Year of Version 2006 Dates Promulgated: November 9, 2005 Type of Text IP-related Laws Subject Matter Enforcement of IP and Related Laws Notes The Penal Law No. 12/NA of November 9, 2005 (promulgated by the Decree of the President of the Lao People's Democratic Republic No. 142/PO of November 9, 2005) repealed the Penal Law No. 29/SPA of December 23, 1989 (promulgated by the Decree of the President of the Lao People's Democratic Republic No. 04/PO of January 9, 1990, and amended by the Decree No. 51/PO of April 25, 2001). The Penal Law No. 12/NA entered into force on March 10, 2006, 120 days after the date of the promulgation of the Decree of the President of the Lao People's Democratic Republic No. 142/PO on November 9, 2005; except for Article 7 of the General Part and the Special Part of this Law, which entered into force on May 10, 2006, 180 days from the date of the promulgation of the said Decree. The Penal Law is applied to judicial procedures for the property protection, which allows for the expropriation of all illegal goods from a guilty individual and for the levying of fines of up to three times the value of each item. For provisions relating to the protection of the property rights, see: - General Part: Chapter 1, Article 1 (safeguarding of property of the State, collectives and individuals); Chapter 2, Article 6 (offense to the property of the State, collectives and individuals); Chapter 5, Articles 28 (2-3), 35 (confiscation of items and property) - Special Part: Chapter 1, Article 81 (unlawful production and possession of radio communication equipment); Chapter 4 'Offenses against State and Collective property', Article 112 (destruction of artifacts or architecture of artistic value), Article 115 (unlawful possession of State or collective property), Article 116 (concealment and unlawful trade of State or collective property); Chapter 5 'Offenses against personal property', Article 123 (unlawful possession of property), Article 124 (concealment and unlawful trade of citizens' property).
