Regulation Concerning the Scope and Extent of the Provisional Act Relating to Photocopying, etc. of Protected Works for Use in Educational Activities

(Laid down by Royal Decree No. 297 of February 15, 1985, in pursuance of Provisional Act No. 40 of June 8, 1979)*

§ 1. Provisional Act No. 40 of June 8, 1979, relating to Photocopying, etc. of Protected Works for Use in Educational Activities shall apply to:

(a) works and photographic pictures created by a Norwegian citizen or by any person resident in the Kingdom of Norway;

(b) works and photographic pictures first published in the realm or published simultaneously here and in another country, simultaneous publication being considered to have taken place when the work or picture is published in the realm within 30 days of the initial publication;

(c) works and photographic pictures of right holders whose names are stated in the Royal Decree of April 10, 1964, relating to the implementation of the international property rights conventions, with amendments of August 31, 1973. The agreement mentioned in § 1 of the Act shall not be a hindrance to such right holders being entitled to claim individual compensation. Such claim must be addressed to the organization which is a party to the agreement and must be submitted within three years of the end of the calendar year in which the photocopying, etc. was made. If necessary, the compensation may be determined according to rules issued in pursuance of the Act relating to Property Rights in Literary, Scientific or Artistic Works, § 51;

(d) the provisions in 1(a) and 1(b) correspondingly apply to works which are protected under the Act relating to Property Rights in Literary, Scientific or Artistic Works, § 43.

§ 2. This Regulation comes into force immediately. From the same date Regulations prescribed by the Royal Decree of December 14, 1979, concerning the scope and extent of the Provisional Act relating to Photocopying, etc. of Protected Works for Use in Educational Activities are repealed.
