The notification by Ecuador to the WTO under article 63.2 of TRIPS states:
'The purpose of the Law is to avoid, prevent, remedy, eliminate and punish any abuse by economic operators with market power; to prevent, prohibit and punish collusive arrangements and other restrictive practices; to control and regulate economic mergers; and to prevent, prohibit and punish unfair practices, with a view to market efficiency, fair trade and the general well-being of consumers and users, so as to establish a mutually supportive and sustainable socio-economic system.'
Article 9(17) of Section 2 and Articles 26 and 27(3) & (7) of Section 5 under Chapter II of this Law contains provisions on protection against unfair practices and acts related to intellectual property; and provisions on trade secrets violation.
This Law also introduces the amendments to Article 155, Articles 280, 339 and 346; and repeals Articles 183-193 and 284-287 of the Intellectual Property Law of December 28, 2006 (see the Fourth, the Twelve, the Thirteen and Fourteenth Provisions under the 'Amending and Repealing Provisions' of the Law).
