PATENTS

The Patents Act 1977 (Commencement No. 2) Order 1978

Made - - - - 17th April 1978

The Secretary of State, in exercise of the powers conferred on him by section 132(5) of the Patents Act 1977, hereby orders as follows:—

1. This Order may be cited as the Patents Act 1977 (Commencement No. 2) Order 1978.

2. Sections 1 to 52, 53 (except subsection (1)), 54 to 59, 60 (except subsection (4)), 61 to 76, 77 (except subsections (6), (7) and (9)), 78 (except subsections (7) and (8)), 79 to 83, 89 to 113, 115 to 129, 131, 132 (except subsection (5)) of, and Schedules 1 to 5 and Schedule 6 (insofar as it is not already in force) to, the Patents Act 1977 shall come into operation on 1st June 1978.

EXPLANATORY NOTE

This Order appoints 1st June 1978 as the day for the coming into operation of all of the provisions of the Patents Act 1977 other than—

(a) sections 77(6), (7) and (9) and 78(7) and (8) which came into operation upon enactment by virtue of section 132(5);

(b) sections 84, 85, 114 and 130 (which were brought into operation on 31st December 1977 by the Patents Act 1977 (Commencement No. 1) Order 1977, which

also effected the repeal on that date of section 88 of the Patents Act 1949); and (c) sections 53(1), 60(4) and 86 to 88 (which relate to Community patents).
