Year of Version 2001 Dates Adopted: December 6, 1995 Type of Text IP-related Laws Subject Matter Patents (Inventions), Trademarks, Plant Variety Protection, Enforcement of IP and Related Laws, Alternative Dispute Resolution (ADR), IP Regulatory Body Notes This consolidated version of the Seed Industry Act incorporates all amendments since 1996 up to 2001.

In the Republic of Korea, new varieties of plants are entitled to protection under the Seed Industry Act and Patent Act.
The Seed Industry Act contains specific provisions on the protection of plant varieties. Part II of the law governs the protection of the plant breeder’s rights. Part III regulates the variety denominations, and Part IX refers to the penal provisions on infringements of plant variety rights.
In particular, the law provides the provisions that specify its relationship with the Patent Act (see Sections 7(i), 10, 48, 86(2), 99(2), 100, 105, 107, 168, 170(1), 176(2)(v) & (2)(vi)).
