The Constitution of the Republic of Azerbaijan was adopted on November 12, 1995 by popular referendum and entered into force on November 27, 1995. The Constitution was amended two times, in 2002 and 2009.
The Constitution is the supreme law of the country and has direct application on the whole territory of Azerbaijan (Article 147). The Constitution proclaims the establishment of a democratic, legal, secular and unitary State, where the state power is based on the principle of separation of powers (Article 7). As the fundamental law of the State, the Constitution defines the structure of the government, basic rights, liberties and responsibilities of its citizens, as well as the powers of the legislative, executive and judicial branches.
Milli Majlis (the parliament) adopts constitutional laws, laws and decrees, while the President and the Cabinet of Ministers (the highest body of the executive branch) adopt decrees and orders.
The Constitution contains specific provisions regarding intellectual property rights in Article 30, where it proclaims the right of every person for intellectual property, Article 51, where it proclaims the right of every person to carry out literary-artistic, scientific-technical and other kinds of creative activity, and Article 23, on the symbols of the Azerbaijani State (State Flag, State Emblem and State Hymn).
The Constitution also contains provisions on property rights (Article 13 and 29) and on economic development and competition (Article 15).
