Year of Version 2014 Dates Entry into force: October 10, 2009 Adopted: September 18, 2009 Type of Text IP-related Laws Subject Matter Patents (Inventions), Trade Names, Undisclosed Information (Trade Secrets), Genetic Resources Notes This consolidated version of the Code incorporates amendments up to Law of the Republic of Kazakhstan No. 159-V of January 13, 2014, which came into force on January 26, 2014 (see General Part, Section1, Chapter 2, Article 7 of the consolidated version for the amendments).

The consolidated Code (i) regulates the production and sale of patent medicines (Special Part, Section 4, Chapter 13, Article 67(6)); (ii) provides for the legal protection of patented drugs and the rights of developers of drug products, medical devices and medical equipment (General Part, Section 1, Articles 1(1)(86); and Special Part, Section 4, Chapter 14, Article 70(2)); (iii) determines information requirements for registering a drug trade name in the State register of drugs, medical devices and medical equipment (Chapter 14, Article 71(4)(1), (5))); and (iv) allows the National Healthcare Holding to request disclosure of information, including commercial secrets from state bodies (General Part, Section 1, Chapter 2, Article 11(2)).
