This reform broadens the concept of trademark to encompass 'any sign that is perceptible by the senses and capable of being represented in a way that enables the clear and precise subject matter of the protection to be determined'. In addition, it will allow for the registration of olfactory and sound marks.

Certification marks are recognized. Also included is the option to protect geographical indications as certification marks.

Finally, where the registration of trademarks is concerned, the requirement to indicate nationality is removed.'

This Decree enters into force on August 10, 2018, sixty business days after its publication in the Official Gazette of the Federation on May 18, 2018, in accordance with its First Section under the Transitional Provisions.
