikte öngörülen diğer hususlar yer alır.
Marka sicili alenidir. Talep edilmesi ve yönetmelikte öngörülen ücretin ödenmesi koşuluyla sicil örneği verilir.
Sicil kaydı yapılan marka ile ilgili bilgiler yönetmelikte şekil ve şartları belirtildiği biçimde ve ikinci fıkrada yer alan unsurları da kapsamak üzere yayınlanır.
DÖRDÜNCÜ KISIM MARKANIN KORUMA SÜRESİ VE MARKA TESCİLİNİN YENİLENMESİ
Markanın koruma süresi Madde 40 - Tescilli markanın koruma süresi başvuru tarihinden itibaren on yıldır. Bu süre, onar yıllık dönemler halinde yenilenir.
Yenileme Madde 41 - Koruma süresi sona eren marka, sahibinin veya onun yetkili kıldığı vekilin talebi ve yönetmelikte öngörülen yenileme ücretinin ödenmesi koşuluyla yenilenir.
Enstitü, tescil süresinin dolmakta olduğunu, sürenin bitiminden önce ve yönetmelikte öngörülen süre içinde, marka hakkı sahibine haber verir. Enstitünün bu bilgiyi vermemiş olması, Enstitüye herhangi bir sorumluluk getirmez.
Yenileme talebinin yapılması ve yenileme ücretinin ödenmesi, koruma süresinin sona erdiği ayın son gününden önceki altı ay içinde gerçekleştirilir. Bu sürenin kaçırılması durumunda, yenileme talebi, ek bir ücretin ödenmesi koşuluyla, koruma süresinin sona erdiği ayın son gününden itibaren altı aylık süre uzatımı içinde de yapılabilir.
Yenileme süresi mevcut tescilin sona erdiği gün başlar. Yenileme sicile kayıt edilir ve yayınlanır.
Koruma süresinin bitiminden itibaren altı aylık süre içerisinde yenilenmeyen markalar hükümsüz sayılır.
BEŞİNCİ KISIM MARKANIN HÜKÜMSÜZLÜĞÜ VE MARKA HAKKININ SONA ERMESİ
BİRİNCİ BÖLÜM Markanın Hükümsüzlüğü
Hükümsüzlük halleri Madde 42 - Aşağıdaki hallerde markanın hükümsüz sayılmasına yetkili mahkeme tarafından karar verilir: a) 7 nci maddede sayılan haller. (Ancak 7 nci maddenin (ı) bendinde belirtilen tanınmış markalarla ilgili davanın (Ek ibare: 4128 - 3.11.1995) " tescil tarihinden itibaren " 5 yıl içerisinde açılması gerekir. Markanın tescilinde kötü niyet varsa iptal davası süreye bağlı değildir.) b) 8 inci maddede sayılan haller. (Ancak, 8 inci maddenin son fıkrası çerçevesinde açılan davada önceki hak sahibi koruma süresinin bitiminden itibaren 2 yıl içerisinde markasını kullanmamışsa bu bir hükümsüzlük nedeni sayılmaz.)
c) 14 üncü maddeye aykırılık. (Ancak, 5 yılın dolması ile davanın açıldığı tarih arasında ciddi biçimde kullanma hükümsüzlük nedeni sayılmaz. Dava açılacağı düşünülerek kullanma gerçekleşmiş ise, mahkeme davanın açılmasından önceki üç ay içerisinde gerçekleşen kullanmayı dikkate almaz.) d) Marka sahibinin davranışları nedeniyle, marka mal ve hizmetler için yaygın bir ad haline gelmiş ise, e) Hak sahibi veya yetkili kıldığı kişi tarafından kullanım sonucunda tescil edildiği mal ve hizmetlerin niteliği, kalitesi, üretim yeri ve coğrafi kaynağı konusunda halkta yanlış anlama ihtimali var ise, f) 59 uncu maddeye aykırı kullanım.
Hükümsüzlük nedenleri, markanın tescil edildiği bir kısım mal veya hizmete ilişkin bulunuyorsa, yalnız o mal veya hizmet ile ilgili olarak kısmi hükümsüzlüğe karar verilir.
(Değişik son fıkra: 5194 - 22.6.2004 / m.15) Bir marka tescil tarihinden önce kullanılmış ve tescile konu mallar veya hizmetlerle ilgili olarak bu kullanım sonucu ayırt edici bir nitelik kazanmış ise 7 nci maddenin birinci fıkrasının (a), (c) ve (d) bentlerine göre tescili hükümsüz sayılamaz.
Hükümsüzlük talebi Madde 43 - Markanın hükümsüzlüğünü, ilgili mahkemeden, zarar gören kişiler, Cumhuriyet savcıları veya ilgili resmi makamlar isteyebilir.
Hükümsüzlüğün etkisi Madde 44 - Markanın hükümsüzlüğüne karar verilmesi halinde, kararın sonuçları geçmişe etkilidir.
Marka sahibinin kötü niyetli olarak hareket etmesinden kaynaklanan, zararın giderilmesine ilişkin tazminat talepleri saklı kalmak üzere, hükümsüzlüğün geriye dönük etkisi, aşağıdaki durumları etkilemez: a) Markanın hükümsüz sayılmasından önce, bir markaya tecavüz sebebiyle verilen hukuken kesinleşmiş ve uygulanmış kararlar, b) Markanın hükümsüzlüğüne karar verilmeden önce, yapılmış ve uygulanmış sözleşmeler. (Ancak, hal ve şartlara göre, haklı sebepler ve hakkaniyet düşüncesi ile sözleşme uyarınca ödenmiş bedelin kısmen veya tamamen iadesi mümkündür.)
Bir markanın hükümsüzlüğüne ilişkin kesinleşmiş karar, herkese karşı hüküm doğurur.
İKİNCİ BÖLÜM Marka Hakkının Sona Ermesi
Sona ermenin sebepleri Madde 45 - Marka hakkı; a) Koruma süresinin dolması ve markanın süresi içinde yenilenmemesi, b) Marka sahibinin marka hakkından vazgeçmesi, nedenlerinden birinin gerçekleşmesi ile sona erer.
Marka hakkının sona ermesi, sona erme sebebinin gerçekleşmiş olduğu andan itibaren hüküm ifade eder. Marka hakkının sona ermesi, ilgili bültende yayınlanır.
Marka hakkından vazgeçme Madde 46 - Marka sahibi, markanın kullanılacağı malların ve/veya hizmetlerin tamamından veya bir kısmından vazgeçebilir.
Vazgeçmenin yazılı olarak Enstitü'ye bildirilmesi gerekir. Vazgeçme, Marka Siciline kayıt tarihi itibariyle hüküm doğurur.
Marka Siciline kayıt edilmiş hakların ve lisans sahiplerinin izni olmadıkça, marka sahibi marka hakkından vazgeçemez.
Marka üzerinde, bir üçüncü kişi tarafından hak sahipliği iddia edilmekte ise, onun izni olmadıkça, marka hakkından vazgeçilemez..
ALTINCI KISIM ENSTİTÜ KARARLARINA İTİRAZ
İtiraz Madde 47 - Enstitü kararlarına karşı itiraz edilebilir.
Sonuçlanmayan kararlarla ilgili itiraz yapılabilmesi için, söz konusu karara ayrı itiraz yapılmasına izin verilmelidir.
İtiraza yetkili kişiler Madde 48 - Enstitü tarafından alınacak kararlardan zarar gören kişiler, kararlara karşı Enstitü nezdinde itiraz yapabilir. Alınan kararlarla ilgili işlemlere taraf diğer kişiler doğrudan itiraz yetkisine sahiptir.
İtiraz şekli ve zamanı Madde 49 - İtiraz, kararın bildiriminden sonraki iki ay içerisinde yazılı olarak Enstitüye yapılır. İtirazın değerlendirilmesi için, itiraz ücretinin itiraz sırasında ödenmesi gerekir. Kararın bildiriminden sonraki iki ay içinde, itiraz konusunun gerekçeleri yazılı olarak verilir. Bu süre içinde gerekçelerin verilmemesi halinde itiraz yapılmamış sayılır.
İlgili dairenin düzeltme kararı Madde 50 - Enstitü ilgili dairesi, itirazın haklı olduğuna ve doğruluğuna ikna olursa, kararını düzeltebilir. Bu durum, alınan kararlarla ilgili işlemlere doğrudan taraf olmayan kişilerin itirazı halinde uygulanmaz.
Enstitünün ilgili dairesi yapılan itirazı kabul etmezse, itirazı herhangi bir yorumda bulunmaksızın, Yeniden İnceleme ve Değerlendirme Kuruluna gönderir.
İtirazların incelenmesi Madde 51 - İtiraz, incelenebilir nitelikte ise, Yeniden İnceleme ve Değerlendirme Kurulu, itirazın incelenmesi işlemlerini başlatır.
Yeniden İnceleme ve Değerlendirme Kurulu, yönetmelikte öngörülen süre içinde, diğer taraf veya makam tarafından ileri sürülen görüşler hakkında, tarafları görüşlerini bildirmeye davet eder.
İtiraz hakkından karar Madde 52 - İtirazın incelenmesinden sonra, Yeniden İnceleme ve Değerlendirme Kurulu, itiraz hakkında kararını verir.
Kararlara karşı dava açılması Madde 53 - Yeniden İnceleme ve Değerlendirme Kurulunun, 47 ila 52 nci maddelerde belirtilen itiraz işlemleri ile ilgili kesinleşen kararlarına karşı, kesinleşen kararın bildirim tarihinden itibaren iki ay içinde, yetkili mahkemede dava açılabilir.
YEDİNCİ KISIM GARANTİ MARKALARI VE ORTAK MARKALAR
Garanti markaları Madde 54 - Garanti markası, markasahibinin kontrolü altında birçok işletme tarafından o işletmelerin ortak özelliklerini, üretim usullerini, coğrafi menşelerini ve kalitesini garanti etmeye yarayan işarettir.
Garanti markasının marka sahibinin veya marka sahibine iktisaden bağlı olan bir işletmenin mal veya hizmetlerinde kullanılması yasaktır.
Ortak marka Madde 55 - Ortak marka, üretim veya ticaret veya hizmet işletmelerinden oluşan bir grup tarafından kullanılan işarettir.
Ortak marka gruptaki işletmelerin mal veya hizmetlerini diğer işletmelerin mal veya hizmetlerinden ayırt etmeye yarar.
Garanti markası veya ortak marka teknik yönetmeliği Madde 56 - Bir garanti markasının veya ortak markanın tescili için başvuru ile birlikte markanın kullanılma usul ve şeklini gösterir bir teknik yönetmeliğin verilmesi zorunludur.
Garanti markası teknik yönetmeliği markanın garanti edilen mal veya hizmetlerin ortak özellikleri hakkında hükümler içerir ve markanın kullanılmasının kontrolunun yapılma şekillerini ve gerektiğinde uygulanacak cezaları öngörür.
Ortak marka teknik yönetmeliğinde, ortak markayı kullanmaya yetkili olan işletmeler belirtilir. Ortak markanın tescili için ortak marka sahipleri birlikte hareket eder.
Ortak markanın yenilenmesi için ortaklardan birinin başvurması yeterlidir.
Teknik yönetmeliğin değiştirilmesi Madde 57 - Teknik yönetmelikte yapılacak değişiklikler Enstitü tarafından onaylanmadıkça uygulanamaz.
Teknik yönetmelikte yapılması istenilen değişiklikler, 56 ncı maddenin ikinci ve üçüncü fıkralarına veya kamu düzenine ve genel ahlaka aykırı olması halinde, Enstitü tarafından değişiklik talebi reddedilir.
Kanun hükmünde kararnameye aykırı teknik yönetmelik Madde 58 - Teknik yönetmelik, 56 ncı maddede öngörülen şartları içermediği takdirde, teknik yönetmelite gerekli değişiklikleri yapması, Enstitü tarafından marka sahibine bildirilir. Marka sahibi bildirim tarihinden itibaren altı ay içinde gerekli değişiklikleri yapmaz ve teknik yönetmeliği düzeltmez ise, garanti markası veya ortak markanın tescili talebi reddedilir.
Teknik yönetmeliğe aykırı kullanma Madde 59 - Marka sahibi, garanti markasının veya ortak markanın belirli bir sürede teknik yönetmeliğe aykırı olarak kullanmasına göz yumar ve taraflardan birinin başvurusu üzerine
mahkemece tanınacak süre içinde, söz konusu aykırı kullanım düzeltilmediği takdirde, marka, tanınan süre sonunda mahkem tarafından iptal edilir.
Devir ve lisans Madde 60 - Garanti markasının veya ortak markanın devri veya bir ortak markada lisans verilmesi, Marka Siciline kayıt halinde geçerlidir.
SEKİZİNCİ KISIM MARKA HAKKINA TECAVÜZ DURUMLARI
Marka hakkına tecavüz sayılan fiiller Madde 61 – (Değişik: 5833 - 21.01.2009 / m. 2) Aşağıda sayılan fiiller marka hakkına tecavüz sayılır:
a) Marka sahibinin izni olmaksızın, markayı 9 uncu maddede belirtilen biçimlerde kullanmak.
b) Marka sahibinin izni olmaksızın, markayı veya ayırt edilmeyecek derecede benzerini kullanmak suretiyle markayı taklit etmek.
c) Markayı veya ayırt edilmeyecek derecede benzerini kullanmak suretiyle markanın taklit edildiğini bildiği veya bilmesi gerektiği halde tecavüz yoluyla kullanılan markayı taşıyan ürünleri satmak, dağıtmak veya bir başka şekilde ticaret alanına çıkarmak veya bu amaçlar için gümrük bölgesine yerleştirmek, gümrükçe onaylanmış bir işlem veya kullanıma tabi tutmak veya ticari amaçla elde bulundurmak.
d) Marka sahibi tarafından lisans yoluyla verilmiş hakları izinsiz genişletmek veya bu akları üçüncü kişilere devretmek.”h
Madde 61/A – (Değişik: 5833 - 21.01.2009 / m. 3) Başkasına ait marka hakkına iktibas veya iltibas suretiyle tecavüz ederek mal veya hizmet üreten, satışa arz eden veya satan kişi bir yıldan üç yıla kadar hapis ve yirmibin güne kadar adli para cezası ile cezalandırılır.
Marka koruması olan eşya veya ambalajı üzerine konulmuş marka koruması olduğunu belirten işareti yetkisi olmadan kaldıran kişi hakkında bir yıldan üç yıla kadar hapis ve beşbin güne kadar adli para cezasına hükmolunur.
Yetkisi olmadığı halde başkasına ait marka hakkı üzerinde satmak, devretmek, kiralamak veya rehnetmek suretiyle tasarrufta bulunan kişi iki yıldan dört yıla kadar hapis ve beşbin güne kadar adli para cezası ile cezalandırılır.
Yukarıdaki fıkralarda tanımlanan suçların bir tüzel kişinin faaliyeti çerçevesinde işlenmesi halinde ayrıca bunlara özgü güvenlik tedbirlerine hükmolunur.
Yukarıdaki fıkralarda tanımlanan suçlardan dolayı cezaya hükmedebilmek için markanın Türkiye’de tescilli olması şarttır.
Yukarıdaki fıkralarda tanımlanan suçların soruşturulması ve kovuşturulması şikayete bağlıdır.
Üzerinde başkasının hak sahibi olduğu marka taklit edilerek üretilmiş malı satışa arz eden veya satan kişinin bu malı nereden temin ettiğini bildirmesi ve bu suretle üretenlerin ortaya çıkarılmasını ve üretilmiş mallara elkonulmasını sağlaması halinde hakkında cezaya hükmolunmaz.” Marka sahibinin talepleri Madde 62 - Marka hakkı tecavüze uğrayan marka sahibi, mahkemeden, aşağıdaki taleplerde bulunabilir: a) Marka hakkına tecavüz fiillerinin durdurulması, b) Tecavüzün giderilmesi ve maddi ve manevi zararın tazmini, c) (Değişik: 4128 - 3.11.1995 / m.5) Marka hakkına tecavüz dolayısı ile üretilmesi veya kullanılması cezayı gerektiren eşya ile bu eşyaları üretmeye yarayan araç, cihaz, makine gibi vasıtalara el koyulması talebi d) (c) bendi uyarınca el konulan ürünler üzerinde kendisine mülkiyet hakkının tanınması, (Bu durumda, söz konusu ürünlerin değeri, tazminat miktarından düşülür. Bu değer, kabul edilen tazminatı aştığı zaman, marka sahibinin fazlayı karşı tarafa ödemesi gerekir.)
e) (Değişik: 4128 - 3.11.1995 / m.5) Marka hakkına tecavüzün devamını önlemek üzere tedbirlerin alınması, özellikle bu maddenin (c) bendine göre el koyulan ürünlerin ve araçların üzerlerindeki markaların silinmesi veya marka hakkına tecavüzün önlenmesi için kaçınılmaz ise imhası talebi , f) Marka hakkına tecavüz eden kişi aleyhine verilen mahkeme kararının, masrafları tecavüz eden tarafından karşılanarak, ilgililere tebliğ edilmesi ve kamuya yayın yoluyla duyurulması.
Hukuk davalarında yetkili mahkeme Madde 63 - Marka sahibi tarafından, üçüncü kişiler aleyhine açılacak hukuk davalarında yetkili mahkeme, davacının ikametgahının olduğu veya suçun işlendiği veya tecavüz fiilinin etkilerinin görüldüğü yerdeki mahkemedir.
Davacının Türkiye'de ikamet etmemesi halinde, yetkili mahkeme, sicilde kayıtlı vekilin iş yerinin bulunduğu yerdeki ve eğer vekillik kaydı silinmiş ise, Enstitünün merkezinin bulunduğu yerdeki mahkemedir.
Üçüncü kişiler tarafından marka başvurusu veya marka sahibi aleyhine açılacak davalarda yetkili mahkeme, davalının ikametgahının bulunduğu yerdeki mahkemedir. Marka başvurusu veya marka sahibinin Türkiye'de ikamet etmemesi halinde, ikinci fıkra hükmü uygulanır.
Birden fazla mahkemenin yetkili olduğu durumda, yetkili mahkeme, ilk davanın açıldığı mahkemedir.
Tazminat Madde 64 - Marka sahibinin izni olmaksızın, marka taklit edilerek üretilen ürünü üreten, satan, dağıtan veya başka bir şekilde ticaret alanına çıkaran veya bu amaçlar için ithal eden veya ticari amaçla elde bulunduran kişi, hukuka aykırılığı gidermek ve sebep olduğu zararı tazmin etmekle yükümlüdür.
Taklit markayı herhangi bir şekilde kullanmakta olan kişi, marka sahibinin markanın varlığından ve tecavüzden kendisini haberder etmesi ve tecavüzü durdurmasını talep etmesi halinde veya kullanmanın kusurlu bir davranış teşkil etmesi halinde, sebep olduğu zararı tazmin etmekle yükümlüdür.
Tecavüzü kanıtlayan belgeler Madde 65 - Marka sahibi, markanın kendi izni olmaksızın taklit edilerek kullanılması sonucunda uğramış olduğu zarar miktarının belirlenmesi için tazminat yükümlüsünden markanın kullanılması ile ilgili belgeleri vermesini talep edebilir.
Yoksun kalınan kazanç Madde 66 - Marka sahibinin uğradığı zarar, sadece fiili kaybın değerini değil, ayrıca marka hakkına tecavüz dolayısıyla yoksun kalınan kazancı da kapsar.
Yoksun kalınan kazanç, zarar gören marka sahibinin seçimine bağlı olarak, aşağıdaki değerlendirme usullerinden birine göre hesap edilir: a) Marka hakkına tecavüz edenin rekabeti olmasaydı, marka sahibinin markanın kullanması ile elde edebileceği muhtemel gelire göre, b) Marka hakkına tecavüz edenin, markayı kullanmak yoluyla elde ettiği kazanca göre, c) Marka hakkına tecavüz edenin, markayı bir lisans anlaşması ile hukuka uygun şekilde kullanmış olması halinde ödemesi gereken lisans bedeline göre.
Yoksun kalınan kazancın hesaplanmasında, özellikle markanın ekonomik önemi, marka hakkına tecavüz edildiği anda geçerlilik süresi ve tecavüz sırasında markaya ilişkin lisansların sayısı ve çeşidi gibi etkenler gözönünde tutulur.
Yoksun kalınan kazancın artırımı Madde 67 - Marka üzerinde tasarruf yetkisi olan kişi, yoksun kalınan kazancın hesaplanmasında, 66 ncı maddenin ikinci fıkrasının (a) veya (b) veya (c) bendlerinde belirtilen değerlendirme usullerinden birini seçmişse; mahkeme, ürünün satışında markanın ekonomik bakımdan önemli bir katkısının bulunduğu kanaatına vardığı takdirde, kazancın hesaplanmasında makul bir payın daha eklenmesine karar verir.
Markanın ilgili ürüne ekonomik bakımdan önemli bir katkısının olduğunun kabul edilebilmesi için, ilgili ürüne olan talebin oluşmasında markanın belirleyici etken olduğunun anlaşılmış olması gerekir.
Markanın itibarı Madde 68 - Marka hakkına tecavüz eden tarafından markanın kötü veya uygun olmayan bir şekilde kullanılması sonucunda, markanın itibarı zarara uğrarsa, marka sahibi, bu nedenle, ayrıca tazminat isteyebilir.
Dava açılamayacak kişiler Madde 69 - Marka sahibi, sebep olduğu zarardan dolayı marka sahibine tazminat ödemiş olan kişi tarafından piyasaya sürülmüş ürünleri kullanan kişilere karşı, Kanun Hükmünde Kararnamenin bu bölümünde yer alan davaları açamaz.
Zamanaşımı Madde 70 - Marka hakkına tecavüzden doğan özel hukuka ilişkin taleplerde, zamanaşımı süresi için, Borçlar Kanununun zamanaşımına ilişkin hükümleri uygulanır.
Görevli ve yetkili mahkeme Madde 71 - (Değişik: 5194 - 22.6.2004 / m.17) Bu Kanun Hükmünde Kararnamede öngörülen davalarda, görevli mahkeme ihtisas mahkemeleridir. Bu mahkemeler tek hakimli olarak görev yaparlar. Asliye hukuk ve asliye ceza mahkemelerinden hangilerinin ihtisas mahkemesi olarak görevlendirileceği ve bu mahkemelerin yargı çevresini, Adalet Bakanlığının teklifi üzerine Hakimler ve Savcılar Yüksek Kurulu belirler.
Enstitünün bu Kanun Hükmünde Kararname hükümlerine göre aldığı bütün kararlara karşı açılacak davalarda ve Enstitünün kararlarından zarar gören üçüncü kişilerin Enstitü aleyhine açacakları davalarda görevli ve yetkili mahkeme, bu maddenin birinci fıkrasında belirtilen mahkemelerden Ankara ihtisas mahkemeleridir.
Hükmün ilanı Madde 72 - Dava sonucunda haklı çıkan taraf, haklı bir sebebin veya menfaatının bulunması halinde, masrafları karşı tarafa ait olmak üzere kesinleşmiş kararın günlük gazete veya benzeri vasıtalarla tamamen veya özet olarak ilan edilmesini talep etmek hakkına sahiptir.
İlanın şekli ve kapsamı kararda tesbit edilir. İlan hakkı, kararın kesinleşmesinden sonra üç ay içinde talep edilmezse düşer.
Lisans alanın dava açması ve şartları Madde 73 - Aksi sözleşmede kararlaştırılmamışsa, inhisari lisansa sahip olan kişi, üçüncü bir kişi tarafından marka sahibinin marka hakkına tecavüz edilmesi durumunda, marka sahibinin bu Kanun Hükmünde Kararname uyarınca açabileceği davaları, kendi adına açabilir. İnhisari olmayan lisans sahibi olanların, dava açma hakları yoktur.
Birinci fıkra uyarınca, marka hakkına tecavüz dolayısıyla dava açma hakkı olmayan bir lisans alan, noter vasıtasıyla yapacağı bir bildirimle, gereken davayı açmasını marka sahibinden isteyebilir.
Marka sahibinin, yukarıdaki fıkrada belintilen talebi kabul etmemesi veya bildirimin alındığı tarihten itibaren üç ay içinde gerekli davanın açılmaması halinde, lisans alan yaptığı bildirimi de ekleyerek, kendi adına dava açabilir.
Lisans alan, ciddi bir zarar tehlikesi karşısında ve söz konusu sürenin geçmesinden önce, ihtiyati tedbire karar verilmesini mahkemeden talep edebilir.
Üçüncü fıkra uyarınca dava açan lisans alanın, dava açtığını marka sahibine bildirmesi gerekir.
Marka hakkına tecavüzün mevcut olmadığı hakkında dava ve şartları Madde 74 - Menfaatı olan herkes, marka sahibine karşı dava açarak, fiillerinin marka hakkına tecavüz teşkil etmediğine karar verilmesini talep edebilir. Birinci fıkrada belirtilen davanın açılmasından önce, kendisinin Türkiye'de giriştiği veya girişeceği sınai faaliyeti sonucu üretilen ürünlerde kullanacağı markanın, başkasına ait bir marka hakkına tecavüz teşkil edip etmediği hakkında, marka sahibinden görüşlerini bildirmesini noter aracılığı ile talep eder.
Bu talebin marka sahibine tebliğinden itibaren bir ay içinde marka sahibinin cevap vermemesi veya verilen cevabın menfaat sahibi kişi tarafından kabul edilmemesi halinde, menfaat sahibi birinci fıkraya göre dava açar.
Birinci fıkrada belirtilen dava, marka hakkına tecavüzden dolayı kendisine karşı dava açılmış bir kişi tarafından açılamaz.
Dava, marka üzerinde hak sahibi bulunan ve Marka Siciline kayıt edilmiş olan, bütün hak sahiplerine tebliğ edilir.
Bu maddede belirlenen dava, markanın hükümsüzlüğü davasıyla birlikte de açılabilir.
Delillerin tesbiti (*) Madde 75 - Marka hakkına tecavüzü ileri sürmeye yetkili olan kişi, bu haklara tecavüz sayılabilecek olayların tesbitini mahkemeden isteyebilir. _____ (*) Madde 75 in "Delillerin Tesbiti Davası" şeklindeki kenar başlığı, 26.6.2004 tarih ve 25504 sayılı R.G.'de yayımlanan, 22.6.2004 tarih ve 5194 sayılı Kanunun 18. maddesi hükmü gereğince değiştirilmiş ve metne işlenmiştir. _____
İhtiyati tedbir talebi Madde 76 - Bu Kanun Hükmünde Kararnamede öngörülen türde dava açan veya açacak olan kişiler, dava konusu markanın kendi marka haklarına tecavüz teşkil edecek şekilde Türkiye'de kullanılmakta olduğunu veya kullanılması için ciddi ve etkin çalışmalar yapıldığını ispat etmek şartıyla, davanın etkinliğini temin etmek üzere, ihtiyati tedbire karar verilmesini talep edebilir.
İhtiyati tedbir talebi, dava açılmadan önce veya dava ile birlikte veya daha sonra yapılabilir. İhtiyati tedbir talebi, davadan ayrı olarak incelenir.
İhtiyati tedbirin niteliği
Madde 77 - İhtiyate tedbirler, verilecek hükmün etkinliğini tamamen sağlayacak nitelikte olmalı ve özellikle aşağıda belirtilen tedbirleri kapsamalıdır: a) Davacının marka hakkına tecavüz teşkil eden fiillerin durdurulması, b) Marka hakkına tecavüz edilerek üretilen veya ithal edilen şeylere Türkiye sınırları içinde veya gümrük ve serbest liman veya bölge gibi olanlar dahil, bulundukları her yerde el konulması ve bunların saklanması, c) Herhangi bir zararın tazmini bakımından teminat verilmesi.
Hukuk usulü muhakemeleri kanunu hükümlerinin uygulanması Madde 78 - (Değişik ibare: 5194 - 22.6.2004 / m.18) "Tesbit talepleri" ve ihtiyati tedbirlerle ilgili diğer hususlarda Hukuk Usulü Muhakemeleri Kanunu hükümleri uygulanır.
Gümrüklerde el koyma Madde 79 - Hak sahibinin yetkilerine tecavüz oluşturması nedeniyle cezayı gerektiren taklit markalı mallara, ithalat veya ihracaat sırasında hak sahibinin talebi üzerine, gümrük idareleri tarafından ihtiyati tedbir niteliğinden el konulabilir.
El koyma ile ilgili uygulama bu konuda çıkarılacak mevzuatta düzenlenir.
Gümrük İdarelerindeki tedbir, el koyma kararının tebliğinden itibaren on gün içinde esas hakkında ihtisas mahkemesinde dava açılmaz veya mahkemeden tedbir niteliğinde karar alınmazsa idarenin el koyma kararı ortadan kalkar.
DOKUZUNCU KISIM İŞLEM YETKİSİ OLAN KİŞİLER VE MARKA VEKİLLERİ
İşlem yetkisi olan kişiler Madde 80 - Aşağıda belirtilen kişiler marka konuları ile ilgili olarak Enstitü nezdinde işlem yapabilir: a) Gerçek veya tüzel kişiler. Tüzel kişiler, yetkili organları tarafından tayin edilen kişi veya kişilerce temsil edilir. b) Marka vekilleri.
İkametgahı yurt dışında bulunan kişiler ancak marka vekilleri vasıtasıyla temsil edilir.
Marka vekili tayin edilmesi halinde, tüm işlemler marka vekili vasıtasıyla yapılır. Marka vekiline yapılan tebligat asile yapılmış sayılır.
ONUNCU KISIM ÜCRETLERİN ÖDENMESİ VE HUKUKİ SONUÇLARI
Ücretlerin ödeme süreleri ve sonuçları Madde 81 - Yönetmelikte öngörülen marka başvurusu ve tescil edilmiş bir marka ile ilgili ücretler, başvuru sahibi veya marka sahibi veya varsa sicilde kayıtlı vekili tarafından ödenir.
Bir markanın tescil edilmesi ile ilgili işlemler için ödenmesi gereken ücretin, bu Kanun Hükmünde Kararnamede belirtilen süreler içinde ödenmemesi halinde, marka başvurusu geri çekilmiş kabul edilir.
ONBİRİNCİ KISIM SON HÜKÜMLER
Yürürlükten kaldırılan hükümler
Madde 82 - 3.3.1965 tarihli ve (Değişik ibare : 4128 - 3.11.1995 / m.5) "551 sayılı Markalar Kanunu" maddeleri yürürlükten kaldırılmıştır.
GEÇİCİ HÜKÜMLER Geçici Madde 1 - Bu Kanun Hükmünde Kararnamenin yürürlüğe girdiği tarihten önce yapılmış marka başvuruları hakkında, başvuru tarihindeki Kanun Hükümleri uygulanır.
Bu Kanun Hükmünde Kararname yürürlüğe girdiği tarihten önce yapılmış ve sicile kaydedilmiş devir, intikal ve lisans işlemlerinden dolayı kazanılmış haklar saklı kalmak üzere, bu çeşit işlemlerde meydana gelecek değişiklikler için bu Kanun Hükmünde Kararname hükümleri uygulanır.
Geçici Madde 2 - Hizmet markalarını fiilen kullananlar, bu Kanun Hükmünde Kararnamenin yürürlüğe girdiği tarihten itibaren en geç oniki ay içinde, söz konusu hizmet markasını kullandıklarını kanıtlayacak resmi belgeleri de eklemek suretiyle hizmet markasının tescilini talep edebilecektir.
Enstitü, oniki aylık süre dolduktan sonra, hizmet markası sahiplerinin taleplerini ilk kullanım tarihlerini de dikkate alarak değerlendirir.
Geçici Madde 3 - Bu Kanun Hükmünde Kararnamenin uygulanması bakımından, ihtisas mahkemeleri kuruluncaya kadar, asliye ticaret ve asliye ceza mahkemelerinin hangilerinin ihtisas mahkemesi olarak görevlendirileceği ve bu mahkemelerin yargı çevresi Adalet Bakanlığının teklifi üzerine Hakimler ve Savcılar Yüksek Kurulu tarafından belirlenir.
Yürürlük Madde 83 - Bu Kanun Hükmünde Kararname yayımı tarihinde yürürlüğe girer.
Yürütme Madde 84 - Bu Kanun Hükmünde Kararname hükümlerini Bakanlar Kurulu yürütür.

DECREE-LAW NO.556 PERTAINING TO THE
PROTECTION OF TRADEMARKS

PART ONE
General Provisions
SECTION ONE
Aim, Scope, Definitions and The Persons Entitled for Protection
Aim and Scope
Article 1 - The aim of this Decree Having the Power of Law is to protect the trademarks registered in conformity with the provisions of this Decree.
This Decree Having the Power of Law encompasses the principles, the rules and conditions for the protection of trademarks.
Definitions
Article 2 -For the purposes of this Decree;
a) ''Trademark'' means trademarks or service marks including guarantee marks and collective marks.
b) ''Paris Agreement'' means the Paris Convention for the Protection of Industrial Property of March, 1883 and its amendments ratified by Turkey.
c) ''Institute'' means the Turkish Patent Institute established by the Decree Having the Power of Law No: 544.
d) ''Trademark Agent'' means the persons entitled to represent third persons before the Institute for the establishment and protection rights provisioned in this Decree Having the Power of Law.
Persons Entitled to Protection
Article 3 - The protection conferred by this law is available to natural and legal persons who are domiciled or who have industrial or commercial establishments within the territory of the Turkish Republic, or to the persons who have application rights resulting from the terms of the Paris or Bern Conventions or the Agreement Establishing World Trade Organisation.
Natural or legal persons other than those referred in the first paragraph of this Article, who are nationals of states which accord legal and de facto protection to the nationals of the Turkish Republic shall enjoy according to the reciprocity principle trademark protection in Turkey.
Priority of International Agreements
Article 4 - Where the provisions of International Agreements which have entered into force as provided by the Laws of the Turkish Republic afford preferable provisions than this Decree Having the Power of Law, persons referred in Article 2 may request treatment according to the preferable provisions.
SECTION TWO
Sign of Which a Trademark May Consist and Means Whereby a Trademark
is Obtained
Signs of Which a Trademark May Consist
Article 5 - A trademark , provided that it is capable of distinguishing the goods and services of one undertaking from the goods and services of other undertakings, may consist of all kinds of signs being represented graphically such as words, including personal names, designs, letters, numerals, shape of the goods or their packaging and similarly descriptive means capable of being published and reproduced by printing.
Trademark may be registered along with the product or the packaging. However, the registration of the product or the packaging does not grant exclusive rights.
Means Whereby a Trademark Right is Obtained
Article 6 - Protection for a trademark under this Decree Having the Power of Law is obtained by registration.
Absolute Grounds for Refusal for Registry of a Trademark
Article 7 - Following signs shall not be registered as a trademark:
a) signs which do not conform with the provisions of Article 5,
b) trademarks identical or confusingly similar with a trademark
registered earlier or with an earlier date of application for registration in respect of an identical or same type of product or services,
c) trademarks which consist exclusively of signs or indications which serve in trade to indicate the kind, characteristics, quality, intended purpose, value, geographical origin, or designate the time of production of the goods or of rendering of the service or other characteristics of goods or services,
d) trademarks which consist exclusively of signs and names used to distinguish specific groups of craftsmen, professionals or tradesmen or have become customary in the current and established practices of the trade,
e) signs containing the shape of the product which results from the nature of the good, which is necessary to obtain a technical result or which gives substantial value to the good,
f) trademarks which are of such a nature as to deceive the public, such as to the nature, quality, place of production or geographical origin of the goods and services,
g) trademarks which have not been authorised by the competent authorises and are to be refused pursuant to Article 6ter of the Paris Convention,
h) trademarks containing badges, emblems or escutcheons other than those covered by Article 6ter of the Paris Convention which have not been authorised by the competent authorises and are of particular historical and cultural public interest,
i) trademarks which have not been authorised by their owners, well known marks according to 6bis of the Paris Convention,
j) trademarks which contain religious symbols,
k) trademarks which contrary to public policy and to accepted principles of morality.
The provisions of (a), (c) & (d) can not be invoked to refuse the registration of a trademark which has been used before the registration and has acquired through this usage distinctive character in respect of the goods and services for which it is to be registered.
Relative Grounds for Refusal for Registration of a Trademark
Article 8 -Upon position by the proprietor of an application for registration of a trademark or of a registered trademark, the trademark applied for shall not be registered under following conditions:
a) If the trademark applied for this identical with a registered trademark or a trademark which has an earlier application date and the protection is sought for the identical goods and services,
b) If because of its identity with or similarity to a trademark which has an earlier application date or a registered trademark and because of the identity or similarity of the goods and services covered by the trademarks there exists a likelihood of confusion on the part of the public and the likelihood of confusion includes the likelihood of association with the registered trademark or with the trademark which has an earlier application date.
Upon opposition by the proprietor of a trademark, a trademark shall not be registered where an agent or representative of the proprietor of the trademark has applied for registration thereof his own name without the proprietor's consent and without a valid justification.
Upon opposition by the proprietor of a non-registered trademark or of another sign used in the course of trade, the trademark applied for shall not be registered provided that;
a) the rights to the sign were acquired prior to the date of application for registration of the trademark, or the date of priority claimed for the application for registration,
b) the sign confers on its proprietor the right to prohibit the use of a subsequent trademark,
A trademark applied for which is identical or similar to a registered trademark or to a trademark with an earlier date of application may be used for different goods and services. However, where in the case of a registered trademark or of a trademark which has an earlier date of application for registration the trademark has a reputation and where the use without due cause of trademark applied for would take unfair advantage of, or be detrimental to, the distinctive character or repute of the registered trademark or of the trademark with an earlier application date, upon opposition by the proprietor of the earlier trademark, the trademark applied for shall not be registered even to be used for goods and services which are not similar to those for which the earlier trademark is registered.
Upon opposition by the holder of the relevant right, the trademark applied for shall not be registered if it contains the name, photograph, copyright, or any industrial property rights of the third parties.
Upon opposition, trademark applied for which is identical or similar to a collective or a guarantee mark shall not be registered within three years from the date of expiry of the collective or of the guarantee mark.
Trademark applied for which is identical or similar and which is to be registered for the identical or similar goods and services of a trademark which has not been renewed, upon opposition shall not be registered within two years of the expiry date.
SECTION THREE
Scope of Protection the Trademark
Rights Conferred by a Registered Trademark
Article 9 - The proprietor of a trademark shall be entitled to prevent all third parties not having his consent from using the trademark as described herewith:
a) use of any sign which is identical with the registered trademark in relation to goods and services which are identical with those for which the trademark is registered,
b) use of any sign where, because of its identity with or similarity to the registered trademark and identity or similarity of the goods and services covered by the registered trademark and sign, there exists a likelihood of confusion on the part of the public including likelihood of association between the sign and the trademark,
c) use of any sign which is identical with or similarity to the registered trademark in relation to goods or services which are not similar to those for which the trademark is registered, where the of that sign without due cause takes unfair advantage of or is detrimental to the distinctive character or the repute of the registered trademark.
The following may be prohibited under the first paragraph,
a) affixing the design to the goods or to the packaging thereof,
b) offering the goods, putting them on the market or stocking them for these purposes under that sign, or offering or supplying services thereunder,
c) importing or exporting the goods under that sign,
d) using the sign on business, papers and in advertising.
The rights conferred by a registered trademark shall prevail against third parties from the date of publication of registration of the trademark. Compensation may be claimed in respect of matters arising after the date of publication of a trademark application. However, the rights arising from the publication of an application shall be considered within the rights conferred by the publication of the registration of a trademark. The Court seized of the case may not decide upon the merits of the case until the registration has been published.
Reproduction of the Trademark in Dictionaries and Reference Works
Article 10 - Where a trademark is reproduced in a dictionary, encyclopaedia or a similar reference work without indications that it is registered and gives the impression that it constitutes the generic name of the goods or services for which the trademark is registered, at the request of the proprietor, the publisher shall correct the fault in the next edition.
Prohibition on the Use of Trademark Registered in the Name of an Agent or a Representative
Article 11 - Where a trademark is registered in the name of the agent or representative of the proprietor of the trademark, without the proprietor's consent, the proprietor shall be entitled to oppose the use of the trademark unless the agent or representative has a valid justification.
Limits on the Effects of a Registered Trademark
Article 12 - The proprietor of a trademark cannot prevent the third parties from using in the course of trade his own name or address, indications concerning the kind, quality, quantity, intended purpose, value, geographical origin, the time of production of the goods or of rendering of the services, or other characteristics of the goods or services, provided the use is effected in accordance with honest practices in industrial or commercial matters.
Exhaustion of the Rights Conferred by a Registered Trademark
Article 13 -The acts related with a product containing the registered trademark shall not constitute a breach of the rights of a registered trademark, where such acts have occurred after the product has been put on the market in Turkey by the proprietor or with his consent.
The proprietor have the right, even within the provision of the first paragraph, to oppose further commercialisation of the goods, especially where the conditions of the goods is changed or impaired after they have been put on the market.
SECTION FOUR
Use of the Trademark
Use of the Trademark
Article 14 - If, within a period of five years following the registration, trademark has not been put to use without a justifiable reason or if the use has been suspended during an uninterrupted period of five years, the trademark shall be repealed.
The following shall be understood to constitute use:
a) use of the registered mark in a form differing in elements which do not alter the distinctive character of the trademark,
b) use of the trademark on goods or their packaging solely for export purposes,
c) use of the trademark with the consent of the proprietor,
d) importing of the goods carrying the trademark.
SECTION FIVE
Legal Transactions Related with Trademark Rights
Legal Transactions
Article 15 - A registered trademark may be transferred to a third party, may be given as security and may be licensed and is subject to inheritance. Related provisions of the Civil Code shall apply with respect to security rights.
Transactions between the living concerning the registered trademark shall be entered in writing.
Transfer of Trademark
Article 16 - A registered trademark may be transferred in part of or all of the goods or services for which it is registered.
A transfer of the whole of an undertaking with its assets and liabilities, unless provided otherwise, shall include the rights over the trademarks of the undertaking. This provision shall apply to the contractual obligation to transfer the undertaking.
Without prejudice to paragraph 2, an assignment of a registered trademark shall be made in writing and signed by the parties to the contract, except when it is a result of a court decision. Contracts otherwise are considered to be void.
Where the nature of the transfer is such to mislead the public concerning the nature, quality, geographical origin of the goods and services in respect to which it is registered, the Institute shall not register the transfer unless the successors agrees to limit registration of the trademark to goods or services of which it is not likely to mislead.
On request of one of the parties a transfer shall be entered in the register and published.
As long as the transfer has not been entered in the register, the parties cannot invoke the rights arising from the registration of the trademark against the third parties acting in good faith.
Transfer of a Trademark Registered in the Name of an Agent or a Representative
Article 17 - Where a trademark is registered in the name of an agent or representative of the proprietor of a trademark without the consent of the proprietor of the trademark, unless the agent or representative justifies his action the proprietor of the trademark shall be entitled to demand the assignment in his favour of the said registration.
Placing the Trademark as Security
Article 18 -A registered trademark may be given as security independently of the undertaking.
On request of one of the parties, the placing of security shall be entered in the register and published.
Levy of Execution
Article 19 - A registered trademark may be levied in execution independently of the undertaking.
Levy of execution shall be entered in the register and published.
Licensing
Article 20 - Rights over a registered trademark may be licensed for some or all of the goods and services for which it is registered.
Licensing Conditions
Article 21 - A licence may be exclusive or non-exclusive.
Unless otherwise provided in the contract the license shall be understood to be non-exclusive. Licenser may use the trademark himself, and may grant licences to third parties on the same trademark.
In the case of an exclusive license, licenser may not grant licences to other parties and cannot make use of the trademark unless such is provided specifically by the contract.
Unless it is specifically provided in the contract, licensee cannot transfer the rights arising from the license or cannot grant a sub-license.
Unless provided otherwise in the contract, licensee shall have exclusive rights with respect to the use of the trademark during the period of protection.
Unless provided otherwise by the contract, the holder of an exclusive license may, in the case of an infringement of the trademark rights, institute in his own name all legal proceedings which have been made available to the proprietor of the trademark by this Decree Having the Power of Law. Holders of non-exclusive licenses do not have the right to institute legal proceedings.
In the case of an infringement, the holder of a non-exclusive license may give notice, through a notary public, requesting the proprietor of the trademark to institute such proceedings as required. In the event that the proprietor of the trademark refuses to initiate or within three months of the reception of the notice fails to institute proceedings, the non-exclusive license holder shall have the right to institute proceedings. The licensee may, in the face of serious damage where elapsing of time cannot be remedied, request the court to issue an injunction for precautionary measures. The licensee who has instituted proceedings shall notify the proprietor of the trademark that the proceedings have been instituted.
The proprietor of the trademark shall undertake the necessary measures to ensure the quality of the products produced or services rendered by the licensee.
Where the licensing contract provisions have been breached by the licensee, rights arising from a registered trademark may be claimed against the licensee by instituting proceedings.
A license cannot effect against third parties of good faith until it is registered.
A licensing contract cannot contain provisions contrary to this Decree Having the Power of Law and other related laws, decrees and regulations. The contrary provisions of a licensing contract shall be void even if legal provisions have come into effect after the signing of the contract.
Legal Procedures
Article 22 -Legal procedures related with the transfer, licensing, execution, placing of security and changes in the proprietorship of the trademark shall also have effect with regard for a trademark application.
PART TWO
Application
SECTION ONE
Filing of Application
Filing of Application Article 23 - An application for registration of a trademark must be filed with the following: a) a petition, the form and contents of which specified in the Implementing
Regulations, including information identifying the applicant, b) a representation of the trademark suitable for reproduction, c) list of the product or services for which the trademark shall be used, d) the original receipt documenting the payment of the application fees, e) the original receipt documenting the payment of the class fees, f) power of attorney if an agent is appointed, g) signature circular where the applicant is a legal person, h) documentation of the applicants business activity.
The application fee must be paid at the time of filing in order an application for the registration of a trademark to be valid.
Each trademark shall be subject to a separate filing of an application.
All documents filed with the application for registration of a trademark or submitted later to the Institute must comply with the Implementing Regulations.
Classification
Article 24 - The goods and services in the respect of the trademark to be registered shall be classified in conformity with the international classification of goods and services. The principles of classification shall be specified in the Implementing Regulation.
Right of Priority
Article 25 - Natural or legal persons who are nationals of any state party to the Paris Convention or if not nationals who are domiciled or have an active business in these states, shall enjoy a right of priority of six months from the date of filing a valid application for registration of a trademark at the authorised bodies of these states, for the purpose of filing an application for obtaining a registration certificate in Turkey in respect of the same trademark. The priority rights not exercised within this period are considered to be void.
When a priority is claimed within the provisions of the first paragraph, all applications filed and registration certificates obtained by third parties shall be declared invalid as from the date recognised as giving rise to a priority right and for trademarks falling within the scope of protection.
If a natural or a legal person who is a national of a state party to the Paris Convention has filed a valid application in a state not party to the Paris Convention he shall enjoy within the provisions of this Article priority right in respect of that filing.
Exhibition Priority
Article 26 -Natural or legal persons specified in the first paragraph of Article 3 who have displayed the products or services on which the trademark is applied, at national or international exhibitions in Turkey or at official or officially recognised national or international exhibitions in the states party to the Paris Convention, may claim a right of priority for registration of the trademark in Turkey if the application for priority is filed within a period of six months from the date of the first display of the products.
If the products or services in respect of which the trademark is applied has been displayed at the exhibition before the official opening date, right of priority starts from the date the products or the services were first displayed at the exhibition.
The officials of the exhibition held in Turkey, shall supply evidence specifying the names of products or the types of the services, first displayed date and the official opening date when the product or the service was visibly displayed.
For the product and the services displayed in foreign countries, the evidence as specified in the third paragraph shall be supplied by the relevant authorities of the state concerned.
Products on which the trademark is applied, cannot be prevented from being displayed at an exhibition in Turkey and from being forwarded to its country of origin after the closing of the exhibition.
Where there are two or more applications for the same products or services in respect of the trademark registered or registration applied for, the applicant who first displayed the products or services and if displayed at the same time the one who filed his application first shall enjoy the right of priority.
Effect of Priority Right
Article 27 - The effects of the priority rights ensuing from Article 25 and 26, shall arise as of the date of the Application for which the priority is declared.
Claiming and the Evidencing of Priority
Article 28 -An Applicant desiring to advantage of his priority right shall file a declaration of priority with his application for a registered trademark. If the right of priority is not documented within three months of the filing of the application the declaration of priority shall be considered invalid.
A priority granted with respect to an exhibition priority right does not extend the period of priority laid down in Article 25.
PART THREE
Registration Procedures
SECTION ONE
Examination of the Application
Examination as to Conditions of Filing
Article 29 - Institute shall examine whether the application complies with the conditions specified in Article 23 and whether there are deficiencies. If the Institute concludes that there are no deficiencies, the application is accorded the date of filing as the date, hour and minute on which the application was filed originally at the Institute or at the body authorised as such by the Institute.
If a priority declaration has been filed, Institute shall undertake an examination in accordance with the provisions of Article 25, 26 and 27.
Remedying Deficiencies as to Conditions of Filing
Article 30 -If deficiencies with respect to conditions of Article 23 are established, the Institute shall request the applicant to remedy these deficiencies within the period specified in the Implementing Regulation.
The Institute shall refuse an application where the information identifying the applicant as provisioned in the sub paragraph (b) of Article 23 is completely or partially lacking, or where of the anyone of the documents provisioned in the sub paragraphs (b), (c) and (d) has not been supplied.
If the applicant complies with the Institute's request and remedies within the prescribed time as specified in the Implementing Regulation the deficiencies which fall within the scope of sub paragraphs (e), (f), (g) and (h) of Article 23 the Institute shall allow as the date of filing the date on which the deficient application was originally filed.
Failure to satisfy the requirements concerning the claim to priority shall result only in the loss of the right of priority for the application.
Examination as to Entitlement
Article 31 - Applications of natural or legal persons who are not within the scope of Article 3 shall be refused.
Examination as to Absolute Grounds for Refusal
Article 32 -The Institute upon concluding that there are no deficiencies in the conditions of filing, the application shall be examined whether it is eligible for registration within the provision s of Article 7 in respect of all or parts of the goods and services to be registered. The application found ineligible shall be refused under Article 7 in respect of all or part of those goods and services.
SECTION TWO
Publication of the Application
Publication of the Application
Article 33 - An application for registration of a trademark which has complied with the application conditions and has not been refused according to Articles 29, 30, 31 and 32 shall be published in the relevant Bulletin.
Where an application is refused in accordance with the provisions of the Articles referred to in the first paragraph, after the publication of the application, the decision of refusal shall also be published.
SECTION THREE
Observations by Third Parties
Observations by Third Parties
Article 34 -Any natural or legal person or any group representing manufacturers, producers, suppliers of services, traders or consumers may submit to the Institute their written observations that the trademark does not conform to the registration requirements in accordance with Article 7, following the publication of the trademark application. However, they shall not be parties to the proceedings before the Institute.
Opposition
Article 35 - Notices of opposition to the registration of trademark on the grounds that it may not be registered under the provisions of Article 7 and 8, and notices of opposition on the ground that there exists bad faith in the application shall be submitted within three months of the publication of the application.
The opposition made under the last paragraph of Article 8 shall be refused if the opposing party does not use his trademark during this period.
Oppositions must be submitted in writing and contain the arguments. Institute may request further facts, evidence and documents to be complied within the period prescribed in the Implementing Regulation.
Where the additional facts, evidence and documents requested are not submitted within the period prescribed by the Implementing Regulation the opposition shall be deemed to have not been made.
Examination of the Opposition
Article 36 - During the examination of the opposition, the Institute when it deems fit and as often as necessary may request the written observations of the parties and communicate to the parties involved such observations and objections submitted by the parties.
Institute, if it finds appropriate may invite the parties to make a friendly settlement.
The Institute shall refuse the opposition if it is not found to be valid. If the opposition is found to be valid for some of the goods or services for which trademark application has been made, the opposition shall be accepted in respect of those goods or services.
SECTION FOUR
Procedural Matters Related with a Trademark Application
Corrections
Article 37 - Upon the request of the applicant, corrections of the spelling errors and the errors in the name and address of the applicant, which does not cause any changes in the goods and services and the scope of the application shall be allowed during the application examination stage.
Withdrawal
Article 38 - A trademark application may be withdrawn by the applicant before it is registered.
SECTION FIVE
Registration
Registration
Article 39 - Where an application filed under the provisions of this Decree Having the Power of Law and the related Regulations, has been found to be without defects or its deficiencies remedied or received no opposition within the prescribed period or the opposition of which has been refused shall be entered in the Register. The applicant shall receive a 'Trademark Certificate of Registry'.
Registry shall include; date of registration of the trademark, representation of the trademark, application date, the list of the goods or services in respect of the trademark, classifications of the goods and services, the name and nationality of the proprietor of the trademark and agents name if applicable, title, address and country of registry of the legal person, changes relating to the trademark and to the rights on the trademark as well as other particulars specified in the Implementing Regulation.
Trademark registry is open to the public. Upon request and payment of the prescribed fee a copy the register shall be available.
Upon registry a trademark shall be published as provisioned in the Implementing Regulation including the information contained in paragraph two.
PART FOUR
Duration of Registry and Renewal of a Trademark
Duration of Registry
Article 40 - Trademark is registered for a period of ten years from the date of filing of the application. Registration may renewed for further periods of ten years.
Renewal
Article 41 - Registration of the registered trademark shall be renewed, upon the payment of the renewal fee at the request of the right holder or of the person authorised by him.
The Institute shall inform the right holder of the expiry of the registration within the time period as specified in the Implementing Regulation. Failure to give such information shall not involve the responsibility of the Institute.
The request for renewal shall be submitted and the renewal fee paid within a period of six months before the last day of the month in which protection ends. In failing this deadline, the request may be submitted within a further period of six months from the day referred to in the previous sentence upon payment of an additional fee.
Renewal shall take effect from the day following the date on which the existing registration expires. The renewal shall be entered in the registry.
The provisions of this Decree Having the Power of Law shall cease to produce effect for trademarks which have not been renewed within six months after the expiry of the period of protection.
PART FIVE
Invalidity of a Trademark and Termination of the Trademark Right
SECTION ONE
Invalidity of a Trademark
Invalidity
Article 42 - A registered trademark shall be declared invalid by the court in following cases:
a) where in breach of Article 7, (However, the action regarding well-known trademarks as specified subparagraph (i) of Article 7 has to be instituted within five years from the date of registration. If there is bad faith time limit shall not apply.)
b) where in breach of Article 8, (However, regarding the proceedings instituted under the last paragraph of Article 8, if the previous right holder has not used his trademark within the two years after the expiry of the period of protection it will not constitute a reason for invalidity.)
c) where in breach of Article 14, (However, serious use between the date of instituting of the proceedings and the expiry of the years shall not constitute a reason of invalidity. If use has been made upon realisation that proceedings are to be instituted, in such a case the court shall not take into consideration the use within three months prior of the institution of the proceedings.)
d) where the trademark has become generic in respect of the goods or services by the acts of the proprietor of the trademark,
e) where, as result of the use made by the proprietor or by the person authorised by him, there exists a likelihood of confusion on the part of the public as to the nature, quality, place of production and geographical origin in respect of the goods or services it is registered,
f) where used in breach of Article 59,
Where the invalidity is involved only for some of the products or services, partial invalidity shall be ruled with respect of those products and services.
Where the trademark having been used before the registration has acquired through this usage distinctive character in respect of the goods and services for which it is to be registered, the provisions of (b), (c) & (d) can not be invoked to invalidate the registration .
Application for a Declaration of Invalidity
Article 43 - Any person who has suffered, State Prosecutor or related official authorities may appeal for invalidity at the court.
Effects of Invalidity
Article 44 - A final decision for the declaration of invalidity shall have retroactive effect.
The retroactive effects of invalidity, without prejudice to claims for compensation for damage caused by negligence or lack of good faith on the part of the proprietor of the trademark, shall not extend to the following:
a) Any final decision for infringement of the trademark reached and enforced prior to the decision of invalidity;
b) Contracts concluded and executed prior to the decision of invalidity. However, partial or total reimbursement of sums paid under the contract may be claimed on grounds of equity to an extent justifiable by the circumstances;
A final decision of invalidity shall produce effect against all.
SECTION TWO
Termination of the Rights
Causes for Termination
Article 45 - The rights of a trademark shall terminate upon:
a) the expiry of the protection period and non-renewal within the prescribed period,
b) the surrendering of the rights by the proprietor of the trademark.
The termination of the rights of a trademark shall have effect from the time when the cause of the termination was realised. The termination of the rights of a trademark shall be published in the related Bulletin.
Surrender of a Right
Article 46 - Proprietor of a trademark may surrender his rights in respect of some or all of the goods and services for which it is registered.
The surrender shall be declared in writing to the Institute. Surrender shall effect as of the date of entry in the Trademark Register.
Proprietor of a trademark cannot surrender his right without having the consent of the licensees or holders of rights recorded in the Trademark Register.
Where there is a claim by a third party for the rights, surrender of the rights cannot be requested without the consent of the referred third party.
PART SIX
Appeals Against the Decisions of the Institute
Appeals
Article 47 - Appeals may be placed against the decisions of the Institute.
Where an appeal is made for an interim decision, a separate appeal shall be allowed upon decision becoming final.
Persons Entitled to Appeal
Article 48 - Any party adversely affected by a decision of the Institute may appeal. Any other parties to the proceedings shall be parties to the appeal as of right.
Form of Appeal
Article 49 - Notice of appeal must be filed in writing at the Institute within two months after the date of notification of the decision. The fee for appeal has to be paid when filing of the notice for the appeal to be examined. The grounds for appeal must be filed in a written statement within two months of the notification of the decision. Where the statement of grounds for appeal has not been submitted within this period the appeal shall be deemed not to have been filed.
Rectifying a Decision
Article 50 - The related department of the Institute upon deciding that the appeal is true and right may rectify its decision. This shall not apply where the appellant is opposed by another party to the proceedings.
If the appeal is not found acceptable by the related department, the appeal shall be forwarded to the Re-examination and Evaluation Board by the department without comment as to its merits.
Examination of Appeals
Article 51 - The Re-examination and Evaluation Board shall consider the appeal if the appeal is admissible.
The Re-examination and Evaluation Board shall invite the parties to submit their observations within the period prescribed by the Implementing Regulation, on the observations of the other parties or those of itself.
Decision in Respect of Appeal
Article 52 - After the examination, the Re-examination and Evaluation Board shall deliver its decision.
Actions before the Court against the Decisions
Article 53 - Actions may be instituted, within two months of the notification of the decision, at the authorised court against the final decisions of the Re-examination and Evaluation Board in respect of the appeals provisioned in Articles 47 through 52 inclusive.
PART SEVEN
GUARANTEE MARKS AND COLLECTIVE MARKS
Guarantee Marks
Article 54 - A guarantee mark, under the control of the proprietor of the mark, serves the purpose of the guaranteeing the common characteristics of the undertakings, production methods, geographical sign and quality of those undertakings.
Collective Mark
Article 55 - Collective mark is a mark used by a group of undertakings of producers or traders or providers of services.
Collective mark serves the purpose of distinguishing the goods and services of the undertakings belonging to the group from the goods and services of the other undertakings.
Technical Regulations of the Guarantee and Collective Marks
Article 56 - When filing an application for registration of a guarantee or a collective mark, a regulation specifying the ways and means of using the mark must be filed.
The guarantee mark regulation shall contain provisions regarding the common characteristics of the goods and services under guarantee and supervision procedures as to the use of the mark and the penalties to be administered when necessary.
The collective mark regulation shall specify the undertakings authorised to use the mark. Proprietors of a collective mark shall act collectively for the registration of a collective mark.
Application by one of the parties shall be sufficient for the renewal of a collective mark.
Amending the Technical Regulations
Article 57 -Technical regulations cannot be altered unless approved by the Institute.
Any changes to be made in the technical regulations where they are in violation of the second and third paragraphs of Article 56 or contrary to public policy and principles of morality shall be rejected by the Institute.
Regulations in Violation of the Decree Having the Power of Law
Article 58 - Where a technical regulation does not conform to the requirements of Article 56, Institute shall notify the proprietor of the mark to undertake the necessary alterations. Where the proprietor of the mark does not make the changes requested and alter the regulation accordingly the request for the registration of the collective mark or the guarantee mark shall be rejected.
Use in Violation of the Technical Regulation
Article 59 - Where the proprietor of a mark disregards a use of a collective or a guarantee mark which constitutes a violation of the technical regulation, and neglects to remedy the infraction within the time determined by the court in respect of an action brought by one of the parties, the mark shall be repealed by the court.
Transfer and Licensing
Article 60 - The transfer or licensing of a guarantee mark or a collective mark shall become valid only after entry in the Trademark Register.
PART EIGHT
Infringement of Rights
Infringement
Article 61 - Following shall be considered infringement of a trademark:
a) violations of Article 9,
b) use of the same or confusingly similar trademark without the consent of the proprietor of the trademark,
c) where being aware or should being aware that a mark is plagiarised, sell, distribute or put the commercial use or import or keep in possession for these purposes the goods carrying the infringed trademark,
d) to transfer to third parties or to expand rights acquired by a licensing contract,
e) to participate or to assist or to encourage or to facilitate in whatever form the acts referred in subparagraphs (a), (b) and (c),
f) to abstain from explaining where and how the product carrying the registered or confusingly similar trademark was obtained when found in possession.
Penalties and Fines Article 61/A
- (a)
- Those making false declaration with respect to true identity of the trademark right holder, or those removing without authority the sign indicating a trademark right rightfully placed on a product or on its packaging, or those falsely presenting themselves as the proprietor of a trademark application right or a trademark right shall be sentenced to an imprisonment term of between one and two years and to pay a fine of between three hundred million liras and six hundred million liras,
- (b)
- Having committed the acts without authority, those transferring or placing as security or undertaking any other such action for utilising any one of the rights of transfer, placing of security, execution of levy and other such rights provisioned in the related articles and the licenses thereof, and those affixing signs on a product produced or put to sale by own self or by others, or on its packaging thereof or on commercial documents or on advertising material in such a way that would convey the impression as if a relationship exists with a legally protected trademark right, or of using to the same effect writings, signs or expressions in the advertisements and commercials at the published and visual media without being the rightful proprietor of the trademark or after the expiry of the protection term or after the invalidation of the trademark right or after the termination of the trademark right shall be sentenced to an imprisonment term of between two and three years and to pay a fine of between six hundred million and one billion liras,
- (c)
- Those who have committed any one of the felonies specified in Article 61 shall be sentenced to an imprisonment term of between two and four years and to pay a fine of between six hundred million and one billion liras, furthermore judgement shall be ruled to close down the premises of their undertaking for a period not to be less than one year and they shall be prevented from practising any commercial activity during the same period.
Where the felonies stated above are committed by those working in the undertaking whether on their own or under instructions while carrying out their duties, the employees and the owner or the manager or their representative and the person holding whatever title whatsoever who is de facto managing the undertaking who have not prevented the misdemeanour shall be punished in the same manner. Where the felonies stated in Article 61 have been committed during the execution of tasks related with a legal entity, the legal entity shall also be liable for the fines, expenses and damages in succession of the real persons who have committed the misdemeanour. For those assisting the acts, depending on the nature of the action the provisions of the Articles 64, 65, 66 and 67 of the Turkish Penal Code shall apply. Prosecution with respect to the felonies stated above shall be subject to complaint.
Subparagraph 8 of paragraph 1 of article 344 of the Criminal Procedures Code No 1412 shall not apply for the implementation of the provisions of this article. The right of complaint belongs to the person whose trademark right has been infringed, and additionally belongs also to the Institute for all felonies except those provisioned in article 61, and to the Consumer Associations and to the establishments under the jurisdiction of laws no 5590 or no 507 for acts of false declaration with respect to true identity of the trademark right holder, and for acts of affixing signs on a product produced and put to sale by own self or by others, or on its packaging or on commercial documents or on advertising material in such a way that would give the impression as if a relationship exists with a protected trademark right, or of using to the same effect writings, signs or expressions in the advertisements and commercials at the published and visual media without being the rightful proprietor of the trademark or after the expiry of the protection term or after the invalidation of the trademark right or after the termination of the trademark right.
The proceedings with respect to the felonious acts should be initiated within two years of the date of being informed of the act and the actor. The complaints with respect to acts falling within this scope shall be treated as of urgent matters. The provisions of Article 36 of the Turkish Penal Code and the related articles of the Criminal Procedures Code shall apply for the seizure, the confiscation or the destruction of the goods and the equipment and machinery used to produce these goods which are subjects of acts of felony having infringed the rights arising from a trademark application or a protected trademark within the provisions of this Decree Having the Power of Law.
Appeals of the Proprietor of the Trademark
Article 62 - A proprietor of a trademark whose rights have been infringed may in particular appeal for the following at the Court:
a) for the cessation of the acts of infringement,
b) appeal for remedies of infringement and request compensation for damages incurred,
c) request the confiscation of the products and the equipment and machinery used to produce these products, those having infringed the trademark right, the production and the use which is a felony
d) appeal for the proprietorship over the products confiscated in accordance with subparagraph (c); in this case the value of the products shall be deducted from the compensation awarded. If the value of the products turn out to be above the compensation value awarded, the proprietor of the trademark shall repay the balance to the infringing party.
e) appeal for enforcement measures for the prevention of continued infringement of rights, request the erasing of the trademark from the products and vehicles or if it is essential for the preclusion of the acts of infringement request the destruction of the products and vehicles confiscated particularly in accordance with subparagraph (c).
f) request the disclosure to the public and to those related of the courts judgement by means of publication, costs of which to be met by the offending party.
Competent Courts
Article 63 - The competent court, for the institution of civil proceedings by the proprietor of a trademark against the third parties, is the court of the domicile of the plaintiff or of the place where the acts was committed or of the place where the act had effect.
Where the plaintiff is not a citizen of the Republic of Turkey, the competent court is the court of the domicile of the authorised agent registered in the registry and if the agent's registry has been cancelled the court of the domicile of the Institute.
The Competent Court, for the institution of proceedings by the third parties against the proprietor of a trademark, is the court of domicile of the defendant. If the applicant or trademark right holder is not domiciled in Turkey, the provisions of the second paragraph shall prevail.
Where there several competent courts, the court at which the proceedings are instituted first shall be the competent court.
Compensation
Article 64 -The person who, without the consent of the proprietor of the trademark, procedures, sells, distributes or puts to commercial use or imports for these purposes or keeps in possession for these purposes the product produced by plagiarising the trademark shall be liable to remedy the illegality and to compensate the damages he has caused.
The person using in any form the plagiarised trademark, having been informed of the infringement by the proprietor of the trademark and having been requested to stop the infringement or where the exists any other misuse, shall be liable to compensate the damages he has caused.
Documents Evidencing Infringement
Article 65 - The proprietor of a trademark can request form the infringing party the documents related with the use without his consent of the trademark, for valuation of the injury suffered resulting from the infringement of the trademark.
Surrender of Profits
Article 66 - The injury suffered by the proprietor of the trademark include not only the value of the actual loss but also the income loss incurred because of the infringement of the trademark rights.
The loss of income shall be calculated in accordance with one of the following evaluation methods, on the options of the proprietor of the trademark who has suffered the injury:
a) According to the possible income that the proprietor of the trademark would have generated if the competition of the infringing party did not exist;
b) According to the income generated by the infringing party from the use of the trademark;
c) According to a license fee that would have been paid if the party infringing the trademark right would have utilised the trademark under a legal licensing contract.
In calculation of the profits surrendered, in particular the economic value of the trademark, the term of protection remaining at the time of infringement, the type and member of the licences outstanding and similar effects shall be taken into consideration.
Increasing the Profits Surrendered
Article 67 - Where the proprietor of the trademark has selected one of the evaluation options specified in the subparagraph (a) or (b) or (c) of Article 66; the Court may be add on a reasonable extra amount if in court's opinion the trademark contributes substantially to the economic value of the product.
The assessment of the trademark's contribution to the economic value of the product shall be grounded on the verification that the demand for the product results substantially from the trademark.
Reputation of the Trademark
Article 68 - The proprietor of a trademark may request extra damages for the harm incurred from the improper use of trademark by the infringing party which were detrimental to the reputation of the trademark.
Those Against Whom Action Cannot Be Brought
Article 69 - Proprietor of a trademark cannot institute proceedings, under the provisions of this Section of this Decree Having the Power of Law, against those who have used the products put on the market by the person who has paid compensation to the proprietor of the trademark. This provision shall not have effect if there is bad faith.
Time Limit
Article 70 - Time limit provisions of the Code of Obligations shall have effect concerning the time limits for appeals relating to infringements on trademark rights.
Competent Courts
Article 71 -Special courts to be established by the Ministry of Justice shall have jurisdiction for all of the actions and claims provisioned by this Decree Having the Power of Law.
High Council of Judges and Prosecutors shall determine which of the Commercial Courts of the First Instance and the Criminal Courts of the First Instance shall be appointed as special courts and indicate their respective jurisdictions based on the request of the Ministry of Justice.
For actions brought in respect of the Institute's decisions within this Decree Having the Power of Law and for actions brought against the Institute by the third parties who have suffered from the decision of the Institute, the special court referred in the first paragraph shall have jurisdiction.
Publication of the Court's Decision
Article 72 - Where a court judgement has become final, the successful party may request the publication in full or in summary of the final judgement in a daily paper, radio, television or by other means of the media, the costs of which are to be met by the other party.
The nature and extent of the publication shall be determined in the judgement. Right of publication shall be void if not exercised within three months of the judgement becoming final.
Claims by the Licensee
Article 73 -Unless provided otherwise by the contract, the holder of an exclusive license may, in the case of an infringement of the trademark rights, institute in his own name all legal proceedings which have been made available to the proprietor of the trademark by this Decree Having the Power of Law. Holders of non-exclusive licenses do not have the right to institute legal proceedings.
In the case of an infringement, the holder of a non-exclusive license may give notice, through a notary public, requesting the proprietor of the trademark to institute such proceedings as required.
In the event that the proprietor of the trademark right refuses to initiate or within three months of the reception of the notice fails to institute proceedings, the non-exclusive license holder shall have the right to institute proceedings.
The licensee may, in the face of serious damage where elapsing of time cannot be remedied, request the court to issue an injunction for precautionary measures.
The licensee who has instituted proceedings in respect of paragraph three, shall notify the proprietor of the trademark that the proceedings have been instituted.
Claims of Non-infringement
Article 74 - Any related person may institute proceedings against the proprietor of a trademark to obtain a judgement of non-infringement.
Prior to the institution of proceedings referred in the first paragraph, a notice shall be forwarded through the notary public to the attention of the proprietor of the trademark to enable the trademark right holder to express his observations on whether the trademark to be used on the products produced or to be produced by the requesting party in Turkey constitute infringement of the trademark rights.
Where the proprietor of the trademark upon receiving such a notice does not respond within one month of receiving the notice, or the content of the response is not found acceptable by the requesting party, the appealing party shall have the right to institute proceedings according to the first paragraph.
Persons, against whom action of infringement has been brought in respect of the trademark right, cannot institute proceedings with respect to first paragraph.
Institution of proceedings shall be communicated to all right holders entered in the Trademark Register.
The actions referred to in this Article may also be instituted jointly with a claim for invalidity.
Action for Securing of Evidences
Article 75 - Any person entitled legally to bring action as prescribed by this Decree Having the Power of Law, may appeal the court to determine and secure the acts of infringement of the trademark.
Precautionary Measures
Article 76 - Any person entitled legally to bring action as prescribed by this Decree Having the Power of Law, may appeal the court to order precautionary measures provided that they can prove the existence of acts of actual use of the trademark or serious preparations to use the trademark which would constitute an infringement.
The request for precautionary measures may be filed before or with the institution of proceedings or filed later. The request for precautionary measures shall be examined separately.
Nature of the Precautionary Measures
Article 77 - Precautionary measures shall be in nature to enable securing of the judgement and particularly provide the following:
a) cessation of the acts of infringement of the trademark rights of the plaintiff,
b) injunction to arrest within the borders of Turkey, including the customs, free ports or free trade areas and keep in custody the produced or imported goods which have infringed the trademark rights,
c) ordering the placement of security for damages to be compensated.
Civil Procedures Code
Article 78 - With respect to other actions for securing and precautionary measures provisions of the Civil Procedures Code shall have effect.
Seizure at Customs
Article 79 - Customs authorities, while being exported or imported, shall withhold as a precautionary measure the products which have infringed the rights of a trademark.
Withholding procedures shall be determined by statute to be enacted for this purpose.
The withholding measure employed by the customs authorities shall cease to have effect if proceedings are not instituted at the special court or preventive injunction is not obtained from the court within ten days of the withholding.
PART NINE
Representation and Agents
Representation before the Institute
Article 80 - Representation before the Turkish Patent Institute for matters of trademarks may only be undertaken by the following:
a) natural or legal persons who have filed an application. Legal persons may only be represented by those duly powered by their respectively authorised bodies.
b) trademark agents.
Those who are domiciled outside the country can only be represented by trademark agents.
Where an agent has been appointed, all procedures are executed through the agent. All notices made to the agent shall be considered to have been made to the assignee.
PART TEN
Payment of Fees and Legal Effects
Term of Payment of Fees and Effects
Article 81 - The fees relating to filing an application and to a registered trademark as prescribed by the Implementing Regulations shall be paid by the applicant or by the proprietor of the trademark or by the trademark agent.
Where the prescribed fees for the registration of a trademark have not been paid within the period provisioned by this Decree Having the Power of Law, the application for the registration of the trademark shall be deemed to have been withdrawn.
PART ELEVEN
Last Provisions
Provisions Repealed
Article 82 -The Trademark Law No.551 dated 3.3.1995 have hereby been repealed.
Transitional Provisions
Transitional Article 1 -For applications for the registration of a trademark filed prior to the entry into force of this Decree Having the Power of Law, the provisions of the law valid on the date of the application shall have effect.
Without prejudice to all acts of transfer, inheritance and licensing contracts concluded and registered prior to the entering into force of this Decree Having the Power of Law, for any further actions and for all changes on these matters the provisions of this Decree Having the Power of Law shall prevail.
Transitional Article 2 -Those who have put to actual use of their service marks, may request the registration of their service marks filing the evidence of use within 12 months of the entering into force of this Decree Having the Power of Law.
The Institute shall examine the requests by the service mark users after the expiry of 12 months by taking into consideration the date of first use.
Transitional Article 3 -For the purposes of this Decree Having the Power of Law, until the Special Courts are established, based on the request of the Ministry of Justice, High Council of Judges and Prosecutors shall select from the Commercial Courts of the First Instance and the Criminal Courts of the First Instance those to be appointed as special courts and indicate their respective jurisdictions.
Entry into Force
Article 83 -This Decree Having the Power of Law shall enter into force on the day of publication.
Execution
Article 84 -This Decree Having the Power of Law shall be executed by the Council of Ministers.

PARTIE I DISPOSITIONS GÉNÉRALES
Section I Objet, portée, définitions et personnes ayant droit à la protection
Objet et portée
1er. L’objet du présent décret-loi est de protéger les marques enregistrées conformément aux dispositions de celui-ci.
Le présent décret-loi établit les principes, les règles et les conditions de la protection des marques.
Définitions
2. Aux fins du présent décret-loi :
a) “marques” s’entend des marques de produits ou de services, y compris des marques de garantie et des marques collectives;
b) “Convention de Paris” s’entend de la Convention de Paris pour la protection de la propriété industrielle du 20 mars 1883 et des modifications de celle-ci ratifiées par la Turquie;
c) “institut” s’entend de l’Institut turc des brevets créé par le décret-loi no 544;
d) “agent de marques” s’entend de la personne habilitée à représenter des tiers devant l’institut pour faire valoir et protéger les droits prévus dans le présent décret-loi.
Personnes ayant droit à la protection
3. Ont droit à la protection conférée par le présent décret-loi les personnes physiques et morales domiciliées sur le territoire de la République turque ou y ayant un établissement industriel ou commercial, ou les personnes jouissant du droit de déposer une demande en vertu des conventions de Paris ou de Berne ou de l’Accord instituant l’Organisation mondiale du commerce.
Les personnes physiques ou morales autres que celles visées au premier alinéa du présent article qui sont ressortissantes d’États accordant aux nationaux de la République turque une protection en droit et en fait jouissent de la protection des marques en Turquie conformément au principe de la réciprocité.
Primauté des conventions internationales
4. Lorsque les dispositions des conventions internationales entrées en vigueur conformément à la législation de la République turque offrent des conditions plus avantageuses que le présent décret-loi, les personnes visées à l’article 2 peuvent demander le bénéfice de ces dispositions.
Section II Signes susceptibles de constituer une marque et mode d’acquisition
des droits attachés à la marque
Signes susceptibles de constituer une marque
5. À condition qu’elle permette de distinguer les produits et services d’une entreprise des produits et services des autres entreprises, une marque peut consister en toutes sortes de signes susceptibles de représentation graphique, tels que les mots, y compris les noms de personnes, les dessins, lettres et chiffres, la forme des produits ou leur emballage et des éléments descriptifs similaires susceptibles d’être publiés et d’être reproduits par impression.
Une marque peut être enregistrée en même temps que le produit ou son emballage. Toutefois, l’enregistrement du produit ou de l’emballage ne confère pas à lui seul des droits exclusifs.
Mode d’acquisition des droits attachés à la marque
6. La protection de la marque en vertu du présent décret-loi s’obtient par l’enregistrement.
Motifs absolus de refus d’enregistrement de la marque
7. Ne peuvent être enregistrés comme marques :
a) les signes contraires aux dispositions de l’article 5;
b) les marques identiques à une marque enregistrée ou dont l’enregistrement a été demandé, ou les marques semblables à celle-ci au point de créer une confusion, utilisées pour un type de produit ou de service identique ou similaire au point de créer une confusion;
c) les marques composées exclusivement de signes ou d’indications servant dans le commerce à indiquer l’espèce, les caractéristiques, la qualité, la quantité, la destination, la valeur ou la provenance géographique ou pour désigner l’époque de la production du produit ou de la prestation du service ou d’autres caractéristiques des produits ou services;
d) les marques composées exclusivement de signes et de noms utilisés pour distinguer certains groupements d’artisans, de membres de professions libérales ou de commerçants ou qui sont devenues habituelles dans la pratique usuelle et constante du commerce;
e) les signes constitués par la forme imposée par la nature du produit, nécessaire à l’obtention d’un résultat technique ou conférant une valeur substantielle au produit;
f) les marques qui sont de nature à tromper le public, notamment quant à l’espèce, à la qualité, au lieu de production ou à la provenance géographique des produits et services;
g) les marques qui n’ont pas été autorisées par les autorités compétentes et doivent être refusées à l’enregistrement en vertu de l’article 6ter de la Convention de Paris;
h) les marques comportant des insignes, emblèmes ou écussons autres que ceux visés à l’article 6ter de la Convention de Paris qui n’ont pas été autorisés par les autorités compétentes et qui présentent un intérêt historique et culturel particulier pour le public;
i) les marques qui n’ont pas été autorisées par leurs titulaires et les marques notoirement connues au sens de l’article 6bis de la Convention de Paris;
j) les marques qui comportent des symboles religieux;
k) les marques contraires à l’ordre public et aux bonnes mours.
Les dispositions des sous-alinéas b), c) et d) ci-dessus ne peuvent être invoquées pour refuser l’enregistrement d’une marque qui a été utilisée avant son enregistrement et qui a acquis de ce fait un caractère distinctif pour les produits et services pour lesquels son enregistrement est demandé.
Motifs relatifs de refus d’enregistrement de la marque
8. Sur opposition du titulaire de la demande d’enregistrement de marque ou du titulaire de la marque enregistrée, l’enregistrement est refusé dans les cas suivants :
a) si la marque dont l’enregistrement est demandé est identique à une marque enregistrée ou à une marque dont la demande porte une date antérieure et si la protection est demandée pour des produits ou services identiques;
b) si, en raison de son identité ou de sa ressemblance avec une marque dont la demande porte une date antérieure ou avec une marque enregistrée et si, en raison de l’identité ou de la similitude des produits et services que désignent les deux marques, il existe un risque de confusion dans l’esprit du public et que ce risque de confusion comprend le risque d’association avec la marque enregistrée ou avec la marque dont la demande porte une date antérieure.
Sur opposition du titulaire de la marque, une marque est refusée à l’enregistrement si l’agent ou le représentant du titulaire a demandé l’enregistrement en son nom propre sans le consentement de ce dernier et sans juste motif. En cas d’opposition du propriétaire d’une marque non enregistrée ou d’un autre signe utilisé dans le commerce, une marque est refusée à l’enregistrement :
a) si les droits au signe ont été acquis avant la date de la demande d’enregistrement de la marque, ou avant la date de priorité invoquée pour ladite demande;
b) si le signe confère à son titulaire le droit d’interdire l’utilisation d’une marque postérieure.
Une marque dont l’enregistrement est demandé et qui est identique ou semblable à une marque enregistrée ou à une marque dont la demande porte une date antérieure peut être utilisée pour des produits et services différents. Toutefois, lorsque la marque enregistrée ou une marque dont la demande porte une date antérieure est une marque renommée, et que l’usage sans juste motif de la marque dont l’enregistrement est demandé tirerait indûment profit du caractère distinctif ou de la renommée de cette autre marque ou leur porterait atteinte, la demande d’enregistrement est rejetée sur opposition du titulaire, même si elle est destinée à être utilisée en relation avec des produits ou services qui ne sont pas similaires à ceux pour lesquels la marque antérieure est enregistrée.
Sur opposition du titulaire des droits concernés, la marque demandée est refusée à l’enregistrement si elle contient le nom ou la photographie d’autrui ou porte atteinte au droit d’auteur ou à tout droit de propriété industrielle appartenant à autrui. Sur opposition, une marque dont l’enregistrement est demandé et qui est identique ou semblable à une marque collective ou de garantie est refusée à l’enregistrement pendant trois ans à compter de la date d’expiration de la marque collective ou de garantie.
Sur opposition, une marque identique ou semblable à une marque dont l’enregistrement n’a pas été renouvelé, et dont l’enregistrement est demandé pour des produits et services identiques ou similaires, est refusée à l’enregistrement pendant deux ans à compter de la date d’expiration.
Section III Étendue de la protection de la marque
Droits conférés par la marque enregistrée
9. Le titulaire de la marque peut interdire aux tiers d’effectuer sans son consentement les actes suivants :
a) utiliser tout signe identique à la marque enregistrée pour des produits ou services identiques à ceux pour lesquels celle-ci est enregistrée;
b) utiliser tout signe qui, en raison de son identité ou de sa ressemblance avec la marque enregistrée et de son identité ou de sa similitude avec les produits ou services visés par la marque enregistrée, risque d’induire le public en erreur en créant notamment un risque d’association entre le signe et la marque;
c) utiliser tout signe identique ou semblable à la marque enregistrée pour des produits ou services qui ne sont pas similaires à ceux pour lesquels celle-ci est enregistrée, dans le cas où l’usage de ce signe sans juste motif tirerait indûment profit du caractère distinctif ou de la renommée de la marque enregistrée ou leur porterait atteinte.
Il peut être interdit en vertu du premier alinéa ci-dessus :
i) d’apposer le signe sur les produits ou sur leur emballage;
ii) d’offrir, de mettre dans le commerce ou de stocker à ces fins les produits sous le signe, ou d’offrir ou de fournir des services sous le signe;
iii) d’importer ou d’exporter les produits sous le signe;
iv) d’utiliser le signe dans les papiers d’affaires et la publicité.
Les droits conférés par la marque enregistrée sont opposables aux tiers à compter de la date de publication de l’enregistrement de la marque. Une indemnité peut être demandée pour des faits postérieurs à la date de publication de la demande d’enregistrement de marque. Toutefois, les droits découlant de la publication d’une demande sont réputés inclus dans les droits conférés par la publication de l’enregistrement de la marque. Le tribunal saisi de l’affaire ne peut se prononcer sur le fond tant que l’enregistrement n’a pas été publié.
Reproduction de la marque dans les dictionnaires et ouvrages de références
10. Lorsque la marque est reproduite dans un dictionnaire, une encyclopédie ou un ouvrage de référence similaire sans mention du fait qu’elle est enregistrée, donnant ainsi l’impression qu’elle constitue le nom générique des produits ou services pour lesquels la marque est enregistrée, l’éditeur doit, sur requête du titulaire, rectifier l’omission dans l’édition suivante.
Interdiction d’utiliser une marque enregistrée au nom d’un agent ou d’un représentant
11. Lorsque la marque est enregistrée au nom de l’agent ou du représentant du titulaire sans le consentement de ce dernier, celui-ci peut s’opposer à l’utilisation de la marque, sauf si l’agent ou le représentant a un motif légitime pour agir.
Limitation des effets de la marque enregistrée
12. Le titulaire de la marque ne peut empêcher un tiers d’utiliser, dans le commerce, ses propres nom et adresse, les renseignements concernant l’espèce, la qualité, la quantité, la destination, la valeur, la provenance géographique ou l’époque de la production des produits ou de la prestation des services, ou d’autres caractéristiques de ceux-ci, pour autant que cet usage soit fait conformément aux usages honnêtes en matière industrielle ou commerciale.
Épuisement des droits conférés par la marque enregistrée
13. Les actes effectués en relation avec un produit comportant une marque enregistrée ne constituent pas une atteinte aux droits attachés à la marque si le produit a déjà été mis sur le marché en Turquie par le titulaire ou avec son consentement.
Même lorsque l’alinéa précédent s’applique, le titulaire a le droit de s’opposer à la commercialisation ultérieure des produits, notamment lorsque l’état de ces derniers est modifié ou altéré après leur mise dans le commerce.
Section IV Usage de la marque
Usage de la marque
14. Si, dans un délai de cinq ans à compter de la date d’enregistrement, la marque n’a pas été utilisée ou si son usage a été suspendu pendant une période ininterrompue de cinq ans sans juste motif, la marque est radiée.
Sont réputés constituer un usage :
a) l’emploi de la marque enregistrée sous une forme qui diffère par des éléments n’altérant pas le caractère distinctif de la marque;
b) l’apposition de la marque sur des produits ou leur emballage aux seules fins de l’exportation;
c) l’usage de la marque avec le consentement de son titulaire;
d) l’importation de produits portant la marque.
Section V Actes juridiques touchant les droits attachés à la marque
Actes juridiques
15. La marque enregistrée peut être transférée à un tiers, utilisée à titre de sûreté ou concédée sous licence, et peut être transmise par voie successorale. Les dispositions pertinentes du Code civil s’appliquent aux sûretés.
Les opérations entre vifs concernant la marque enregistrée doivent être constatées par écrit.
Transfert de la marque
16. La marque enregistrée peut être transférée pour tout ou partie des produits ou services pour lesquels elle est enregistrée.
Le transfert d’une entreprise dans sa totalité, avec son actif et son passif, implique, sauf stipulation contraire, celui des droits sur les marques de l’entreprise. La présente disposition s’applique à l’obligation contractuelle de transférer l’entreprise.
Sans préjudice des dispositions du deuxième alinéa ci-dessus, la cession d’une marque enregistrée doit être constatée par écrit et signée par les parties au contrat, sauf lorsqu’elle résulte d’une décision judiciaire. À défaut, le contrat est nul.
Lorsque le transfert est de nature à induire le public en erreur quant à l’espèce, à la qualité ou à la provenance géographique des produits ou services qui sont concernés, l’institut ne procède pas à son enregistrement, sauf si les ayants cause acceptent de limiter l’enregistrement de la marque aux produits ou services pour lesquels elle ne risque pas d’induire le public en erreur.
Le transfert est inscrit au registre et publié sur requête de l’une ou l’autre des parties.
Tant que le transfert n’a pas été inscrit au registre, les parties ne peuvent se prévaloir des droits découlant de l’enregistrement de la marque contre les tiers de bonne foi.
Transfert d’une marque enregistrée au nom d’un agent ou d’un représentant
17. Lorsque la marque est enregistrée au nom d’un agent ou représentant du titulaire de la marque sans le consentement de ce dernier, celui-ci a le droit d’exiger que l’enregistrement lui soit cédé, à moins que l’agent ou le représentant ne justifie son acte.
Utilisation de la marque à titre de sûreté
18. La marque enregistrée peut être utilisée à titre de sûreté indépendamment de l’entreprise
Une telle utilisation doit être mentionnée au registre et publiée sur requête de l’une des parties.
Saisie
19. La marque enregistrée peut être saisie indépendamment de l’entreprise.
La saisie doit être inscrite au registre et publiée.
Licence
20. Les droits sur une marque enregistrée peuvent faire l’objet de licences pour tout ou partie des produits ou services pour lesquels la marque est enregistrée.
Conditions applicables à la licence
21. Une licence peut être exclusive ou non exclusive.
Sauf clause contraire du contrat de licence, la licence est réputée non exclusive. Le donneur de licence peut utiliser lui-même la marque et la concéder sous licence à des tiers.
Dans le cas d’une licence exclusive, le donneur de licence ne peut octroyer de licences à d’autres personnes ni utiliser la marque, à moins que le contrat ne le stipule expressément.
Sauf clause expresse du contrat de licence, le preneur de licence ne peut transférer les droits concédés sous licence ni octroyer une sous-licence.
Sauf clause contraire du contrat de licence, le preneur de licence exerce les droits exclusifs relatifs à l’utilisation de la marque pendant la période de protection.
Sauf clause contraire du contrat de licence, le titulaire d’une licence exclusive peut, en cas d’atteinte aux droits sur la marque, intenter en son nom toute action qui est ouverte au titulaire de la marque en vertu du présent décret-loi. Les titulaires de licences non exclusives n’ont pas le droit d’agir en justice.
En cas d’atteinte à la marque, le titulaire d’une licence non exclusive peut, par l’intermédiaire d’un officier ministériel, mettre le titulaire de la marque en demeure d’engager les poursuites nécessaires. Si l’intéressé s’y refuse, ou s’il néglige de le faire dans un délai de trois mois à compter de la mise en demeure, le titulaire de la licence non exclusive peut engager lui-même l’action. Le preneur de licence peut, s’il s’expose à un préjudice grave appelé à durer, demander au tribunal de délivrer une injonction de ne pas faire. Le preneur de licence qui a engagé les poursuites doit en aviser le titulaire de la marque.
Le titulaire de la marque doit prendre les mesures nécessaires pour garantir la qualité des produits ou services fournis par le preneur de licence.
En cas de violation des dispositions du contrat de licence par le preneur de licence, une action peut être intentée contre ce dernier pour faire valoir les droits attachés à la marque enregistrée.
Tant qu’elle n’est pas enregistrée, la licence n’est pas opposable aux tiers de bonne foi.
Le contrat de licence ne peut contenir de clauses contraires au présent décret-loi et aux autres lois, décrets et règlements connexes. De telles clauses sont réputées non écrites même si elles sont conformes aux dispositions légales entrées en vigueur après la signature du contrat.
Procédures légales
22. Les procédures légales applicables à la marque en ce qui concerne le transfert, la concession de licences, l’utilisation à titre de sûreté et les changements de titulaire s’appliquent également à la demande d’enregistrement de marque.
PARTIE II DEMANDE
Section I Dépôt de la demande
Dépôt de la demande
23. La demande d’enregistrement d’un signe doit contenir les pièces suivantes :
a) une requête, dont la forme et le contenu seront précisés dans le règlement d’application, contenant les renseignements relatifs à l’identité du déposant;
b) une représentation de la marque permettant la reproduction de celle-ci;
c) la liste des produits ou services pour lesquels la marque doit être utilisée;
d) l’original de la quittance attestant le paiement des taxes de dépôt;
e) l’original de la quittance attestant le paiement des taxes par classe;
f) le pouvoir, si un agent est désigné;
g) la liste des personnes qui ont la signature lorsque le déposant est une personne morale;
h) les documents justifiant de l’activité commerciale du déposant.
La demande d’enregistrement de marque n’est valable que si la taxe de dépôt est acquittée au moment du dépôt.
Une demande distincte doit être déposée pour chaque marque.
Toutes les pièces accompagnant la demande d’enregistrement de marque ou remises ultérieurement à l’institut doivent être conformes au règlement d’application.
Classement
24. Les produits et services pour lesquels l’enregistrement de la marque est demandé doivent être classés selon la classification internationale des produits et des services. Les principes de classement sont précisés dans le règlement d’application.
Droit de priorité
25. Les personnes physiques ou morales ressortissantes d’un État partie à la Convention de Paris ou, à défaut, domiciliées dans un tel État ou y ayant un établissement effectif jouissent, pour déposer en Turquie une demande de certificat d’enregistrement pour la même marque, d’un droit de priorité de six mois à compter de la date à laquelle une demande d’enregistrement de marque valable est déposée auprès des organismes compétents de l’État concerné. Le droit de priorité qui n’a pas été exercé à l’expiration de ce délai est éteint.
Lorsqu’une priorité est revendiquée en vertu du premier alinéa ci-dessus, toutes les demandes déposées et tous les certificats d’enregistrement obtenus par des tiers pour des marques entrant dans le champ de la protection sont déclarés nuls à compter du jour du dépôt reconnu comme donnant naissance au droit de priorité.
Si une personne physique ou morale ressortissante d’un État partie à la Convention de Paris a déposé une demande valable dans un État qui n’est pas partie à cette convention, elle jouit pour ce dépôt du droit de priorité prévu au présent article.
Priorité d’exposition
26. Les personnes physiques ou morales au sens du premier alinéa de l’article 3 qui ont présenté les produits ou services portant la marque lors d’une exposition nationale ou internationale tenue en Turquie ou lors d’une exposition nationale ou internationale officielle ou officiellement reconnue tenue dans un État signataire de la Convention de Paris peuvent revendiquer un droit de priorité pour l’enregistrement de la marque en Turquie à condition que la demande revendiquant la priorité soit déposée dans un délai de six mois à compter de la date de la première présentation des produits.
Si les produits ou services portant la marque ont été présentés à l’exposition avant la date d’ouverture officielle, le droit de priorité prend effet à compter du jour où ils ont été présentés pour la première fois à l’exposition.
Les organisateurs de l’exposition tenue en Turquie fourniront des justificatifs précisant les noms des produits ou les types de services, la date de la première présentation et la date
d’ouverture officielle de l’exposition à laquelle les produits ou services ont été présentés au public.
S’il s’agit de produits et de services exposés à l’étranger, les justificatifs mentionnés à l’alinéa précédent devront être fournis par les autorités compétentes de l’État concerné.
Il ne peut être fait obstacle à ce que les produits portant la marque soient exposés en Turquie ou repartent dans leur pays d’origine après la clôture de l’exposition.
Si plusieurs personnes revendiquent la priorité d’un enregistrement de marque ou d’une demande d’enregistrement de marque portant sur les mêmes produits ou services, le droit de priorité appartient à celle qui a exposé en premier les produits ou services ou, si elles les ont exposés en même temps, à celle qui dépose sa demande en premier.
Effet des droits de priorité
27. Les droits de priorité découlant des articles 25 et 26 prennent effet à compter de la date de la demande dont la priorité est revendiquée.
Revendication et preuve de la priorité
28. Le déposant qui veut se prévaloir de son droit de priorité est tenu de joindre une déclaration de priorité à sa demande d’enregistrement. Si le droit de priorité n’est pas prouvé dans un délai de trois mois à compter du dépôt de la demande, la déclaration de priorité est réputée nulle.
L’octroi d’un droit de priorité d’exposition ne prolonge pas le délai de priorité prévu à l’article 25.
PARTIE III PROCÉDURE D’ENREGISTREMENT
Section I Examen de la demande
Examen des conditions de dépôt
29. L’institut vérifie si la demande satisfait aux conditions énoncées à l’article 23 et si elle ne comporte pas d’irrégularités. S’il ne constate aucune irrégularité, il attribue à la demande, comme date de dépôt, l’heure et la minute du dépôt initial effectué auprès de l’institut ou de l’organisme par lui habilité.
Si une déclaration de priorité a été déposée, l’institut procède à son examen conformément aux articles 25, 26 et 27.
Rectification des irrégularités
30. Si des irrégularités concernant les conditions énoncées à l’article 23 sont constatées, l’institut demande au déposant de les rectifier dans le délai prévu par le règlement d’application.
L’institut rejette la demande lorsque les renseignements relatifs à l’identité du déposant mentionnés au sous-alinéa a) de l’article 23 font complètement ou partiellement défaut ou lorsque l’une des pièces énumérées aux sous-alinéas b), c) et d) n’a pas été remise.
Si le déposant donne suite à la demande de l’institut en rectifiant, dans le délai prévu par le règlement d’application, les irrégularités constituées par l’inobservation des sous-alinéas e), f), g) et h) de l’article 23, l’institut accorde comme date de dépôt le jour du dépôt initial de la demande irrégulière.
L’inobservation des dispositions concernant la revendication du droit de priorité entraîne simplement la perte du droit de priorité pour la demande.
Examen des conditions relatives à la qualité du déposant
31. Les demandes déposées par des personnes physiques ou morales ne répondant pas à la définition de l’article 3 sont rejetées.
Examen relatif aux motifs absolus de refus
32. Lorsqu’il a conclu à la régularité du dépôt, l’institut vérifie si la demande peut être enregistrée en vertu de l’article 7 pour tout ou partie des produits ou services. Si tel n’est pas le cas, la demande est rejetée en vertu de l’article 7 pour tout ou partie des produits ou services.
Section II Publication de la demande
Publication de la demande
33. Toute demande d’enregistrement de marque qui satisfait aux conditions de dépôt et qui n’a pas été rejetée en vertu de l’article 29, 30, 31 ou 32 est publiée au Bulletin.
Lorsque la demande est rejetée en vertu de l’un des articles visés à l’alinéa précédent, la décision de refus est également publiée.
Section III Observations des tiers
Observations des tiers
34. Toute personne physique ou morale ou tout groupement représentant des fabricants, producteurs, prestataires de services, commerçants ou consommateurs peut, après publication de la demande d’enregistrement de marque, adresser par écrit à l’institut des observations indiquant que la marque ne satisfait pas aux prescriptions de l’article 7 concernant l’enregistrement. Ces personnes ou groupements ne peuvent cependant intervenir dans la procédure en cours devant l’institut.
Opposition
35. En cas d’opposition formée à l’enregistrement de la marque au motif que celle-ci tombe sous le coup de l’article 7 ou 8, ou est entachée de mauvaise foi, l’avis d’opposition doit être notifié dans un délai de trois mois à compter de la date de publication de la demande.
L’opposition formée en vertu du dernier alinéa de l’article 8 est rejetée si l’opposant n’utilise pas sa marque pendant la période indiquée.
L’opposition doit être formée par écrit et motivée. L’institut peut, dans le délai prévu par le règlement d’application, demander la communication d’éléments de fait, de preuves et de pièces supplémentaires.
Lorsque les éléments de fait, les preuves et les pièces supplémentaires ne sont pas communiqués dans le délai prévu par le règlement d’application, l’opposition est réputée ne pas avoir été formée.
Examen de l’opposition
36. Lorsqu’il examine l’opposition, l’institut peut, s’il le juge utile et aussi souvent que nécessaire, demander aux parties de lui transmettre des observations écrites, et communiquer les observations et objections qu’il aura reçues aux autres parties intéressées.
L’institut peut, s’il le juge utile, inviter les parties à se concilier.
L’institut rejette l’opposition s’il constate qu’elle n’est pas fondée. S’il constate qu’elle est fondée pour une partie des produits ou services pour lesquels la demande d’enregistrement de marque a été déposée, l’opposition est acceptée pour cette partie des produits ou services.
Section IV Points de procédure concernant les demandes de marques
Rectifications
37. Sur requête du déposant, des rectifications peuvent être apportées pendant la phase d’examen aux fautes d’orthographe et aux erreurs concernant le nom et l’adresse du déposant, pour autant qu’elles ne modifient en rien les produits ou services ou la portée de la demande.
Retrait
38. Le déposant peut retirer sa demande d’enregistrement de marque jusqu’à l’enregistrement.
Section V Enregistrement
Enregistrement
39. S’il est constaté que la demande déposée en vertu du présent décret-loi et de son règlement d’application est régulière, si les éventuelles irrégularités ont été rectifiées, si aucune opposition n’a été formée dans le délai imparti ou si l’opposition a été rejetée, la demande est inscrite au registre. Le déposant reçoit un certificat d’enregistrement de marque.
Figurent dans le registre la date d’enregistrement de la marque, la représentation de la marque, la date de la demande, la liste des produits ou services pour lesquels la marque sera utilisée, le classement des produits ou services, le nom et la nationalité du titulaire de la marque et le nom de son agent le cas échéant, la dénomination, l’adresse et le pays d’enregistrement de la personne morale, toutes les modifications apportées à la marque et aux droits sur la marque et tous autres renseignements prévus dans le règlement d’application.
Le registre des marques peut être consulté librement. Des extraits peuvent être obtenus sur demande moyennant paiement de la taxe prescrite.
Une fois enregistrée, la marque est publiée conformément aux dispositions du règlement d’application, accompagnée des pièces et renseignements énumérés au second alinéa ci- dessus.
PARTIE IV DURÉE ET RENOUVELLEMENT DE L’ENREGISTREMENT
Durée de l’enregistrement
40. La marque est enregistrée pour une période de 10 ans à compter de la date de dépôt de la demande. L’enregistrement peut être renouvelé, par périodes de 10 ans.
Renouvellement
41. L’enregistrement de la marque est renouvelé, moyennant paiement de la taxe correspondante, sur requête du titulaire des droits ou de la personne habilitée par lui.
L’institut informe le titulaire des droits de l’expiration de l’enregistrement dans le délai prévu par le règlement d’application. Sa responsabilité n’est pas engagée s’il omet de communiquer cette information.
La requête en renouvellement doit être communiquée et la taxe de renouvellement payée dans les six mois qui précèdent le dernier jour du mois au cours duquel la protection cesse. Si ce délai n’est pas respecté, la requête peut être présentée à nouveau dans un délai de six mois à compter du jour mentionné dans la phrase précédente, moyennant paiement d’une surtaxe.
Le renouvellement prend effet le jour qui suit la date à laquelle expire l’enregistrement en cours. Le renouvellement est mentionné au registre.
Les dispositions du présent décret-loi cessent de produire effet à l’égard des marques dont l’enregistrement n’a pas été renouvelé dans un délai de six mois à compter de la fin de la période de protection.
PARTIE V NULLITÉ DE LA MARQUE ET EXTINCTION DES DROITS
ATTACHÉS À CELLE-CI
Section I Nullité de la marque
Nullité
42. Le tribunal annule la marque enregistrée :
a) lorsqu’elle a été enregistrée en contravention de l’article 7 (toutefois, les actions relatives aux marques notoirement connues au sens du point i) de l’article 7 doivent être intentées dans un délai de cinq ans à compter de la date d’enregistrement; l’action n’est pas soumise à prescription en cas de mauvaise foi);
b) lorsqu’elle a été enregistrée en contravention de l’article 8 (toutefois, en ce qui concerne les poursuites engagées en vertu du dernier alinéa de l’article 8, si le précédent titulaire des droits n’utilise pas sa marque pendant les deux années qui suivent la fin de la période de protection, la marque n’est pas annulée);
c) lorsqu’elle a été enregistrée en contravention de l’article 14 (toutefois, l’usage fait de bonne foi entre le jour où les poursuites sont engagées et celui où la période de cinq ans vient à expiration ne constitue pas une cause de nullité; si l’usage a été motivé par l’imminence des poursuites, le tribunal ne tient pas compte de l’usage fait au cours des trois mois précédant leur engagement);
d) lorsqu’elle est devenue le nom générique des produits ou services par le fait de l’activité du titulaire de la marque;
e) lorsque, en conséquence de l’usage fait par le titulaire ou par la personne habilitée par lui, le public risque d’être induit en erreur quant à l’espèce, à la qualité, au lieu de production et à la provenance géographique des produits ou services pour lesquels la marque est enregistrée;
f) lorsque la marque est utilisée en violation de l’article 59.
Lorsque la cause de nullité n’existe que pour une partie des produits ou services, la nullité n’est prononcée que pour cette partie.
Lorsque la marque a acquis, par un usage antérieur à l’enregistrement, un caractère distinctif pour les produits et services pour lesquels son enregistrement est demandé, les dispositions des alinéas b), c) et d) ci-dessus ne peuvent être invoquées à l’appui d’une requête en annulation.
Requête en annulation
43. La partie lésée, le parquet ou les autorités officielles compétentes peuvent demander au tribunal l’annulation de la marque.
Effet de la nullité
44. La décision finale prononçant la nullité a un effet rétroactif. Cet effet, sans préjudice toutefois du droit à réparation du dommage causé par la négligence ou la mauvaise foi du titulaire de la marque, ne s’étend pas :
a) à la décision finale sur l’atteinte à la marque, rendue et exécutée avant que la nullité ne soit prononcée;
b) aux contrats conclus et exécutés avant que la nullité ne soit prononcée; toutefois, le remboursement partiel ou total des sommes versées au titre du contrat peut être demandé sur le fondement de l’équité, dans la mesure justifiée par les circonstances.
La décision finale prononçant la nullité est opposable erga omnes.
Section II Extinction des droits
Causes d’extinction
45. Les droits sur la marque s’éteignent :
a) à l’expiration de la durée de la protection si l’enregistrement n’est pas renouvelé dans le délai prescrit;
b) si le titulaire de la marque renonce à ses droits.
Les droits sur la marque s’éteignent à compter du moment où survient la cause d’extinction. L’extinction des droits sur la marque fait l’objet d’une publication au Bulletin.
Renonciation aux droits
46. Le titulaire de la marque peut renoncer aux droits qu’il détient sur une partie ou la totalité des produits ou services pour lesquels elle est enregistrée.
La renonciation doit être notifiée par écrit à l’institut. Elle prend effet à compter du jour de son inscription au registre.
Le titulaire de la marque ne peut renoncer à ses droits sans le consentement des preneurs de licence ou des titulaires de droits inscrits au registre.
Lorsque les droits sont revendiqués par un tiers, la renonciation ne peut être enregistrée sans le consentement de ce dernier.
PARTIE VI RECOURS CONTRE LES DÉCISIONS DE L’INSTITUT
Recours
47. Les décisions de l’institut sont susceptibles de recours.
Lorsqu’un recours est formé contre une décision provisoire, un recours distinct peut être formé contre la décision devenue définitive.
Personnes admises à former le recours
48. Toute partie à qui une décision de l’institut fait grief peut former un recours contre cette décision. Toute autre partie à la procédure ayant conduit à cette décision est de droit partie au recours.
Forme du recours
49. Le recours doit être formé par écrit auprès de l’institut dans un délai de deux mois à compter de la notification de la décision. La taxe de recours doit être acquittée en même temps. L’exposé des moyens doit être communiqué par écrit dans un délai de deux mois à compter de la notification de la décision. À défaut, le recours est réputé ne pas avoir été formé.
Rectification de la décision
50. Le service compétent de l’institut peut rectifier sa décision s’il conclut que le recours est fondé. La présente disposition ne s’applique pas si le recours met en cause une autre partie.
Si le service compétent juge le recours irrecevable, il le transmet à la Commission de réexamen et d’évaluation sans se prononcer sur le fond.
Examen des recours
51. La Commission de réexamen et d’évaluation examine le recours s’il est recevable.
Elle invite les parties à communiquer, dans le délai prévu par le règlement d’application, leurs commentaires sur les observations des autres parties ou sur ses propres observations.
Décision
52. Après examen, la commission rend sa décision.
Contestation en justice des décisions de la commission
53. Les décisions définitives de la commission rendues sur les recours prévus aux articles 47 à 52 peuvent être contestées devant le tribunal compétent dans un délai de deux mois à compter de leur notification.
PARTIE VII MARQUES DE GARANTIE ET MARQUES COLLECTIVES
Marques de garantie
54. La marque de garantie vise, sous le contrôle du titulaire de la marque, à garantir les caractéristiques communes des entreprises, ainsi que les méthodes de production, les indications géographiques et la qualité de celles-ci.
Marques collectives
55. La marque collective est une marque utilisée par un groupement de producteurs, de commerçants ou de prestataires de services.
Elle sert à distinguer les produits et services des entreprises du groupement de ceux des autres entreprises.
Règlement d’usage des marques de garantie et des marques collectives
56. Lorsqu’une demande d’enregistrement est déposée pour une marque de garantie ou une marque collective, elle doit être accompagnée d’un règlement d’usage de la marque.
Le règlement d’usage d’une marque de garantie doit contenir les dispositions relatives aux caractéristiques communes des produits et services garantis, aux procédures de contrôle de l’usage de la marque et aux sanctions éventuelles.
Le règlement d’usage d’une marque collective doit indiquer les entreprises autorisées à utiliser la marque. Les titulaires d’une marque collective doivent en demander collectivement l’enregistrement. La demande émanant de l’un d’eux suffit pour le renouvellement de l’enregistrement.
Modification du règlement d’usage
57. Le règlement d’usage ne peut être modifié qu’avec l’approbation de l’institut. L’institut doit rejeter toute modification contrevenant aux dispositions des deuxième et troisième alinéas de l’article 56 ou contraire à l’ordre public ou aux bonnes mours.
Règlements contraires au présent décret-loi
58. Lorsque le règlement d’usage ne satisfait pas aux prescriptions de l’article 56, l’institut demande au titulaire de la marque de procéder aux modifications nécessaires. Si celui-ci ne le fait pas, la demande d’enregistrement de la marque collective ou de la marque de garantie est rejetée.
Utilisation contraire aux dispositions du règlement d’usage
59. Lorsqu’un usage de la marque collective ou de garantie constitue une violation des dispositions du règlement d’usage et que le titulaire néglige de mettre fin à la violation dans le délai imparti par le tribunal en conséquence d’une action intentée par l’une des parties, le tribunal annule la marque.
Transfert et concession de licences
60. Le transfert de la marque de garantie ou de la marque collective ou la concession de licences d’exploitation de ces marques n’est valable qu’après son inscription au registre.
PARTIE VIII ATTEINTES AUX DROITS
Actes constitutifs d’une atteinte
61. Constituent une atteinte aux droits sur la marque :
a) les violations de l’article 9;
b) l’usage, sans le consentement du titulaire de la marque, d’une marque identique ou semblable au point de prêter à confusion;
c) la vente, la distribution, l’utilisation à des fins commerciales ou l’importation de produits portant une marque dont on sait, ou dont on est censé savoir, qu’elle constitue une imitation frauduleuse, ou la détention de ces produits à ces fins;
d) le transfert à des tiers, ou l’extension, de droits acquis en vertu d’un contrat de licence;
e) le fait de participer ou de prêter son concours aux actes visés aux sous-alinéas a), b) et c) ci-dessus, ou de fournir toute forme d’incitation ou d’encouragement à effectuer ces actes;
f) le fait, pour une personne trouvée en possession d’un produit portant la marque enregistrée ou une marque semblable à celle-ci au point de prêter à confusion, de ne pas révéler le lieu où elle a obtenu le produit et la façon dont elle l’a obtenu.
61A. — a) Est puni d’un emprisonnement d’un à deux ans et d’une amende de 300 à 600 millions de livres quiconque se rend coupable de fausses déclarations quant à l’identité véritable du titulaire des droits sur la marque, retire sans y être autorisé la mention de réserve des droits de marque régulièrement apposée sur un produit ou sur son emballage ou se fait passer pour le titulaire des droits sur la demande d’enregistrement de marque ou sur la marque.
b) Est puni d’un emprisonnement de deux à trois ans et d’une amende de 600 millions à un milliard de livres quiconque, sans y être autorisé, transfère la marque, l’utilise à titre de sûreté ou accomplit tout acte en vue d’exercer les droits de transfert, d’utilisation à titre de
sûreté, de saisie ou tout autre droit prévu aux articles correspondants ou détenu en vertu d’une licence; appose des signes sur un produit ou sur l’emballage d’un produit fabriqué ou mis en vente par lui-même ou par des tiers ou les utilise sur des papiers commerciaux ou des publicités de façon à suggérer une association avec des marques légalement protégées; ou utilise dans le même but un texte ou des signes ou expressions dans les médias écrits et audiovisuels sans être le titulaire légitime de la marque, ou effectue l’un des actes susmentionnés après l’expiration de la période de protection ou après l’annulation ou l’extinction des droits sur la marque.
c) Est puni d’un emprisonnement de deux à quatre ans et d’une amende de 600 millions à un milliard de livres quiconque se rend coupable de l’une des infractions énumérées à l’article 61; le tribunal ordonnera en outre la fermeture des locaux de l’entreprise concernée pour une période d’au moins une année, pendant laquelle il sera aussi interdit au contrevenant d’exercer toute activité commerciale.
Lorsqu’une des infractions susmentionnées est le fait d’une personne employée dans l’entreprise, que cette personne ait agi de sa propre initiative ou en exécution d’instructions reçues dans l’exercice de ses fonctions, les salariés et le propriétaire ou le gérant, ou leur représentant, ou encore la personne qui, à un titre quelconque, est le gérant de fait de l’entreprise, qui n’ont pas empêché l’infraction, encourent les mêmes peines. Lorsqu’une infraction mentionnée à l’article 61 est commise dans le cadre d’un travail réalisé pour le compte d’une personne morale, celle-ci peut être tenue au paiement des amendes, frais et dommages-intérêts en lieu et place des contrevenants. Selon la nature de l’infraction, les actes de complicité tombent sous le coup des dispositions des articles 64, 65, 66 ou 67 du Code pénal turc. Les infractions susmentionnées sont poursuivies sur plainte.
L’alinéa 1.8) de l’article 344 du Code de procédure pénale no 1412 n’est pas applicable aux fins du présent article. Peuvent déposer plainte les personnes dont les droits sur la marque ont été violés, ainsi que l’institut pour toutes les infractions à l’exception de celles prévues à l’article 61; peuvent également déposer plainte les associations de consommateurs et les établissements régis par la loi no 5590 ou 507 dans les cas suivants : fausses déclarations quant à la véritable identité du titulaire des droits sur la marque; apposition de signes sur un produit ou sur l’emballage d’un produit par la personne qui le fabrique et le met en vente ou par des tiers, ou sur les papiers commerciaux ou les publicités de façon à suggérer une association avec une marque protégée; utilisation, aux mêmes fins, de texte, de signes ou d’expressions dans des publicités paraissant dans les médias écrits et audiovisuels par une personne qui n’est pas le titulaire légitime de la marque; actes effectués après l’expiration de la période de protection ou après l’annulation ou l’extinction des droits sur la marque.
Les poursuites doivent être engagées dans un délai de deux ans à compter du jour où l’infraction et l’identité du contrevenant sont connues. Les plaintes déposées pour des actes visés par la présente disposition sont examinées en procédure d’urgence. Les dispositions de l’article 36 du Code pénal turc et les articles pertinents du Code de procédure pénale s’appliquent à la saisie, à la confiscation ou à la destruction des produits attentatoires aux droits découlant de la demande d’enregistrement de marque ou de la marque protégée conformément au présent décret-loi, ainsi que des équipements et machines utilisés pour les fabriquer.
Action du titulaire de la marque
62. Le titulaire d’une marque dont les droits ont été violés peut notamment demander au tribunal :
a) de faire cesser les actes portant atteinte à ses droits;
b) d’appliquer des sanctions et d’ordonner l’indemnisation du préjudice subi;
c) d’ordonner la confiscation des produits attentatoires aux droits sur la marque ainsi que des équipements et machines utilisés pour les fabriquer, cette fabrication et cette utilisation constituant une infraction;
d) de lui attribuer la propriété des produits confisqués en vertu des dispositions du sous- alinéa c) ci-dessus, auquel cas la valeur des produits est déduite de l’indemnité accordée; lorsque la valeur des produits est jugée supérieure à l’indemnité accordée, le titulaire de la marque doit restituer la différence au contrevenant;
e) de prendre des mesures visant à empêcher la poursuite de l’infraction, de faire enlever la marque apposée sur les produits et les véhicules ou, si cela est indispensable pour prévenir les infractions, de faire détruire les produits et véhicules confisqués notamment en vertu du sous-alinéa c) ci-dessus;
f) d’ordonner la publication du jugement et sa notification aux parties intéressées, aux frais du contrevenant.
Tribunaux compétents
63. Le tribunal compétent pour connaître des actions civiles intentées par le titulaire de la marque contre des tiers est celui du domicile du demandeur, du lieu où l’infraction a été commise ou du lieu où elle a produit des effets.
Lorsque le demandeur n’est pas citoyen de la République turque, le tribunal compétent est celui du domicile de l’agent inscrit au registre ou, si son inscription a été radiée, celui du siège de l’institut.
Le tribunal compétent pour connaître des actions intentées par des tiers contre le titulaire de la marque est celui du domicile du défendeur. Si le déposant ou le titulaire des droits sur la marque n’est pas domicilié en Turquie, les dispositions du deuxième alinéa ci- dessus s’appliquent.
Lorsque plusieurs tribunaux sont habilités à connaître du litige, le tribunal compétent est celui qui est saisi en premier.
Réparation
64. Quiconque, sans le consentement du titulaire de la marque, fabrique, vend, distribue ou utilise à des fins commerciales, ou importe ou détient à ces fins un produit imitant frauduleusement la marque est tenu de mettre fin à la violation et de réparer le préjudice qu’il a causé.
Quiconque utilise une imitation frauduleuse de la marque après avoir été informé de l’infraction par le titulaire de la marque et requis de cesser ses agissements ou toute autre utilisation abusive est tenu de réparer le préjudice qu’il a causé.
Documents prouvant l’infraction
65. Le titulaire de la marque peut, en vue d’évaluer le préjudice causé par l’infraction, exiger du contrevenant les documents se rapportant à l’usage de la marque fait sans son consentement.
Perte de gains
66. Le préjudice subi par le titulaire en raison de l’atteinte portée aux droits sur la marque comprend non seulement la perte effectivement subie, mais également le manque à gagner.
Le manque à gagner est défini de l’une des manières ci-après, au choix du titulaire victime du préjudice :
a) gain que le titulaire aurait pu réaliser s’il n’avait pas subi la concurrence du contrevenant;
b) gain effectivement réalisé par le contrevenant en utilisant la marque;
c) redevance que le contrevenant aurait payée s’il avait utilisé la marque en vertu d’un contrat de licence. Le calcul du manque à gagner doit tenir compte notamment de la valeur économique de la marque, du temps qui restait à courir de la durée de protection, du type et du nombre des licences restantes et de facteurs similaires.
Relèvement du montant du manque à gagner
67. Si le tribunal estime que la marque contribue de façon substantielle à la valeur économique du produit, il peut ajouter une somme raisonnable au montant calculé par le titulaire de la marque selon l’une des méthodes énumérées aux sous-alinéas a), b) et c) de l’article 66.
Pour apprécier dans quelle mesure la marque contribue à la valeur économique du produit, on examine l’incidence de la marque sur la demande de celui-ci.
Réputation de la marque
68. Le titulaire de la marque peut demander des dommages-intérêts supplémentaires si le fait que le contrevenant a utilisé indûment la marque a nui à la réputation de celle-ci.
Personnes ne pouvant être poursuivies en justice
69. Le titulaire de la marque ne peut poursuivre en vertu de la présente partie du décret- loi les personnes qui ont utilisé des produits mis sur le marché par une personne dont il a reçu des dommages-intérêts. La présente disposition ne s’applique pas en cas de mauvaise foi manifeste.
Délais
70. Les dispositions du Code des obligations contractuelles relatives aux délais s’appliquent aux délais d’action en cas d’atteinte aux droits attachés à la marque.
Tribunaux compétents
71. Les tribunaux spéciaux qui seront établis par le Ministère de la justice seront compétents pour toutes les actions et contestations prévues dans le présent décret-loi.
Le Haut Conseil des magistrats du siège et du parquet désignera les tribunaux spéciaux parmi les tribunaux commerciaux du premier degré et les tribunaux répressifs du premier degré, et il définira la compétence de chacun sur requête du Ministère de la justice.
Les tribunaux spéciaux visés à l’alinéa précédent connaîtront des actions intentées contre les décisions de l’institut en vertu du présent décret-loi et des actions intentées contre l’institut par les tiers auxquels les décisions de ce dernier font grief.
Publication des décisions judiciaires
72. Lorsque la décision de justice a acquis force de chose jugée, la partie qui a obtenu gain de cause peut demander la publication du jugement définitif, intégrale ou sous forme condensée, dans un journal quotidien, à la radio ou à la télévision ou par tout autre moyen de communication, aux frais de la partie adverse.
Le jugement précise la forme et la teneur de l’avis publié. Si le droit de publication n’est pas exercé dans un délai de trois mois à compter du moment où la décision a acquis force de chose jugée, il devient caduc.
Action du preneur de licence
73. Sauf clause contraire du contrat de licence, le titulaire d’une licence exclusive peut, en cas d’atteinte aux droits attachés à la marque, intenter en son nom propre toutes les actions en justice ouvertes au titulaire de la marque en vertu du présent décret-loi. Ce droit ne s’étend pas aux titulaires de licences non exclusives.
En cas d’atteinte à la marque, le titulaire d’une licence non exclusive peut, par l’intermédiaire d’un officier ministériel, mettre le titulaire de la marque en demeure d’engager les poursuites nécessaires.
Si le titulaire de la marque s’y refuse ou s’il néglige de le faire dans un délai de trois mois à compter de la mise en demeure, le titulaire de la licence non exclusive peut engager lui-même l’action.
En cas de préjudice grave appelé à durer, le preneur de licence peut demander au tribunal de délivrer une injonction de ne pas faire. Le preneur de licence qui a engagé des poursuites en vertu du troisième alinéa ci-dessus doit en aviser le titulaire de la marque.
Requête en déclaration d’absence d’atteinte aux droits
74. Toute partie intéressée peut intenter une action contre le titulaire de la marque pour faire constater qu’elle n’a pas porté atteinte aux droits de ce dernier.
Avant que ne soient engagées les poursuites prévues à l’alinéa précédent, le titulaire de la marque en est avisé par l’intermédiaire d’un officier ministériel afin que le titulaire des droits sur la marque puisse faire part de ses observations sur le point de savoir si la marque destinée aux produits qui sont ou vont être fabriqués en Turquie par le requérant porte atteinte à ces droits.
Si le titulaire de la marque ne répond pas dans le mois qui suit la réception de l’avis, ou si la réponse ne satisfait pas le requérant, celui-ci peut engager des poursuites en vertu du premier alinéa ci-dessus.
Les personnes à l’encontre de qui ont été engagées des actions pour atteinte aux droits de marques ne peuvent engager les poursuites prévues au premier alinéa.
L’engagement des poursuites doit être notifié à tous les titulaires de droits inscrits au registre.
Les actions visées au présent article peuvent aussi être intentées conjointement avec l’action en annulation.
Requête en établissement de preuve
75. Toute personne ayant qualité pour agir en justice en vertu du présent décret-loi peut s’adresser au tribunal pour faire établir et conserver la preuve d’actes constituant une atteinte à la marque.
Mesures conservatoires
76. Toute personne ayant qualité pour agir en justice en vertu du présent décret-loi peut demander au tribunal d’ordonner des mesures conservatoires, si elle peut prouver l’existence d’actes d’usage effectif de la marque ou de préparatifs sérieux en vue d’un tel usage susceptibles de constituer une atteinte aux droits.
La requête en mesures conservatoires peut être déposée avant ou après l’engagement des poursuites ou en même temps; elle est examinée séparément.
Nature des mesures conservatoires
77. Les mesures conservatoires doivent être de nature à permettre au tribunal de statuer; elles visent en particulier :
a) à faire cesser les actes portant atteinte aux droits que le demandeur détient sur la marque;
b) à faire saisir sur le territoire de la Turquie, y compris en douane ou dans les ports francs ou les zones de libre-échange, et à faire placer sous main de justice les produits fabriqués sur place ou importés constitutifs d’une atteinte aux droits attachés à la marque;
c) à constituer des sûretés pour garantir un éventuel préjudice.
Code de procédure civile
78. Les dispositions du Code de procédure civile s’appliquent aux autres actions et mesures conservatoires.
Saisie en douane
79. Les services douaniers doivent retenir à titre conservatoire, à l’exportation ou à l’importation, les produits qui portent atteinte aux droits attachés à la marque.
Les procédures applicables en la matière seront édictées par voie législative.
La saisie effectuée par les services douaniers cesse de produire effet si une action n’est pas intentée devant le tribunal spécial ou si celui-ci ne délivre pas une injonction de ne pas faire dans les 10 jours qui suivent la saisie.
PARTIE IX REPRÉSENTATION ET AGENTS
Représentation devant l’institut
80. Seules peuvent agir devant l’institut, en matière de marques, les personnes suivantes :
a) les personnes physiques ou morales qui ont déposé une demande; les personnes morales ne peuvent être représentées que par les personnes dûment autorisées à le faire par leurs organes compétents;
b) les agents de marques.
Les personnes domiciliées à l’étranger ne peuvent être représentées que par des agents de marques.
Lorsqu’un agent est désigné, il effectue tous les actes de la procédure. Toutes les notifications qui lui sont faites sont réputées avoir été faites à son mandant.
PARTIE X PAIEMENT DES TAXES ET EFFETS JURIDIQUES
Modalités de paiement et effets
81. Les taxes prescrites par le règlement d’application pour le dépôt d’une demande et pour une marque enregistrée doivent être acquittées par le déposant, par le titulaire de la marque ou par l’agent de marques.
Lorsque les taxes prescrites pour l’enregistrement de la marque n’ont pas été acquittées dans le délai prévu dans le présent décret-loi, la demande d’enregistrement de la marque est réputée retirée.
PARTIE XI DISPOSITIONS FINALES
Dispositions abrogées
82. La loi sur les marques no 551 du 3 mars 1995 est abrogée.
DISPOSITIONS TRANSITOIRES
1re. Les dispositions législatives qui étaient en vigueur à la date de la demande s’appliquent aux demandes d’enregistrement de marque déposées avant l’entrée en vigueur du présent décret-loi.
Sans préjudice des actes de transfert ou de succession et des contrats de licence conclus et enregistrés avant l’entrée en vigueur du présent décret-loi, les dispositions de ce dernier s’appliquent à toute nouvelle action ou modification en la matière.
2. Quiconque a utilisé effectivement ses marques de services peut en demander l’enregistrement en déposant la preuve de cette utilisation dans un délai de 12 mois à compter de l’entrée en vigueur du présent décret-loi.
L’institut examine les demandes d’enregistrement déposées par les utilisateurs de marques de services à l’expiration d’un délai de 12 mois à compter du jour de la première utilisation.
3. Aux fins du présent décret-loi, et jusqu’à ce que les tribunaux spéciaux soient institués, le Haut Conseil des magistrats du siège et du parquet choisit, sur requête du Ministère de la justice, parmi les tribunaux commerciaux du premier degré et les tribunaux répressifs du premier degré ceux qui seront désignés comme tribunaux spéciaux, et il définit la compétence de chacun.
Entrée en vigueur
83. Le présent décret-loi entrera en vigueur le jour de sa publication.
Exécution
84. Le présent décret-loi sera exécuté par le Conseil des ministres.
