There is currently an urgent need to provide Cape Verdean artists, creators, enterprises

and other economic agents with solid foundations in terms of intellectual property, in

order to allow them to reach the level of innovation, quality and competitiveness required

in the context of global economic development.

Despite the country having entered a phase of accelerated development, ways of “doing

business” which are not compatible with a globalized economy continue to flourish and

even to be encouraged in Cape Verde.

On this basis, it is vital that a body be established to regulate intellectual property issues,

thus increasing efficiency, productivity and competitiveness, both with regard to

industrial property and copyright and related rights. Such a move would, at the same

time, facilitate greater discipline and the improved regulation of the intellectual sector,

providing it with momentum and making it more competitive.

Therefore, the establishment of such a body being in the public interest;

Pursuant to Article 281 of the Industrial Property Code, approved by Legislative­Decree

No. 4/2007, of August 20, and to Article 24 of the Law on Copyright, approved by

Legislative Decree No. 1/2009, of April 27;

Under the terms of Law No. 96/V/99, Article 6 (1), of March 22; and

By the power conferred by Article 265 (2) of the Constitution, the Government hereby

approves the following Regulation:

Article 1

Establishment

The Institute for Intellectual Property of Cape Verde (IPICV), the Statutes of which are

approved by Regulatory­Decree, shall be established, with its head office in the City of

Praia.

Article 2

Supervision

The Ministers for Industry and Culture shall supervise the functioning of IPICV.

Article 3

Entry into force

The present Regulation shall enter into force on the same date as the Regulatory Decree

approving the Statutes of IPICV.
