Notes
The Civil Procedure Rules 1998 make provisions for a new code of civil procedure for civil courts and Part 49 'Specialist Proceedings' paragraph 2 (d) stipulates that these Rules apply to proceedings in 'Patents Court business (as defined by the relevant practice direction) and proceedings under—
(i)the Copyright, Designs and Patents Act 1988(1);
(ii)the Trade Marks Act 1994(2); and
(iii)the Olympic Symbol etc Protection Act 1995(3) and Olympics Association Right (Infringement Proceedings) Regulations 1995(4);'.
Rule 17 'Appeal against order for revocation of patent' to these Rules sets out the procedure for an appleal to the Court of Appel from an order for the revocation of a patent. Rule 18 'Appel from Patent Court on appeal from Comptroller' makes proivisions on the proceedings relating to an appeal from a decision of the Comptroller- General of Patents, Designs and Trade Marks.
