Notes
The notification by Switzerland to the WTO under Article 63.2 of TRIPS states:
'Art. 14.2 and 15.3(c): protection of the first applicant pursuant to Art. 39.3 of the TRIPS Agreement: Use may be made by a second applicant only: with the authorization of the first applicant; for ten years as of the first authorization for the most recent active ingredient in the phytosanitary product; for five years, in relation to data relating to fresh discoveries about the active ingredient or for data furnished at the request of the authorities to address information gaps.'
