Patents Decree
No. 669 of September 26, 1980, as amended by Decrees No. 505/85, No. 583/92, No. 71/94, No. 595/94, No. 104/96 and No. 246/97.
Patent Application and Record of Applications
Section 1
Finnish patent applications shall be filed with the National Board of Patents and Registration of Finland (the Patent Office).
International applications designating Finland shall be filed with an authority or international organization that is a receiving Office authorized under the Patent Cooperation Treaty done at Washington on June 19, 1970, and its Regulations. Sections 45 to 51 contain provisions on the Patent Office acting as a receiving Office.
The provisions in this Decree concerning patent applications shall only apply, unless otherwise specified, to:
- (1)
- Finnish patent applications;
- (2)
- international patent applications pursued in Finland under Section 31 of the Patents Act or accepted for examination under Section 38 of that Act; and
- (3)
- European patent applications converted into national applications under Section 70 s of the Patent Act. (15.2.1996/104) Section 2 Finnish patent applications shall contain an application document and accompanying documents. The application document shall be signed by the applicant or his representative and shall state:
- (1)
- the name, domicile and address of the applicant and, if the applicant has appointed a representative, the name, domicile and address of the representative;
- (2)
- the name and address of the inventor;
- (3)
- a concise and factual title for the invention to which the application relates;
- (4)
- where a patent is applied for by several persons jointly, a statement as to whether one of such persons is entitled to receive communications from the Patent Office on behalf of all applicants; (14.6.1985/505)
(4a) a statement, where appropriate, that the application includes the deposit of a culture of a microorganism under Section 8a of the Patents Act; (14.6.1985/505) and

- (5)
- a list of the documents accompanying the application document. The following documents shall accompany the application document:
- (1)
- a description of the invention together with the drawings, if any, needed to understand the invention, claims and an abstract;
- (2)
- if the applicant has appointed a representative, a separate power of attorney for the representative if the representative has not been given authorization in the application document; and
- (3)
- if the invention has been made by someone other than the applicant, a deed establishing the applicant’s title to the invention.
The prescribed application fee shall be paid when filing an application.
Section 3
If the document is not written in one of the languages laid down by the fifth paragraph of Section 8 of the Patents Act, the applicant shall also submit to the Patent Office a translation of the document into Finnish or Swedish. For a document other than a description, an abstract or claims or for the text of the description or claims of a Finnish application not included in the basic documents under the first paragraph of Section 21 , the Patent Office may waive the requirement for a translation or may accept a translation into a language other than Finnish or Swedish.
The Patent Office may take up an application for processing before a translation thereof into one of the languages laid down by the first paragraph has been submitted. The translation has to be submitted before the application under Section 22 of the Patents Act becomes available to the public. The Patent Office shall specify the prerequisites under which the application is taken up for processing before the translation has been submitted. (21.3.1997/246)
Section 4
The description, abstract and claims shall be in black type or black print on white paper, size A4 (210 mm × 297 mm).
Drawings shall be executed in dark, preferably black, lines on a light, preferably white, background on durable material, size A4.
The description, with accompanying drawings, if any, and the claims and abstract shall be submitted in a form suitable for printing.
Regulations on further requirements concerning the form of the documents and the number of copies to be filed with the Patent Office by the applicant shall be given by the Patent Office.
Section 5
To obtain a novelty search as referred to in Section 9 of the Patents Act, the applicant shall make a

written request within three months of the filing date of the application or, where applicable, of the
�
date on which it is deemed to have been filed, to the Patent Office and shall pay the fee prescribed

by the Searching Authority. Where the application is not drawn up in a language acceptable to the Searching Authority, the request shall be accompanied by a translation of the application into a language prescribed by the Patent Office.
If the search referred to in the first paragraph can be carried out by more than one authority and if the applicant wishes to specify which of such authorities is to carry out the search, he shall name that authority in his request.
The request shall be deemed withdrawn if, on expiration of the time limit laid down in the first paragraph, the application and the translation do not satisfy the formal requirements for an international application.
Section 6
The Patent Office shall enter on the application the date on which it was received at the Patent Office.
Section 7
The Patent Office shall keep a record of patent applications filed. The record shall be accessible to the public.
The following particulars shall be entered in the record for each application:
- (1)
- the serial number in the record of the application and the classes in which the application has been classified;
- (2)
- the name of the examiner processing the application;
- (3)
- the name, domicile and address of the applicant;
- (4)
- if the applicant has appointed a representative, the name, domicile and address of the representative;
- (5)
- the name and address of the inventor,
- (6)
- the title of the invention;
- (7)
- a statement as to whether the application is a Finnish patent application, an international patent application or a European patent application which has been converted into a national application; (15.2.1996/104)
- (8)
- if the application is a Finnish patent application, the filing date and the effective date where different from the filing date;
- (9)
- if the application is an international patent application, the international filing date and the date on which the application was pursued under Section 31 of the Patents Act or was filed under Section 38 of that Act;

(9a) if the application has been converted from a European patent application into a national application, the filing date in accordance with the European Patent Convention (Finnish Treaty Series 8/96) and the date on which the application was received by the Patent Office for conversion; (15.2.1996/104)
- (10)
- if the priority of an earlier application is claimed, the country where the earlier application given as the basis for the priority was filed, the filing date of that application and its serial number;
- (11)
- if the application results from division or separation, the serial number of the parent application;
- (12)
- if a new application results from the division or separation of the application, the serial number of the application that has been divided or separated out;
- (13)
- if the application has been made available to the public under the third paragraph of Section 22 of the Patents Act, the date on which it became available;
- (14)
- where the application is an international application, the international application number; (14a) if the application has been converted from a European patent application into a national application, the application number of the European patent application; (15.2.1996/104)
- (15)
- the documents filed and fees paid in respect of the application;
- (16)
- decisions taken in respect of the application.
Section 8
The Patent Office shall prepare a weekly list of patent applications that have been filed. The list shall contain for each application the particulars listed in the second paragraph of Section 7 under items (1) , (3) , (5) to (11) , (14) and (14a) .
The Patent Office shall further prepare a weekly list of international applications designating Finland, on the basis of the information received by the Office from the International Bureau of the World Intellectual Property Organization. The list shall contain, as far as possible, for each application the particulars listed in Article 30(2)(b) of the Patent Cooperation Treaty.
The Patent Office shall further prepare a weekly list of published European patent applications on the basis of the information received by the Office from the European Patent Office. The list shall contain for each application the data listed in Article 128(5) of the European Patent Convention. (15.2.1996/104)
These lists shall be accessible to the public on payment of a prescribed fee. (15.2.1996/104)
Section 9
Where notice is given that an invention for which a patent has been sought has been assigned to another person, the latter person shall be recorded as the applicant in the record of applications only if proof of the assignment is furnished.

Priority

Section 10
To enjoy priority under Section 6 of the Patents Act, the applicant must claim priority in writing within three months of the date on which the application was filed or is deemed to have been filed, simultaneously stating where and when the application given as a basis for the priority was filed and, as soon as possible, its serial number. In the case of an international application, the priority claim shall be made in the application itself, stating the place and date the application given as the basis for priority was filed and, in the case of an international application, at least one country designated in such application. In such case, the serial number of the application given as the basis for priority shall be communicated to the receiving Office for the international application or to the International Bureau of the World Intellectual Property Organization within 16 months from the priority date which is claimed. Where the application is divided under Section 22 , a claim to priority in respect of the parent application shall also apply, without separate request, to the new application resulting from division.
Section 11
An applicant who has claimed priority shall, within 16 months of the date for which priority is claimed, file with the Patent Office a certificate issued by the authority with which the application for which priority is claimed was filed, stating the filing date of the priority application and the applicant’s name, and also a copy of the application certified by that same authority. The copy shall be filed in the form prescribed by the Patent Office. However, for an international application, the certificate shall be filed only after the Patent Office has issued the corresponding official action. For such application the priority document may also be filed in accordance with Rule 17.1 of the Regulations under the Patent Cooperation Treaty with the International Bureau referred to in Section 8 or with the authority that received the application, or a request may be made to such latter authority to forward the priority document to the International Bureau.
The Patent Office may grant an exemption from the obligation to file the certificate and the copy referred to in the first paragraph.
Where a copy of an application that is the basis for the priority of an international application has been filed with the International Bureau referred to in the first paragraph, the Patent Office may only require a copy and a translation of such copy in accordance with Rule 17.2 of the Regulations under the Patent Cooperation Treaty.
Section 12
Priority may only be based on the first application in which the invention was disclosed.
If the person who filed the first application or his successor in title has filed a subsequent application with the same patent authority, relating to the same invention, the subsequent application may be cited as a basis for priority, provided that at the time of filling of the later application the earlier application was withdrawn, dismissed, or rejected without having become available to the public and without there being any rights subsisting, and had not served as a basis

for priority. Where priority has been obtained on the basis of the subsequent application, the prior application may no longer serve as a basis for claiming priority.
Section 13
Priority may also be obtained for a part of an application.
An application may claim priority deriving from several earlier applications even where they relate to different countries.
Claims

Section 14
The claims shall contain:
- (1)
- the title of the invention;
- (2)
- a statement identifying the art in relation to which the invention is new (prior art), where necessary; and
- (3)
-
a statement of the new and characteristic features of the invention.
� Each claim may relate to one invention only.
� Where possible, the invention shall relate to one of the following categories: product, apparatus,
�
process or use.
�
A claim may not contain any matter irrelevant to the invention disclosed therein or irrelevant to the
�
exclusive right claimed by the applicant.
�
Section 15
An application may contain more than one claim. Where the application includes more than one claim, they shall be arranged and numbered consecutively.
A claim may be independent or dependent. A dependent claim is a claim that relates to an embodiment of the invention disclosed in another claim of the application and which, therefore, comprises all the features of that claim. All other claims are independent.
One or more dependent claims may relate to one claim. A dependent claim may refer to several preceding claims. It shall begin with a reference to a preceding claim and shall state the additional features characterizing the invention.
Section 16

(26.6.1992/583) Where an application contains several inventions they shall be interdependent. Inventions shall be deemed to be interdependent, if there is a technical connection between all of them in that the inventions have, in whole or in part, the same or similar special technical characteristics. The term special technical characteristics shall mean the technical characteristics contributed by each single invention going, in considering the invention as a whole, beyond the state of the art.
The question whether the inventions are interdependent shall be determined irrespective of whether they are stated in separate patent claims or as alternatives in a single claim.
Description

Section 17
The description may contain only subject matter that assists in understanding the invention. Where a newly-coined word or a technical term that is not generally accepted has to be used, such term shall be explained. The designations and units of measurement may not depart from those in general use in the Nordic countries.
Where the application includes the deposit of a culture of a microorganism under Section 8a of the Patents Act, the applicant shall, on filing the application, give all relevant information regarding the characteristics of the microorganism that is available to him. (14.6.1985/505)
Section 17a
(14.6.1985/505) Deposits under the first paragraph of Section 8a of the Patents Act shall be made with an institution that is an international depositary authority under the Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure (the Budapest Treaty) done at Budapest on April 28, 1977, or with another depositary authority recognized by the European Patent Office. Deposits shall be made in accordance with the Budapest Treaty.
The Patent Office shall keep a list of the institutions that are international depositary authorities under the Budapest Treaty.
Section 17b
(14.6.1985/505) Where a microorganism has been deposited, the applicant shall inform the Patent Office in writing, within 16 months of the filing date of the application or, where priority is claimed, of the date of the claimed priority, of the institution with which the deposit has been made and the access code given to the deposit by that institution. For international applications, the information may be submitted, within the same time limits, to the International Bureau referred to in the second paragraph of Section 8 . (21.3.1997/246)
Where the applicant requests that the application documents be made available to the public earlier than provided for in the first and second paragraphs of Section 22 of the Patents Act, the

information referred to in the first paragraph shall be submitted, at the latest, together with the request. Where the applicant requests early publication of an international application under Article 21(2)(b) of the Patent Cooperation Treaty, the information shall be submitted, at the latest, together with the request for publication.
If the deposit has been transferred from one international depositary authority to another under Rule
5.1 of the Regulation under the Budapest Treaty, the applicant shall notify the Patent Office of the transfer and of the new access code for the deposit.
The Patent Office may require a copy of the receipt for the deposit issued by the institution as proof of the information referred to in the first and third paragraphs.
Section 17c
(14.6.1985/505) A new deposit as referred to in the second paragraph of Section 8a of the Patents Act shall be made in accordance with the provisions for new deposits under the Budapest Treaty.
The new deposit shall be made within three months of the date the depositor received notification from the international depositary authority that samples of the previous deposit can no longer be furnished. Where the institution has ceased to act as an international depositary authority for the kind of microorganism to which the deposit belonged or if it has ceased to fulfill its obligations under the Budapest Treaty and the depositor has not received notification to such effect within six months of the announcement thereof published by the International Bureau, a new deposit may nevertheless be made within nine months of the said published announcement. As far as other depositary institutions are concerned, the period of time for making the deposit stated above begins once the European Patent Office has published a corresponding announcement of the matter. Within four months of making the new deposit, the depositor shall submit to the Patent Office a copy of the receipt issued for the new deposit by the institution. However, if the time limit laid down in the first or second paragraph of Section 17b expires at a later date, the receipt may be submitted within such later time limit. When submitting the receipt, the number of the application or patent to which the deposit relates shall be stated.
Abstract
(14.6.1985/505)
Section 18
The abstract of a Finnish application shall be based on the description and claims as set out in the documents that constitute the basic documents pursuant to the first paragraph of Section 21 or the first paragraph of Section 24 . The abstract shall contain the title of the invention and shall be drafted with sufficient clarity to disclose the technical problem to which the invention relates, the principles of the solution provided by the invention and the primary field in which the invention is to be used. The final wording of the abstract shall, where possible, be determined before the application is made available to the public under the second paragraph of Section 22 of the Patents Act.

Where an international application or a European patent application converted into a national application contains an abstract confirmed by the International Searching Authority or the European Patent Office, the wording of that abstract shall be accepted. Where this is not the case, the Patent Office shall also confirm the abstract in such application. In the latter case, the provisions of the first paragraph shall be applicable. (15.2.1996/104)
Amendments to Applications
Section 19
Claims may not be amended to include subject matter not disclosed in a document constituting a basic document under the first or second paragraph of Section 21 or the first paragraph of Section 24 . Where a claim is amended to add new features, the applicant shall at the same time state where those new features are to be found in the basic documents.
Once the Patent Office has issued a novelty search report, no claim disclosing an invention that is independent of the invention disclosed in the previous claims may be included in the same application.
For international applications, no novelty search report shall be issued before the period of time laid down in Section 52b has expired, unless the applicant agrees thereto. (14.6.1985/505)
An applicant may make amendments or additions to the description and drawings only where they are necessary according to Section 8 of the Patents Act. Such amendments or additions may not make a claim encompass matter other than that which has a counterpart in the basic documents.
Section 20
Unless otherwise permitted by the Patent Office, amendments or additions to the claims shall be made by filing a new document setting out all the claims in sequence.
Section 21
For the purposes of this Decree, the basic document for a Finnish patent application, a patent application to be taken up for processing under Section 38 of the Patents Act and a European patent application converted into a national application shall be deemed to consist of the Finnish or Swedish language description, with drawings, if any, and the claims contained in the application as filed or as deemed to have been filed. If those documents were not included in the application at that time, the first Finnish or Swedish language description and claims subsequently filed shall be deemed to constitute the basic document if the content of those documents clearly corresponds to the content of the documents held by the Patent Office at that time. The basic document for an international application pursued under Section 31 of the Patents Act shall be deemed to consist of:
(1) where a translation is required to pursue the application, the translation of the description, drawings and claims filed under Section 31 of the Patents Act, including any amendments made before the time limit laid down in Section 52b has expired; or

(2) where the application was drafted in Finnish or Swedish, the copy of the description, drawings and claims filed under Section 31 of the Patents Act. (14.6.1985/505)
If, at the time of filing an application, it is stated that an application for protection of the invention has been filed with a foreign patent authority, a subsequently filed certified copy of the foreign application shall, provided that the filing date and serial number of the foreign application have been indicated, be deemed to have been filed with the Patent Office simultaneously with the filing of the application with the Finnish Patent Office.
Division and Separation
Section 22
(21.3.1997/246) If more than one invention has been disclosed in the basic documents, the applicant may divide the application into more than one application. Division may only be made before a notice under the first paragraph of Section 19 of the Patents Act has been given. In such case, a new application relating to an invention divided from the original application (parent application) shall, at the applicant’s request, be deemed to have been filed at the same time as the parent application. Section 23
If, as a result of an addition to the description or claims, or in some other way, the application has been caused to disclose an invention that was not disclosed in the basic documents, a new application relating to such invention, filed by separation from the original application (parent application), may, at the applicant’s request, be deemed to have been filed on the date when the document disclosing the invention was received by the Patent Office.
Separation may only be made before a notice under the first paragraph of Section 19 of the Patents Act has been given. In an application made by separation, protection can only be claimed for subject matter that was disclosed in the documents of the parent application when the new document was filed. (21.3.1997/246)
Section 24
In the event of division or separation, the description, with accompanying drawings, and claims filed at the same time as the application document of the new application shall be deemed to constitute the basic document.
A new application may be considered to result from division or separation only if this is evident from the application when filed. The serial number of the parent application shall be stated in such divisional or separated application.
Availability to the Public
Section 25

If the documents of a patent application, under the second or third paragraph of Section 22 of the Patents Act, have become available to the public prior to the grant of a patent, the abstract shall be printed as soon as its final wording has been determined. The Patent Office may also decide to print other parts of the application together with the abstract. These documents shall be available to any person on payment of the prescribed fee. The announcement under the fourth paragraph of Section 22 of the Patents Act shall state the serial number and classification of the application, its filing date, the effective date, if different from the filing date, the title of the invention and the name and address of the applicant and of the inventor. Where priority has been claimed, the announcement shall also state where the relevant prior application was filed, together with the filing date and serial number of such prior application. If the application includes the deposit of a culture of a microorganism, this shall be stated in the announcement. If the applicant has requested under the seventh paragraph of Section 22 of the Patents Act that samples of the deposited culture be issued only to a special expert, this fact shall also be stated in the announcement. If the translation of the description or claims in an international application has been amended within the time limit laid down in Section 52b , but after the documents have become available to the public, an announcement shall be published of such amendment. (14.6.1985/505)
Section 25a
(14.6.1985/505) A request made under the first sentence of the eighth paragraph of Section 22 of the Patents Act to obtain a sample of a deposit shall be formulated as prescribed in Rule 11 of the Regulations under the Budapest Treaty.
A person wishing to obtain a sample shall give an undertaking to the applicant or the proprietor of the patent that the sample will not be used for other than experimental purposes and will not be made available to anyone else before a final decision has been given on the application or, if a patent has been granted, before the patent has expired, unless the applicant or the proprietor of the patent explicitly waives this undertaking. The same undertaking as is prescribed with respect to a sample shall also be given with respect to cultures derived from the sample which have retained those characteristics of the deposited culture that are essential for carrying out the invention.
The undertaking shall be attached to the request.
Section 25b
(14.6.1985/505) A request made under the seventh paragraph of Section 22 of the Patents Act that samples shall only be issued to a special expert must be made within 16 months of the filing date of the application or, where priority is claimed, of the claimed priority date.
The Patent Office shall draw up a list of those persons who have stated their willingness to assume assignments as experts and who are suitable for such a task. A decision on the persons chosen for inclusion in the list of experts shall be announced as prescribed in Section 43 .
If a sample may be issued only to a special expert, the request for the sample shall state the person to be called upon as an expert. The request shall be accompanied by a written undertaking from the

expert to the applicant to the effect that the sample will not be used for other than experimental purposes and will not be made available to anyone else before a patent granted on the invention has expired or before 20 years have lapsed from the filing date of the application if a final decision not resulting in the grant of a patent has been taken on the application. This undertaking shall also apply to cultures derived from the sample which have retained those characteristics of the deposited culture that are essential for carrying out the invention. Any person included in the list, or accepted by the applicant in a particular case, may be called upon as an expert.
Section 25c
(14.6.1985/505) Notwithstanding the undertakings required under Sections 25a and 25b of this Decree, a derived culture may be deposited for the purposes of a new patent application if it is necessary to deposit the culture for such purpose.
Section 25d
(14.6.1985/505) If a request has been made for a sample and neither the Patents Act nor this Decree preclude the furnishing of a sample, the Patent Office shall issue a certificate to that effect. The Patent Office shall forward the request for the sample and the certificate to the institution where the deposit is kept. The Patent Office shall at the same time forward to the applicant or the proprietor of the patent a copy of the request and the certificate.
If the Patent Office decides that a certificate as referred to in the first paragraph cannot be issued, it shall give a notice of that decision. The person who has requested the sample may lodge an appeal against such decision with the Board of Appeal of the Patent Office within 60 days of the date on which the decision was communicated to the appellant, not counting the date of communication. There shall be no appeal from the decision of the Board of Appeal. (21.3.1997/246)
Processing of Patent Applications
Section 26
In examining whether the conditions for granting a patent laid down in Section 2 of the Patents Act have been satisfied, the Patent Office shall consider all facts that come to its attention.
The examination at the Patent Office shall be carried out on the basis of patent specifications, published specifications and published applications, or abstracts thereof, from Finland, Norway, Sweden, Denmark, the United States of America, the United Kingdom, France, the Federal Republic of Germany, the former German Reich and the European Patent Office, or on the basis of publicly available international applications or abstracts thereof as well as applications that have become available to the public in Finland. Other available literature may also be examined if found necessary.
The Patent Office shall issue more detailed regulations regarding the conduct of the examination. Where particular circumstances require, such regulations may differ from the provisions of the second paragraph.

Section 26a

(21.3.1997/246) If, during the examination of an application, a communication which is of importance for the examination of the application is filed with the Patent Office, the applicant shall be notified thereof. If the communication does not concern better title to the invention, the Patent Office shall notify the party that submitted the communication of the possibility of lodging an opposition if a patent is granted.
Section 27
Where necessary for the examination of a patent application, the Patent Office may consult experts who are not on the staff of the Patent Office.
Section 28
The Patent Office may call upon an applicant to submit a model, sample or the like, or to carry out investigations or experiments, if necessary in order to evaluate an invention.
Section 29
Anyone who applies for a patent in Finland in respect of an invention for which he has sought a patent from a foreign patent authority shall be required, with the limitations laid down in the third paragraph of Section 74 of the Patents Act, to report what such foreign authority has communicated to him concerning the novelty or patentability examination of the invention. The Patent Office may require him, by official action, to file a copy of such communication or a declaration that no information concerning the examination of the previous application has been received.
If the examination of an application is carried out by a foreign authority in accordance with the second paragraph of Section 74 of the Patents Act, and if the Finnish Patent Office has concluded an agreement with such authority to exchange examination results and other information, the Patent Office may defer examination of an application that corresponds to an application filed previously with such foreign patent authority until the latter application has been processed to the extent provided for in the agreement.
The Patent Office shall be authorized to communicate documents in respect of applications that have not yet become public to a patent authority with which an agreement has been concluded in accordance with the second paragraph, provided that the patent authority concerned has undertake not to make such documents available to the public.
Section 29a
(21.3.1997/246) When the Patent Office considers that a patent may be granted, the Office shall, before giving a notice under the first paragraph of Section 19 of the Patents Act, send the applicant the documents that show the text in which it intends to grant the patent. The Patent Office may in such case under Section 15 of the Patents Act invite the applicant to file his comments or return the documents to the Office within a specified time limit.
Section 30

(21.3.1997/246) The Patent Office shall issue regulations on time limits and extensions of time limits. The grant of a patent may only be deferred, if the grant would take place before the application has become available to the public under Section 22 of the Patents Act, In such case, the grant of a patent may at the applicant’s request be deferred until the time the application becomes available to the public under the above-mentioned Section of the Act.
Grant of a Patent

Section 31
(21.3.1997/246) Printing of a published specification pursuant to Section 21 of the Patents Act shall begin as soon as possible after the applicant has paid the printing fee under the third paragraph of Section 19 of the Patents Act.
The published specification shall state:
- (1)
- the serial number of the application in the record of applications and the registration number of the patent and the classes in which the patent is classified;
- (2)
- the name and address of the proprietor of the patent;
- (3)
- the name, domicile and address of the representative appointed by the applicant, if any;
- (4)
- the name and address of the inventor;
- (5)
- the title of the invention;
- (6)
- whether the patent is based on a Finnish application, an international application or a European patent application which has been converted into a national application;
- (7)
- if the patent is based on a Finnish application, the filing date of the application and the date on which the patent term begins if not identical with the filing date of the application;
- (8)
- if the patent is based on an international application, the international filing date and the date on which the application was pursued under Section 31 of the Patents Act or on which the application under the third paragraph of Section 38 of the same Act is deemed to have been filed, and the number of the international application;
- (9)
- if the patent is based on a European patent application which has been converted into a national application, the filing date under the European Patent Convention and the date the application was received by the Patent Office for conversion, and the application number of the European application;
- (10)
- if priority is claimed, where the earlier application given as a basis for priority has been filed and the filing date and serial number of such application;
- (11)
- if the application results from division or separation, the serial number of the parent application;

- if the application includes the deposit of a culture of a microorganism, an indication of the institution where the deposit is kept and the access code given by the said institute to the deposit;
- (13)
- the date on which the application documents were made available to the public;

Section 32
(21.3.1997/246) The announcement of the grant of a patent shall contain the information that is to be given in the published specification under Section 31 , with the exception of the publications cited.
Opposition
Section 33
(21.3.1997/246) An opposition under Section 24 of the Patents Act shall state the following particulars:
1) the name and address of the opponent;
2) the registration number of the patent against which the opposition is lodged, the name of the proprietor of the patent and the title of the invention;
3) whether the opponent demands that the patent be revoked or that patent protection be restricted to some extent;
4) which of the circumstances stated in the first paragraph of Section 25 of the Patents Act serve as grounds on which the opposition is filed and what other circumstances can be presented as grounds for the opposition; and
5) if the opponent has appointed a representative, the name, domicile and address of the representative.
The opposition and any subsequent communications, together with attachments, from the proprietor of the patent or the opponent shall be filed in the number of copies required by the Patent Office.
Where the opponent has appointed a representative, the representative’s power of attorney shall be filed with the Patent Office.
Section 34
(21.3.1997/246) If the opposition has not been made in the manner prescribed in the first paragraph of Section 24 of the Patents Act, the opposition will not be admitted. Neither will the opposition be admitted if the patent against which the opposition is filed is not identified in the documents submitted to the Patent Office within the time limit reserved for lodging an opposition, or if it

cannot be established who filed the opposition, or if the particulars stated in item 4 of the first paragraph of Section 33 are not given in the documents.
If other provisions concerning oppositions are not complied with on lodging an opposition, the Patent Office shall invite the opponent to correct the defects within a prescribed time limit. Failure to do so in the prescribed time limit shall result in the opposition being rejected as inadmissible.
Section 35
(21.3.1997/246) Copies of all communications filed by the opponent shall be transmitted to the proprietor of the patent.
If the proprietor of the patent files a counterstatement in respect of the opposition, the Patent Office shall decide on the need for a further exchange of communications.

(21.3.1997/246) The Patent Office shall issue more specific regulations on applications and oppositions and their processing.
Patent Register
Section 37a
(15.2.1996/104) The Patent Register shall contain information on patents granted by the Patent Office and on European patents having legal effect in Finland.
Section 38
(21.3.1997/246) Once a patent has been granted in Finland, it shall be recorded in the Patent Register. In that connection, the particulars that under Section 31 shall be indicated in the patent specification, with the exception of the publications cited, shall be recorded in the Patent Register.
Section 38a
(15.2.1996/104) A European patent shall be recorded in the Register once the European Patent Office has published an announcement of the grant of the patent and the applicant has filed a translation and paid a fee pursuant to the first paragraph of Section 70h of the Patents Act.
The following particulars shall be recorded in the Register in that connection:
(1) the date on which the European Patent Office has announced its decision to grant the patent;

- the date on which the translation and the payment of the fee under the first paragraph of Section 70h of the Patents Act were received and the date on which the announcement of the translation was published;
- (3)
- the date on which the patent term begins; and
- (4)
- the particulars corresponding to the ones specified in subparagraphs 1 to 5, 10 and 13 of the second paragraph of Section 31. (21.3.1997/246)
If the European Patent Office has taken a final decision to revoke a European patent or maintain a European patent with amended wording, this fact shall be recorded in the Register. If the proprietor of the patent, in cases where the patent is maintained with amended wording, filed the translation and paid the prescribed fee under the first paragraph of Section 70h of the Patents Act, this fact shall be recorded in the Register.
If a correction is filed of the translation referred to in the first and third paragraphs above, the date this has taken place and the date of the announcement of the correction shall be recorded in the Register.
Section 38b
(21.3.1997/246) Once an opposition has been lodged against a granted patent, this fact shall be recorded in the Patent Register. The entry shall contain the following particulars:
1) the name and address of the opponent;
2) if the opponent has appointed a representative, the name, domicile and address of the representative; and
3) the date of lodging the opposition.
A final decision taken in respect of an opposition shall be recorded in the Patent Register. In that connection, the date of the decision and its principal contents are recorded in the Register.
Section 39
(21.3.1997/246) The announcement under the sixth paragraph of Section 25 of the Patents Act concerning a decision taken in respect of an opposition shall give the serial number and classification of the patent, the title of the invention, the name of the proprietor of the patent and the date of the decision.
Section 40
Payment of a renewal fee or respite granted for payment of a renewal fee shall be recorded in the Register.
If a patent has lapsed under Section 51 of the Patents Act, the date as from which the patent ceased to be valid shall be recorded in the Register.

A request under Section 71a of the Patents Act that a renewal fee be deemed to have been paid within the specified time limit shall be recorded in the Register without delay. The final decision on such request shall also be recorded.
Section 41
Any notification made to the Patent Office that a person has taken legal action to have a patent declared invalid, to have a patent transferred or to obtain a compulsory license shall be recorded in the Register.
When a copy of a court decision has been sent to the Patent Office in accordance with Section 70 of the Patents Act, this fact shall be recorded in the Register. Once the decision has become final, an entry shall be made in the Register in such a way that the main findings of the case are apparent in the Register.
If the Patent Office has declared a patent terminated under Section 54 of the Patents Act, this fact shall be recorded in the Register.
Section 42
Entries under Section 44 of the Patents Act concerning the transfer of a patent or the grant of a license or a pledge shall include the name, domicile and address of the owner of the right and the date of the transfer or grant of the license or rights. In the case of a license, it shall be stated, on request, whether the right of the owner of the patent to grant additional licenses has been limited. If it is not possible to take an immediate decision on the question of recording the transfer or grant of a license or a pledge, an entry shall nevertheless be made in the Register that recording has been requested.
Seizure of a patent to cover a debt shall be recorded in the Register when reported.
Any change reported in respect of a representative shall be recorded in the Register.
Where the Patent Office receives such notification of transfer of a deposit as is referred to in the third paragraph of Section 17b or such receipt of a new deposit of a microorganism as is referred to in the third paragraph of Section 17c , the transfer or the new deposit shall be recorded in the Register. Announcements published by the Patent Office

Announcements in respect of patents shall be published in a publication issued by the Patent Office.

Legal proceedings under the third paragraph of Section 52 of the Patents Act shall be instituted by the Public Prosecutor, unless the Government appoints another official in a specific case.
Receiving Office for International Patent Applications
Section 45
(15.2.1996/104) The Patent Office shall be the receiving Office for international patent applications where the applicant or one of the applicants is a national of Finland, a natural person domiciled in Finland, a legal entity constituted according to Finnish law or anyone who carries on business in Finland. Such applicant may file an international patent application also with the European Patent Office.
Section 46
In its capacity as a receiving Office, the Patent Office shall receive, check and transmit international applications in accordance with the Patent Cooperation Treaty and its Regulations.
The following fees shall be payable to the Patent Office in that connection:
- (1)
- the basic fee referred to in Rule 15.1 of the Regulations under the Patent Cooperation Treaty, within one month of receipt of the application;
- (2)
- the designation fee referred to in Rule 15.1, within one year of the international filing date of the application or, if priority is claimed, the claimed priority date; the fee may nevertheless in all cases be paid within one month of receipt of the application;
- (3)
- the search fee referred to in Rule 16.1, within one month of receipt of the application; and
- (4)
- the transmittal fee for handling of the application by the Patent Office as a receiving Office, within one month of receipt of the application.
If the amount of the basic fee or of the designation fee has been increased after receipt of the application, but prior to making the payments, the fee may be paid without an increase if it is paid within one month of receipt of the application. (14.6.1985/505)
If the fee referred to in the second paragraph has not been paid within the prescribed time limit or if it has not been fully paid on expiry of the time limit, the Patent Office shall invite the applicant to pay the outstanding amount within one month of issuing the invitation. (26.6.1992/583)
Section 47
At the applicant’s request and on payment of a specifically prescribed fee, the Patent Office shall ensure that a copy of an application previously filed with the Patent Office is transmitted under Rule 17.1(b) to the International Bureau referred to in Section 8 . The fee shall be paid within the time limit for making the request under the above-mentioned Rule.
Section 48

(14.6.1985/505) International applications filed with the Patent Office shall be submitted in a single copy. They shall be drafted in Finnish, Swedish or English or in any other language accepted by the Patent Office. The application document for an international application may be in the English language even where the actual application is drafted in Finnish or Swedish.

A separate record shall be kept of international applications filed with the Patent Office. The record shall not be available to the public.
Section 50
An applicant not domiciled in Finland shall be required to appoint a representative domiciled in the country, entitled to represent him before the Patent Office in matters concerning the application.

Transmitting International Patent Applications to the International Bureau

(21.3.1997/246) Where the Patent Office is not competent to receive an international application filed with it by an applicant who is domiciled in or a national of a Contracting State, the Patent Office shall without delay transmit the application to the International Bureau in accordance with the Patent Cooperation Treaty and its Regulations.
In this connection, the applicant shall pay the transmittal fee referred to in Rule 19(4) of the Patent Cooperation Treaty within one month of the filing of the application. An application so received for the International Bureau shall be deemed to have been received on the day the international application has been filed with the Patent Office.
Pursuing International Patent Applications

The Patent Office may issue regulations concerning relaxation for applicants from the requirement to file a translation in cases where an international application is pursued in Finland in part only.

(14.6.1985/505) If the applicant has taken all steps required by Section 31 of the Patents Act for pursuing an international application, but the Patent Office has received no notification of receipt of the application from the International Bureau, the Patent Office shall notify the International Bureau thereof.
Section 52b
(14.6.1985/505) The time limit referred to in Section 34 of the Patents Act shall be: (1) unless otherwise specified in item (2), four months from the expiration of the time limit for pursuing an international application as laid down in the first paragraph of Section 31 of the Patents Act; or
(2) if the applicant, within 19 months of the international filing date or, if priority is claimed, of the date of the claimed priority, has filed a statement under the second paragraph of Section 31 of the Patents Act, four months from the expiry of the 30-month time limit laid down in the said Section. Section 52c
(14.6.1985/505) The request for review under the first paragraph of Section 38 of the Patents Act shall be filed within two months of the date on which the receiving Office or the International Bureau has sent a notification to the applicant of the decision referred to in that paragraph.
If the applicant can prove that he received the notification referred to in the first paragraph more than seven days after the date borne by the notification, the time limit shall be extended by as many days as have elapsed between the date of the notification and the date on which the applicant received the notification. The seven days referred to above shall nevertheless be subtracted from the term.
Supplementary Protection Certificates

(21.3.1997/246) ’Supplementary protection certificate’ refers to the supplementary protection certificate in accordance with Section 70a of the Patents Act.
‘Council Regulation’ refers to Council Regulation (EEC) No 1768/92 concerning the creation of a supplementary protection certificate for medicinal products, with the amendments and additions made to it by decision No. 7/94 of the joint committee of the EEA, and to the European Parliament

Section 52e
(28.6.1994/595) An application concerning a supplementary protection certificate shall be filed in writing and submitted in two copies.
The application document shall be signed by the applicant or his representative and shall state the particulars referred to in Article 8 of the relevant Council Regulation. If a supplementary protection certificate is applied for by several persons jointly, the application document shall also contain a statement as to whether one of such persons is entitled to receive communications from the Patent Office on behalf of all applicants. In addition, the applicant shall provide the Patent Office with any additional information on the product necessary for the processing of the application.

(28.6.1994/595) The application shall be written in Finnish or Swedish in compliance with the applicable language laws. If a document accompanying the application is drafted in a language other than those mentioned above, the Office may require that a translation be provided in either Finnish or Swedish.

(28.6.1994/595) The Patent Office shall keep a record of applications received. In addition to the details listed in Article 9(2) of the relevant Council Regulation, the following particulars shall be entered in the record for each application:
1) the serial number and filing date of the application;

Converting European Patent Applications into National Applications

(15.2.1996/104) If the Patent Office receives a request for conversion of a European patent application into a national application under Article 136(2) of the European Patent Convention, the Patent Office shall immediately transmit the request together with a copy of the application to the patent authorities of the countries specified in the request.
Section 52s
(15.2.1996/104) If the Patent Office receives a European patent application which has been transmitted there for conversion into a national application under Article 136 of the European Patent Convention, the Patent Office shall immediately notify the applicant thereof.
The application fee and the translation under the first and second paragraphs of Section 70s of the Patents Act shall be received by the Patent Office within three months of the date on which the Patent Office sent the notification under the first paragraph above to the applicant. The application fee shall be computed in the same manner as the application fee under Section 8 of the Patents Act.

Record to be kept of European Patent Applications

Section 52t
(15.2.1996/104) The Patent Office shall keep a separate record, accessible to the public, of European patent applications for which translations have been filed pursuant to Section 70n of the Patents Act.
The particulars to be entered in the record for each application include the serial number of the application, the applicant’s name and address, and the date on which the translation or a corrected translation was received by the Patent Office as well as the date on which an announcement of the filing of the translation or a corrected translation was published. Further, the date which has been accorded as the filing date of the application and the particulars listed in subparagraphs 4 to 6, 10 and 11 of the second paragraph of Section 7 shall be entered.
Once the translation under the first paragraph of Section 70h of the Patents Act has been filed, a note to that effect as well as the date on which an announcement of the filing of the translation was published shall be entered in the record. The same shall apply to any correction of such a translation received before the patent is entered in the Patent Register.
Translating European Patent and European Patent Applications

Section 52u
(15.2.1996/104) The filing of the translation and the payment of the fee under Section 70h of the Patents Act shall take place within three months of the date on which the European Patent Office has published its decision to let the patent application proceed to grant or to maintain the patent in an amended form.
The translation under the first paragraph shall comprise the title of the invention, the description, including any drawings where necessary, and the patent claims. (21.3.1997/246)
The translation under the first paragraph, 1st clause, of Section 70h of the Patents Act shall be accompanied by indication of the application number and the name and address of the applicant. The translation under the first paragraph, 3rd clause, of the said Section 70h of the Patents Act shall be accompanied by indication of the serial number of the patent and the name and mailing address of the proprietor of the patent.
If the requirements of paragraphs 2 and 3 hereof are not complied with, the translation under Section 70h of the Patents Act shall be deemed not to have been filed.

(15.2.1996/104) Correction of the translation under Section 70q of the Patents Act shall be made by filing a rewritten copy of the document clearly indicating the correction. The correction of the translation shall be accompanied by an indication of the number of the patent application or the patent and the name and address of the proprietor of the patent or the applicant, respectively, at the risk of the correction of the translation being deemed not to have been filed.
Announcements concerning corrections of translations under the first paragraph of 70 q of Section the Patents Act shall contain:
(1) the information that pursuant to the third paragraph of Section 52u shall accompany the translation;

1. Les demandes de brevet finlandais doivent être déposées auprès de l’Office national des brevets et de l’enregistrement (Office des brevets).
Les demandes internationales désignant la Finlande doivent être déposées auprès d’une administration ou d’une organisation internationale qui est un office récepteur conformément au Traité de coopération en matière de brevets fait à Washington le 19 juin 1970 et à son règlement d’exécution. Les articles 45 à 51 contiennent les dispositions relatives à l’Office des brevets en sa qualité d’office récepteur. Sauf indication contraire, les dispositions du présent décret relatives aux demandes de brevet régissent uniquement :
1) les demandes de brevet finlandais ; ou 2) les demandes internationales dont la procédure est poursuivie en ce qui concerne la Finlande en
vertu de l’article 31 de la Loi sur les brevets ou qui sont acceptées pour poursuite de la procédure en vertu de l’article 38 de ladite loi.
2. Les demandes de brevet finlandais doivent comporter une demande proprement dite et des pièces jointes.
La demande doit être signée par le déposant ou son mandataire et contenir les indications suivantes :

1) les nom, domicile et adresse du déposant et, si le déposant a constitué un mandataire, les nom, domicile et adresse du mandataire ;
2) les nom et adresse de l’inventeur ; 3) un titre, concis et descriptif, de l’invention faisant l’objet de la demande ; 4) lorsqu’un brevet est demandé conjointement par plusieurs personnes, une indication selon
laquelle l’une d’elles est habilitée à recevoir les communications de l’Office des brevets au nom de tous les déposants ;
4a) le cas échéant, l’indication que la demande comprend le dépôt d’une culture de micro-organisme conformément à l’article 8a de la Loi sur les brevets ;
5) une liste des pièces jointes à la demande. Les pièces suivantes doivent être jointes à la demande : 1) une description de l’invention accompagnée, le cas échéant, des dessins nécessaires à
l’intelligence de l’invention, de revendications et d’un abrégé ; 2) si le déposant a constitué un mandataire, la procuration du mandataire en tant que pièce
distincte si le mandat n’a pas été donné à ce dernier dans la demande ; 3) si l’invention a été faite par une personne autre que le déposant, un acte attestant le droit du
déposant à l’invention. La taxe de dépôt prescrite doit être payée lors du dépôt de la demande.
3. Lorsqu’une pièce n’est pas rédigée dans une des langues indiquées à l’article 8, cinquième alinéa, de la Loi sur les brevets, le déposant doit aussi en déposer une traduction en finnois ou suédois auprès de l’Office des brevets. L’Office des brevets peut renoncer à exiger une traduction, ou accepter une traduction dans une langue autre que le finnois ou le suédois, d’une pièce autre que la description, l’abrégé ou les revendications, ou du texte de la description ou des revendications d’une demande de brevet finlandais ne faisant pas partie des documents de base au sens de l’article 21, premier alinéa.
4. La description, l’abrégé et les revendications doivent être dactylographiés ou imprimés à l’encre noire sur du papier blanc de format A4 (210 x 297 mm).
Les dessins doivent être exécutés en traits foncés, noirs de préférence, sur un support durable et de couleur claire, blanche de préférence, de format A4.
La description, accompagnée de dessins le cas échéant, les revendications et l’abrégé doivent être présentés sous une forme se prêtant à l’impression.
L’Office des brevets donne des informations sur les conditions supplémentaires relatives à la forme des pièces et au nombre d’exemplaires que le déposant doit déposer auprès de l’Office des brevets.
5. Le déposant qui souhaite qu’une recherche de nouveauté soit effectuée conformément à l’article 9 de la Loi sur les brevets doit présenter une requête écrite à cet effet à l’administration des brevets dans un délai de trois mois à compter de la date de dépôt de la demande ou, le cas échéant, de la date à laquelle la demande est réputée déposée, et payer la taxe prescrite par l’administration chargée de la recherche. Lorsque la demande n’est pas rédigée dans une langue admise par l’administration chargée de la recherche, la requête doit être accompagnée d’une traduction de la demande dans une langue prescrite par l’administration des brevets.
Lorsque la recherche mentionnée au premier alinéa peut être effectuée par plusieurs administrations et que le déposant souhaite désigner celle d’entre elles qui effectuera la recherche, il doit la nommer dans sa requête.
La requête est réputée retirée si, à l’expiration du délai prévu au premier alinéa, la demande et la traduction ne remplissent pas les conditions de forme régissant les demandes internationales.
6. L’Office des brevets inscrit sur chaque demande la date à laquelle elle a été déposée auprès de lui.

7. L’Office des brevets tient un registre des demandes de brevet déposées auprès de lui. Ce registre est accessible au public.
Chaque demande fait l’objet de l’inscription au registre des indications suivantes : 1) le numéro de la demande et les classes dans lesquelles elle est rangée ; 2) le nom de l’examinateur chargé d’examiner la demande ; 3) les nom, domicile et adresse du déposant ; 4) lorsque le déposant a constitué un mandataire, les nom, domicile et adresse du mandataire ; 5) les nom et adresse de l’inventeur ; 6) le titre de l’invention ; 7) l’indication qu’il s’agit d’une demande de brevet finlandais ou d’une demande internationale ; 8) pour une demande de brevet finlandais, sa date de dépôt et la date à compter de laquelle la
demande produit ses effets si elle est différente de la date de dépôt ; 9) pour une demande internationale, sa date de dépôt international et la date à laquelle la
procédure relative à la demande a été poursuivie conformément à l’article 31 de la Loi sur les brevets, ou la date à laquelle la demande a été déposée conformément à l’article 38 de ladite loi ;
10) lorsque la priorité d’une demande antérieure est revendiquée, le pays dans lequel la demande antérieure sur laquelle se fonde la priorité a été déposée, la date de dépôt de cette demande et son numéro ;
11) lorsque la demande résulte d’une division ou d’une séparation, le numéro de la demande principale ;
12) lorsqu’une nouvelle demande résulte de la division ou de la séparation d’une demande, le numéro de la demande divisionnaire ou séparée ;
13) lorsque la demande a été rendue accessible au public conformément à l’article 22, troisième alinéa, de la Loi sur les brevets, la date à laquelle elle est devenue accessible ;
14) pour une demande internationale, le numéro de dépôt international ; 15) la liste des pièces déposées et le montant des taxes payées pour la demande ; 16) les décisions rendues sur la demande.
8. L’Office des brevets dresse une liste hebdomadaire des demandes de brevet déposées. Cette liste contient pour chaque demande les indications énumérées à l’article 7, deuxième alinéa, sous-alinéas 1), 3), 5) à 11) et 14).
L’Office des brevets dresse en outre une liste hebdomadaire des demandes internationales désignant la Finlande en se fondant sur les renseignements communiqués par le Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle. Dans la mesure du possible, cette liste contient pour chaque demande les indications énumérées à l’article 30.2)b) du Traité de coopération en matière de brevets.
Ces listes sont accessibles au public moyennant le paiement de la taxe prescrite.
9. Lorsqu’un avis de cession est donné à un tiers pour une invention dont la protection par brevet est demandée, le tiers bénéficiaire de la cession ne peut être inscrit au registre des demandes en tant que déposant que sur présentation de la preuve de la cession.

Priorité
10. Pour bénéficier de la priorité prévue à l’article 6 de la Loi sur les brevets, le déposant doit la revendiquer par écrit dans un délai de trois mois à compter de la date de dépôt de sa demande ou, le cas échéant, de la date à laquelle la demande est considérée comme déposée, en indiquant où et quand la demande sur laquelle se fonde la priorité a été déposée et, dès que possible, son numéro. Pour les demandes internationales, la priorité doit être revendiquée dans la demande elle-même avec l’indication du lieu et de la date auxquels la demande sur laquelle se fonde la priorité a été déposée et, si celle -ci est une demande internationale, au moins un des pays désignés dans la demande. Dans ce cas, le numéro de la demande sur laquelle se fonde la priorité est communiqué à l’office récepteur de la demande internationale ou au Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle dans un délai de 16 mois à compter de la date de priorité revendiquée.
Lorsqu’une demande a été divisée conformément à l’article 22, la revendication de priorité relative à la demande principale est aussi applicable à la demande divisionnaire sans qu’il soit nécessaire de la revendiquer expressément.
11. Le déposant qui a revendiqué la priorité doit, dans un délai de 16 mois à compter de la date dont la priorité est revendiquée, déposer auprès de l’Office des brevets un certificat de l’administration auprès de laquelle la demande dont la priorité est revendiquée a été déposée attestant la date de dépôt de la demande prioritaire et le nom du déposant, ainsi qu’une copie de cette demande, certifiée conforme par cette administration. La copie doit être déposée dans la forme prescrite par l’Office des brevets. Toutefois, pour les demandes internationales, le certificat ne doit être déposé que sur invitation officielle de l’Office des brevets. Pour ces demandes, le document de priorité peut aussi être déposé, conformément à la règle 17.1 du règlement d’exécution du Traité de coopération en matière de brevets, auprès du Bureau international mentionné à l’article 8 ou auprès de l’administration auprès de laquelle la demande a été déposée, ou encore faire l’objet d’une requête en transmission au Bureau international présentée à cette administration.
L’Office des brevets peut accorder des dérogations à l’obligation de déposer le certificat et la copie mentionnés au premier alinéa.
Lorsqu’une copie de la demande sur laquelle se fonde la priorité d’une demande internationale a été déposée auprès du Bureau international mentionné au premier alinéa, l’Office des brevets ne peut en exiger une copie et une traduction que conformément à la règle 17.2 du règlement d’exécution du Traité de coopération en matière de brevets.
12. La priorité ne peut se fonder que sur la première demande dans laquelle l’invention a été décrite.
Lorsque le déposant de la première demande ou son ayant cause a déposé ultérieurement auprès de la même administration une demande se rapportant à la même invention, la demande ultérieure peut être mentionnée pour fonder la priorité à condition qu’à la date du dépôt de la demande ultérieure, la demande antérieure ait été retirée, classée ou rejetée sans avoir été rendue accessible au public, sans laisser subsister de droits et sans avoir servi à fonder une priorité. Lorsque la priorité a été accordée sur la base d’une demande ultérieure, la demande antérieure ne peut plus servir à fonder une revendication de priorité.
Les dispositions du deuxième alinéa sont applicables par analogie à une demande de brevet dont la date de dépôt a été modifiée.
13. La priorité peut aussi être accordée pour une partie d’une demande.
La priorité de plusieurs demandes antérieures, même déposées dans des pays différents, peut être revendiquée dans une demande.

Revendications
14. Les revendications doivent contenir : 1) le titre de l’invention ; 2) l’indication de la technique en rapport avec laquelle l’invention est nouvelle (état de la
technique), si nécessaire ; 3) l’indication des éléments nouveaux et caractéristiques de l’invention. Une revendication ne peut se rapporter qu’à une seule invention. Dans la mesure du possible, l’invention doit relever de l’une des catégories suivantes : produit,
dispositif, procédé ou utilisation. Une revendication ne doit pas contenir d’éléments sans rapport avec l’invention qui y est décrite ou
avec le droit exclusif revendiqué par le déposant.
15. Une demande peut contenir plusieurs revendications. Lorsqu’une demande contient plusieurs revendications, celles-ci doivent être présentées et numérotées consécutivement.
Une revendication peut être indépendante ou dépendante. Est dépendante une revendication qui se rapporte à une réalisation d’une invention décrite dans une autre revendication de la demande et comprend par conséquent toutes les caractéristiques de cette dernière revendication. Toute autre revendication est indépendante.
Une ou plusieurs revendications dépendantes peuvent se rapporter à une revendication. Une revendication dépendante peut se rapporter à plusieurs revendications précédentes. Elle doit commencer par un renvoi à la revendication précédente puis énumérer les caractéristiques supplémentaires de l’invention.
16. Lorsque l’objet de l’invention est d’une nature telle qu’une invention relevant d’une certaine catégorie ne peut pas être présentée de manière appropriée dans une seule revendication indépendante, la demande peut contenir plusieurs revendications indépendantes de la même catégorie. Toutefois, la demande ne doit dès lors pas porter sur deux ou plusieurs inventions indépendantes les unes des autres.
La demande de brevet n’est en aucun cas considérée comme se rapportant à des inventions indépendantes les unes des autres lorsqu’elle comporte :
1) outre une revendication indépendante décrivant un produit, une revendication indépendante pour un procédé de fabrication du produit et une revendication indépendante pour un usage du produit,
2) outre une revendication indépendante décrivant un produit, une revendication indépendante pour un procédé de fabrication du produit et une revendication indépendante pour un moyen de fabrication du produit, ou
3) outre une revendication indépendante décrivant un procédé, une revendication indépendante pour un moyen de mise en œuvre du procédé.
Description
17. La description ne peut contenir que des éléments contribuant à l’intelligence de l’invention. S’il est nécessaire d’utiliser un terme nouvellement forgé ou un terme technique qui n’est pas admis de manière générale, ce terme doit être expliqué. Les dénominations et unités de mesure ne doivent pas s’écarter de celles qui sont communément utilisées dans les pays nordiques.
Lorsque la demande comprend le dépôt d’une culture de micro-organisme conformément à l’article 8a de la Loi sur les brevets, le déposant doit, lors du dépôt de la demande, donner toutes les informations pertinentes dont il dispose sur les caractéristiques du micro-organisme.
17a. Les dépôts mentionnés au premier alinéa de l’article 8a de la Loi sur les brevets doivent être effectués auprès d’une institution qui a le statut d’une autorité de dépôt internationale au sens du Traité sur

la reconnaissance internationale du dépôt des micro-organismes aux fins de la procédure en matière de brevets (Traité de Budapest) fait à Budapest le 28 avril 1977.
Ces dépôts doivent être effectués conformément au Traité de Budapest.
L’Office des brevets tient une liste des institutions ayant le statut d’autorité de dépôt internationale conformément au Traité de Budapest.
17b. Le déposant d’un micro-organisme doit informer l’Office des brevets par écrit, dans un délai de 16 mois à compter de la date de dépôt de la demande ou, si une priorité est revendiquée, de la date de priorité revendiquée, de l’institution auprès de laquelle le dépôt a été effectué, de la date de ce dépôt et du numéro d’ordre donné au dépôt par l’institution. Pour les demandes internationales, ces informations peuvent être données, dans le même délai, au Bureau international mentionné à l’article 8.
Lorsque le déposant présente une requête tendant à ce que les pièces de la demande soient rendues accessibles au public plus tôt qu’il n’est prévu aux premier et deuxième alinéas de l’article 22 de la Loi sur les brevets, les informations mentionnées au premier alinéa doivent être données au plus tard lors de la présentation de la requête. Lorsque le déposant demande la publication anticipée d’une demande internationale conformément à l’article 21.2)b) du Traité de coopération en matière de brevets, ces informations doivent être fournies au plus tard lors de la présentation de la requête en publication.
Si le dépôt a fait l’objet du transfert d’une autorité de dépôt internationale à une autre en vertu de la règle 5.1 du règlement d’exécution du Traité de Budapest, le déposant doit informer l’Office des brevets du transfert et du nouveau numéro d’ordre du dépôt.
L’Office des brevets peut exiger une copie du récépissé du dépôt délivré par l’institution à titre d’attestation des informations mentionnées aux premier et troisième alinéas.
17c. Le nouveau dépôt mentionné au deuxième alinéa de l’article 8a de la Loi sur les brevets doit être effectué conformément aux dispositions relatives au nouveau dépôt du Traité de Budapest.
Le nouveau dépôt doit être effectué dans un délai de trois mois à compter de la date à laquelle le déposant a reçu la notification de l’autorité de dépôt internationale selon laquelle des échantillons du dépôt antérieur ne peuvent plus être remis. Lorsque l’institution a cessé d’exercer ses fonctions d’autorité de dépôt internationale à l’égard du genre de micro-organismes dont le dépôt relève ou a cessé de remplir ses obligations découlant du Traité de Budapest et que le déposant n’a pas reçu de notification à cet effet dans un délai de six mois à compter de la publication de la notification correspondante par le Bureau international, un nouveau dépôt peut toutefois être effectué dans un délai de neuf mois à compter de la publication de cette dernière notification.
Dans un délai de quatre mois à compter du nouveau dépôt, le déposant doit déposer à l’Office des brevets une copie du récépissé du nouveau dépôt délivré par l’institution. Toutefois, lorsque le délai prévu au premier ou au deuxième alinéa de l’article 17b expire à une date ultérieure, le récépissé peut être déposé dans le délai expirant à cette date ultérieure. Le numéro de la demande de brevet ou du brevet auquel se rapporte le dépôt doit être indiqué lors du dépôt du récépissé.

Abrégé
18. L’abrégé d’une demande de brevet finlandais doit se fonder sur la description et les revendications contenues dans les pièces constituant les documents de base conformément à l’article 21, premier alinéa, ou à l’article 24, premier alinéa. L’abrégé doit contenir le titre de l’invention et être rédigé de manière suffisamment claire pour exposer le problème technique auquel l’invention se rapporte, les principes auxquels l’invention fait appel pour résoudre ce problème ainsi que le principal domaine d’utilisation de l’invention. La rédaction définitive de l’abrégé est confirmée, dans la mesure du possible, avant que la demande soit rendue accessible au public conformément à l’article 22, deuxième alinéa, de la Loi sur les brevets.
Lorsqu’une demande internationale contient un abrégé confirmé par l’administration chargée de la recherche internationale, la teneur de cet abrégé est acceptée. Dans la négative, l’Office des brevets confirme aussi l’abrégé d’une demande internationale. Les dispositions du premier alinéa sont dès lors applicables.
Modification des demandes
19. Les revendications ne peuvent pas être modifiées de manière à y inclure des éléments qui ne figuraient pas dans les documents de base au sens de l’article 21, premier ou deuxième alinéa, ou de l’article 24, premier alinéa. Lorsque la modification d’une revendication a pour effet d’y ajouter de nouveaux éléments, le déposant doit simultanément indiquer où se trouve la contrepartie de ces nouveaux éléments dans les documents de base.
Une fois que l’Office des brevets a établi un rapport de recherche de nouveauté relatif à une demande, cette demande ne peut pas contenir de revendication décrivant une invention indépendante de l’invention décrite dans les revendications antérieures.
En ce qui concerne les demandes internationales, le rapport de recherche de nouveauté n’est établi avant l’expiration du délai prévu à l’article 52b qu’avec le consentement du déposant.
Le déposant ne peut apporter à la description et aux dessins que des modifications ou adjonctions nécessaires conformément à l’article 8 de la Loi sur les brevets. Ces modifications ou adjonctions ne doivent pas avoir pour effet d’inclure dans une revendication des éléments qui ne figuraient pas dans les documents de base.
20. Les modifications ou adjonctions sont apportées aux revendications par dépôt d’un nouveau document présentant toutes les revendications dans l’ordre, à moins que l’Office des brevets n’autorise une présentation différente.
21. Aux fins du présent décret, sont réputés constituer les documents de base des demandes de brevet finlandais et des demandes faisant l’objet de la poursuite de la procédure conformément à l’article 38 de la Loi sur les brevets : la description en finnois ou suédois, accompagnée de dessins le cas échéant, et les revendications qui figuraient dans la demande telle qu’elle a été déposée ou est réputée avoir été déposée. Lorsque ces pièces ne figuraient pas dans la demande telle que rédigée à cette date, la première description en finnois ou suédois et les premières revendications déposées ultérieurement sont réputées constituer les documents de base si leur contenu correspond clairement au contenu des pièces déposées auprès de l’Office des brevets à cette date.
Sont réputés constituer les documents de base des demandes internationales faisant l’objet de la poursuite de la procédure conformément à l’article 31 de la Loi sur les brevets :
1) la traduction de la description, des dessins et des revendications, lorsque la traduction est exigée pour la poursuite de la procédure, déposée en vertu de l’article 31 de la Loi sur les brevets, y compris les corrections éventuelles apportées avant l’expiration du délai prévu à l’article 52b, ou

2) la copie de la description, des dessins et des revendications déposée conformément à l’article 31 de la Loi sur les brevets si la demande est rédigée en finnois ou suédois.
Lorsque le déposant a indiqué, à la date de dépôt d’une demande, qu’il a antérieurement déposé une demande de protection de l’invention auprès d’une administration des brevets étrangère, la copie certifiée conforme de la demande étrangère déposée ultérieurement est réputée avoir été déposée auprès de l’Office des brevets à la date de dépôt de la demande auprès de l’Office des brevets finlandais, à condition que la date de dépôt et le numéro de la demande étrangère soient indiqués.
Division et séparation
22. Lorsque plusieurs inventions sont décrites dans les documents de base, le déposant peut diviser sa demande en plusieurs demandes. Une nouvelle demande portant sur une invention résultant de la division de la demande originale (demande principale) est dès lors, sur requête du déposant, réputée déposée à la même date que la demande principale. La demande divisionnaire ne peut contenir que des éléments qui auraient pu être contenus en vertu de l’article 19, deuxième alinéa, de la Loi sur les brevets dans les revendications de la demande principale à la date de dépôt de la demande divisionnaire auprès de l’Office des brevets.
Lorsque la demande est divisée pour le motif qu’elle contient deux ou plusieurs inventions indépendantes les unes des autres, la demande divisionnaire n’est réputée déposée à la même date que la demande principale que si elle est déposée dans un délai de quatre mois à compter de la date à laquelle la limitation correspondante a été apportée à la demande principale.
23. Lorsque, en raison d’une adjonction à la description ou aux revendications ou pour un autre motif, la demande a été modifiée de manière à décrire une invention qui n’était pas décrite dans les documents de base, une nouvelle demande portant sur cette invention, déposée par séparation de la demande originale (demande principale), peut, sur requête du déposant, être réputée déposée à la date à laquelle le document décrivant l’invention a été déposé auprès de l’Office des brevets.
La séparation ne peut être opérée que conformément à l’article 19, deuxième alinéa, de la Loi sur les brevets et à condition que ne soit revendiquée dans la demande séparée que la protection d’éléments qui étaient décrits dans les pièces de la demande principale lors du dépôt du nouveau document.
24. En cas de division ou de séparation, la description, les dessins et les revendications déposés en même temps que les pièces de la demande divisionnaire ou séparée sont réputés constituer les documents de base.
Une nouvelle demande ne peut être considérée comme résultant d’une division ou d’une séparation que si cela ressort à l’évidence de la demande lors de son dépôt. Le numéro de la demande principale doit être indiqué dans la demande divisionnaire ou séparée.
Accessibilité au public
25. Lorsque les pièces d’une demande de brevet sont devenues accessibles au public conformément à l’article 22, deuxième ou troisième alinéa, de la Loi sur les brevets avant d’avoir été mises à l’inspection publique, l’abrégé est imprimé dès que sa rédaction définitive a été confirmée. L’Office des brevets peut aussi décider d’imprimer d’autres parties de la demande avec l’abrégé. Ces pièces sont accessibles au public moyennant paiement de la taxe prescrite.

L’annonce prévue à l’article 22, quatrième alinéa, de la Loi sur les brevets indique le numéro et la classification de la demande, sa date de dépôt, la date à laquelle elle produit ses effets si cette date est différente de la date de dépôt, le titre de l’invention ainsi que les nom et adresse du déposant et de l’inventeur. Lorsqu’une priorité a été revendiquée, l’annonce indique aussi le lieu de dépôt de la demande antérieure pertinente ainsi que sa date de dépôt et son numéro. L’annonce indique si la demande comprend le dépôt d’une culture de micro-organisme. Elle indique aussi si le déposant a présenté, en vertu du septième alinéa de l’article 22 de la Loi sur les brevets, une requête en remise d’échantillon de la culture déposée à un expert en la matière exclusivement.
La modification de la traduction de la description ou des revendications d’une demande internationale opérée dans le délai prévu à l’article 52b, mais après que les documents ont été rendus accessibles au public, fait l’objet d’une annonce.
25a. La requête en remise d’un échantillon d’un dépôt mentionnée à la première phrase du huitième alinéa de l’article 22 de la Loi sur les brevets doit être présentée de la manière prescrite par la règle 11 du règlement d’exécution du Traité de Budapest.
Lorsque la requête porte sur un dépôt se rapportant à une demande de brevet qui n’a pas fait l’objet d’une décision finale, le requérant doit donner au déposant l’engagement de n’utiliser l’échantillon qu’à des fins expérimentales et de ne pas le rendre accessible à des tiers avant que la demande fasse l’objet d’une décision finale ou, si un brevet a été délivré, avant l’expiration de la durée de validité du brevet.
Lorsque la requête porte sur un dépôt se rapportant à un brevet, le requérant doit donner au titulaire du brevet l’engagement de ne pas rendre l’échantillon accessible à des tiers avant l’expiration de la durée de validité du brevet.
L’engagement concernant l’échantillon doit aussi être donné pour des cultures dérivées de l’échantillon qui ont conservé de la culture déposée les caractéristiques essentielles pour la mise en œuvre de l’invention.
L’engagement doit être joint à la requête.
25b. La requête en remise d’échantillon à un expert en la matière exclusivement, mentionnée au septième alinéa de l’article 22 de la Loi sur les brevets, doit être présentée dans un délai de 16 mois à compter de la date de dépôt de la demande ou, si une priorité est revendiquée, de la date de priorité revendiquée.
L’Office des brevets dresse une liste des personnes qui ont accepté d’exercer les fonctions d’expert et possèdent les qualifications nécessaires pour les exercer. Les décisions relatives aux personnes choisies pour figurer sur la liste des experts sont annoncées de la manière prévue à l’article 43.
Lorsqu’un échantillon ne peut être remis qu’à un expert en la matière, la requête en remise d’un échantillon doit indiquer le nom de la personne invitée à exercer les fonctions d’expert. La requête doit être accompagnée d’un engagement par écrit de l’expert envers le déposant, correspondant à l’engagement prévu aux deuxième et quatrième alinéas de l’article 25a.
Toute personne figurant sur la liste ou acceptée par le déposant dans un cas d’espèce peut être invitée à exercer les fonctions d’expert.
25c. Nonobstant les engagements exigés en vertu des articles 25a et 25b du présent décret, une culture dérivée peut être déposée aux fins d’une nouvelle demande de brevet si son dépôt à de telles fins est nécessaire.
25d. Lorsqu’une requête en remise d’échantillon est présentée et que les dispositions de la Loi sur les brevets ou du présent décret ne s’opposent pas à ce qu’il y soit donné suite, l’Office des brevets délivre un certificat à cet effet. L’Office des brevets transmet la requête en remise d’échantillon et le certificat à

l’institution auprès de laquelle le dépôt est conservé. L’Office des brevets transmet en même temps une copie de la requête et du certificat au déposant ou au titulaire du brevet.
Lorsque l’Office des brevets décide qu’un certificat visé au premier alinéa ne peut pas être délivré, il annonce sa décision. Le requérant d’un échantillon peut former un recours contre cette décision auprès de la Commission des recours de l’Office des brevets dans un délai de 60 jours à compter de la date de la signification de la décision au recourant, le jour de la signification n’étant pas inclus. La décision de la Commission des recours est sans appel.
Procédure relative aux demandes de brevet
26. En examinant si les conditions de délivrance d’un brevet prévues à l’article 2 de la Loi sur les brevets sont remplies, l’Office des brevets tient compte de tous les faits dont il a connaissance.
L’Office des brevets procède à cet examen sur la base des mémoires descriptifs de brevet, des mémoires descriptifs publiés et des demandes publiées, ou d’abrégés de ces pièces, de la Finlande, de la Norvège, de la Suède, du Danemark, des Etats-Unis d’Amérique, du Royaume-Uni, de la France, de la République fédérale d’Allemagne, de l’ancien Etat allemand et de l’Office européen des brevets, ou sur la base de demandes internationales accessibles au public ou d’abrégés de celles-ci ainsi que des demandes de brevet devenues accessibles au public en Finlande. D’autres documents disponibles peuvent aussi être examinés si cela est jugé nécessaire.
L’Office des brevets édicte des règles plus détaillées relatives à l’examen. Ces règles peuvent être différentes des dispositions du deuxième alinéa lorsqu’un cas particulier l’exige.
27. L’Office des brevets peut consulter des experts ne faisant pas partie de ses services lorsque l’examen des demandes l’exige.
28. L’Office des brevets peut inviter les déposants à lui présenter un modèle, échantillon ou autre objet similaire, ou à mener des enquêtes ou des expériences lorsque cela est nécessaire pour évaluer l’invention.
29. Toute personne qui dépose en Finlande une demande de brevet pour une invention pour laquelle elle a déposée antérieurement une demande de brevet auprès d’une administration de brevets étrangère est tenue, sous réserve des limitations prévues à l’article 74, troisième alinéa, de la Loi sur les brevets, de communiquer les informations que cette administration étrangère lui a transmises au sujet de l’examen de nouveauté ou de brevetabilité de l’invention. L’Office des brevets peut l’inviter officiellement à déposer une copie de cette communication ou à déclarer qu’elle n’a reçu aucune information concernant l’examen de la demande antérieure.
Lorsque l’examen d’une demande de brevet est effectué par une administration étrangère conformément à l’article 74, deuxième alinéa, de la Loi sur les brevets et que l’Office des brevets a conclu avec cette administration un accord d’échange de résultats d’examen et d’autres informations, il peut ajourner l’examen d’une demande correspondant à une demande déposée antérieurement auprès de cette administration étrangère jusqu’à ce que la procédure relative à cette dernière demande ait atteint le stade prévu dans l’accord.
L’Office des brevets est habilité à communiquer des documents concernant des demandes qui ne sont pas encore devenues accessibles au public à une administration de brevets avec laquelle il a conclu un accord conformément au deuxième alinéa, à condition que l’administration de brevets en question se soit engagée à ne pas rendre ces documents accessibles au public.
30. L’Office des brevets édicte des règles relatives aux délais et à leur prorogation. Toutefois, l’ajournement de la mise d’une demande à l’inspection publique ne peut être accordé que si la demande a été acceptée pour mise à l’inspection publique avant d’être devenue accessible au public conformément à

l’article 22 de la Loi sur les brevets. Dans ce cas, la mise à l’inspection publique peut être ajournée sur requête du déposant jusqu’à ce que la demande devienne accessible au public en vertu dudit article de la loi.
Mise de la demande à l’inspection publique
31. L’Office des brevets publie la description, accompagnée des dessins, le cas échéant, des revendications et de l’abrégé aux fins de la mise à l’inspection publique conformément à l’article 21 de la Loi sur les brevets (mémoire descriptif publié). Il procède à cette publication dès que possible après l’acceptation de la demande. Le mémoire descriptif publié doit porter la date de sa publication et contenir les indications suivantes :
1) le numéro de la demande et les classes dans lesquelles elle est rangée ; 2) les nom, domicile et adresse du déposant ; 3) le nom du mandataire constitué par le déposant le cas échéant ; 4) les nom et adresse de l’inventeur ; 5) l’indication qu’il s’agit d’une demande de brevet finlandais ou d’une demande internationale ; 6) pour une demande de brevet finlandais, sa date de dépôt et la date à compter de laquelle elle
produit ses effets si elle est différente de la date de dépôt ; 7) pour une demande internationale, sa date de dépôt international et la date à laquelle la
procédure relative à la demande a été poursuivie conformément à l’article 31 de la Loi sur les brevets, ou la date à laquelle la demande a été déposée conformément à l’article 38 de ladite loi ;
8) une revendication de priorité indiquant le lieu de dépôt de la demande antérieure sur laquelle se fonde la priorité, sa date de dépôt et son numéro ;
9) pour une demande internationale, le numéro de dépôt international ; 10) pour une demande divisionnaire ou séparée, le numéro de la demande principale ; 10a) une déclaration selon laquelle la demande comprend le dépôt d’une culture de
micro-organisme ; 11) un renvoi aux publications citées.
32. L’annonce de la mise à l’inspection publique mentionnée à l’article 21 de la Loi sur les brevets contient le titre de l’invention et les renseignements qui doivent être donnés dans le mémoire descriptif publié conformément à l’article 31, à l’exception du renvoi aux publications citées.
33. L’opposition formée contre une demande de brevet et les communications ultérieures ainsi que les pièces jointes produites par le déposant ou l’opposant doivent être déposées en un nombre d’exemplaires fixé par l’Office des brevets.
Lorsqu’opposition est formée, les motifs d’opposition doivent être indiqués.
34. Lorsqu’un opposant a constitué un mandataire, il doit déposer la procuration du mandataire auprès de l’Office des brevets.
35. Une copie de toutes les communications déposées par l’opposant est envoyée au déposant.
Lorsque le déposant dépose une réplique à l’opposition, l’Office des brevets décide si l’argumentation écrite doit être poursuivie.
36. Lorsque, au cours de l’examen d’une demande de brevet, une communication présentant de l’importance pour l’examen de la demande est déposée auprès de l’Office des brevets en dehors du délai d’opposition, le déposant en est avisé. Lorsqu’une telle communication a été produite avant la mise de la demande à l’inspection publique et qu’elle ne concerne pas un meilleur droit à l’invention, l’Office des brevets avise l’auteur de la communication de sa faculté de former opposition lors de la mise de la demande à l’inspection publique.

Dispositions réglementaires détaillées
37. L’Office des brevets édicte des règles plus détaillées relatives aux demandes et à la procédure y relative.
Registre des brevets
38. Les brevets délivrés sont inscrits au registre des brevets.
A cet égard, le registre contient les renseignements suivants : 1) le numéro de la demande, le numéro du brevet et les classes dans lesquelles il est rangé ; 2) les nom, domicile et adresse du titulaire du brevet ; 3) les nom, domicile et adresse du mandataire si le titulaire du brevet a constitué un mandataire ; 4) les nom et adresse de l’inventeur ; 5) les dates suivantes :
a) si le brevet est fondé sur une demande de brevet finlandais, la date de dépôt de la demande et la date à compter de laquelle la durée de validité du brevet commence à courir si elle n’est pas identique à la date de dépôt ;
b) si le brevet est fondé sur une demande internationale, la date de dépôt international ou la date à laquelle la demande est réputée déposée conformément à l’article 38, troisième alinéa, de la Loi sur les brevets ;
c) la date à laquelle les pièces de la demande sont devenues accessibles au public ; d) la date à laquelle la mise de la demande à l’inspection publique a été annoncée
conformément à l’article 21 de la Loi sur les brevets ; e) la date de délivrance du brevet ;
6) la priorité revendiquée ainsi que le lieu de dépôt de la demande sur laquelle se fonde la priorité, sa date de dépôt et son numéro ;
7) si le brevet a été délivré sur la base d’une demande internationale, le numéro de dépôt international ;
8) le titre de l’invention ; 9) lorsque la demande comprend le dépôt d’une culture de micro-organisme, le nom de
l’institution auprès de laquelle le dépôt est conservé et le numéro d’ordre donné au dépôt par l’institution.
39. L’annonce faite conformément à l’article 26 de la Loi sur les brevets en ce qui concerne la délivrance d’un brevet indique le numéro et la classification du brevet, le titre de l’invention, le nom du titulaire du brevet, le numéro de la demande et la date à laquelle la mise à l’inspection publique a été annoncée conformément à l’article 21 de la Loi sur les brevets.
40. Le paiement d’une annuité ou le moratoire accordé pour le paiement d’une annuité fait l’objet d’une inscription au registre. Lorsqu’un brevet a expiré conformément à l’article 51 de la Loi sur les brevets, la date à compter de laquelle il a cessé d’être valide est inscrite au registre.
Une requête, présentée conformément à l’article 71a de la Loi sur les brevets, tendant à ce qu’une annuité soit considérée comme payée en temps opportun fait l’objet sans retard d’une inscription au registre. La décision finale rendue sur cette requête fait aussi l’objet d’une inscription au registre.
41. Tout avis informant l’Office des brevets qu’une personne a intenté une action en annulation d’un brevet, en transfert d’un brevet ou en concession d’une licence obligatoire fait l’objet d’une inscription au registre.
La communication de copies de décisions de justice à l’Office des brevets conformément à l’article 70 de la Loi sur les brevets fait l’objet d’une inscription au registre. Dès qu’une décision de justice est entrée en

force de chose jugée, elle fait l’objet d’une inscription au registre faisant clairement ressortir les conclusions principales de l’affaire.
La constatation par l’Office des brevets du fait qu’un brevet a expiré en vertu de l’article 54 de la Loi sur les brevets fait l’objet d’une inscription au registre.
42. Les inscriptions prévues à l’article 44 de la Loi sur les brevets en ce qui concerne la cession d’un brevet, la concession d’une licence ou la constitution d’un nantissement sur un brevet doivent indiquer les nom, domicile et adresse du titulaire du droit et la date de la cession, de la concession de la licence ou de la constitution du nantissement. Pour une licence, il est indiqué sur requête si le droit du titulaire du brevet d’accorder d’autres licences a été limité. Lorsqu’il n’est pas possible de rendre immédiatement une décision sur l’inscription de la cession, de la concession de la licence ou de la constitution du nantissement, le fait qu’une requête en inscription a été présentée fait toutefois l’objet d’une inscription au registre.
La saisie d’un brevet pour dettes fait l’objet d’une inscription au registre dès qu’elle est annoncée.
Toute modification annoncée en ce qui concerne un mandataire est inscrite au registre.
Lorsque l’administration des brevets reçoit un avis de transfert d’un dépôt conformément à l’article 17b, troisième alinéa, ou de réception d’un nouveau dépôt de micro-organisme conformément à l’article 17c, troisième alinéa, le transfert ou le nouveau dépôt fait l’objet d’une inscription au registre.
Annonces de l’Office des brevets
43. Les annonces relatives aux brevets paraissent dans une publication de l’Office des brevets.
Droit d’intenter une action
44. L’action prévue à l’article 52, troisième alinéa, de la Loi sur les brevets est intentée par le ministère public, à moins que le gouvernement ne désigne à cet effet un autre fonctionnaire dans un cas d’espèce.
Office récepteur des demandes internationales
45. L’Office des brevets est l’office récepteur des demandes internationales déposées par des ressortissants finlandais, des personnes physiques domiciliées en Finlande, des personnes morales constituées selon le droit finlandais et des personnes morales exerçant des activités industrielles ou commerciales en Finlande.
Lorsqu’une demande internationale est déposée par plusieurs déposants dont l’un est une personne physique ou morale mentionnée au premier alinéa, les dispositions dudit alinéa sont applicables au dépôt de la demande.
46. En sa qualité d’office récepteur, l’Office des brevets reçoit, vérifie et transmet les demandes internationales conformément au Traité de coopération en matière de brevets et à son règlement d’exécution.
Les taxes suivantes sont payables à l’Office des brevets : 1) la taxe de base prévue à la règle 15.1 du règlement d’exécution du Traité de coopération en
matière de brevets, dans un délai d’un mois à compter de la réception de la demande ; 2) la taxe de désignation prévue à la règle 15.1, dans un délai d’un an à compter de la date de
dépôt international de la demande ou, si une priorité est revendiquée, de la date de priorité revendiquée ;

toutefois, la taxe peut en tout état de cause être payée dans un délai d’un mois à compter de la réception de la demande ;
3) la taxe de recherche prévue à la règle 16.1, dans un délai d’un mois à compter de la réception de la demande ;
4) la taxe de transmission pour traitement de la demande par l’Office des brevets en sa qualité d’office récepteur, dans un délai d’un mois à compter de la réception de la demande.
Lorsque le montant de la taxe de base ou de la taxe de désignation a fait l’objet d’une augmentation après le dépôt de la demande mais avant son paiement, l’augmentation n’est pas applicable si la taxe est payée dans un délai d’un mois à compter du dépôt de la demande.
Lorsqu’une taxe mentionnée au deuxième alinéa n’a pas été payée ou ne l’a pas été dans sa totalité dans le délai prescrit, l’Office des brevets peut, conformément à la règle 16bis, imputer le montant manquant au Bureau international mentionné à l’article 8. Le montant ainsi imputé est réputé payé en temps opportun.
47. Sur requête du déposant et moyennant le paiement d’une taxe prescrite à cet effet, l’Office des brevets fait transmettre, conformément à la règle 17.1)b), une copie de la demande antérieure déposée auprès de l’Office des brevets au Bureau international mentionné à l’article 8. La taxe doit être payée dans le délai pour la présentation de la requête prescrit à la règle précitée.
48. Les demandes internationales déposées auprès de l’Office des brevets doivent l’être en un seul exemplaire. Elles doivent être rédigées en finnois, en suédois, en anglais ou dans toute autre langue admise par l’Office des brevets. La requête d’une demande internationale peut être rédigée en anglais même si la demande elle-même est rédigée en finnois ou suédois.
49. L’Office des brevets tient un registre distinct pour les demandes internationales déposées auprès de lui. Ce registre n’est pas accessible au public.
50. Un déposant qui n’est pas domicilié en Finlande doit constituer un mandataire résidant en Finlande et habilité à le représenter pour ce qui concerne la demande auprès de l’Office des brevets.
51. Sauf dispositions contraires de la Loi sur les inventions intéressant la défense nationale (N° 551/67), l’Office des brevets transmet les demandes internationales déposées auprès de lui au Bureau international de l’Organisation Mondiale de la Propriété Intellectuelle, conformément au Traité de coopération en matière de brevets et à son règlement d’exécution.
Poursuite de la procédure relative aux demandes internationales
52. Lorsqu’une demande internationale a été déposée dans une langue autre que celles mentionnées à l’article 8, cinquième alinéa, de la Loi sur les brevets, une traduction de la demande est requise aux fins de la poursuite de la procédure relative à la demande conformément à l’article 31 de la Loi sur les brevets ou aux fins de la présentation d’une requête en réexamen conformément à l’article 38, premier alinéa, de la Loi sur les brevets. Les dispositions de l’article 3 du présent décret relatives aux traductions doivent dès lors être observées lorsqu’elles sont applicables. L’Office des brevets peut édicter des règles accordant aux déposants une dérogation à l’obligation de déposer une traduction dans les cas où la procédure relative à une demande internationale n’est poursuivie qu’en partie en Finlande.
52a. Lorsque le déposant a accompli toutes les démarches prévues à l’article 31 de la Loi sur les brevets aux fins de la poursuite de la procédure relative à une demande internationale mais que l’Office des brevets n’a pas été avisé de la réception de la demande par le Bureau international, l’Office des brevets en avise le Bureau international.

52b. Le délai mentionné à l’article 34 de la Loi sur les brevets est : 1) sauf disposition contraire du sous-alinéa 2), de quatre mois à compter de l’expiration du délai
pour poursuivre la procédure relative à une demande internationale prévu à l’article 31, premier alinéa, de la Loi sur les brevets ; ou
2) identique au délai de 30 mois prévu à l’article 31 de la Loi sur les brevets si le déposant a déposé une déclaration, conformément à l’article 31, deuxième alinéa, de la Loi sur les brevets, dans un délai de 19 mois à compter de la date de dépôt international ou, si une priorité est revendiquée, de la date de la priorité revendiquée.
52c. La requête en réexamen prévue à l’article 38, premier alinéa, de la Loi sur les brevets doit être présentée dans un délai de deux mois à compter de la date à laquelle l’office récepteur ou le Bureau international a notifié au déposant la décision mentionnée audit alinéa.
Si le déposant peut prouver qu’il a reçu la notification mentionnée au premier alinéa plus de sept jours après la date de cette notification, le délai est prorogé du même ‘nombre de jours que celui qui s’est écoulé entre la date de la notification et la date à laquelle le déposant l’a reçue. Le délai de sept jours précité est toutefois déduit de ce délai prorogé.
Entrée en vigueur et dispositions transitoires
53. Le présent décret entre en vigueur le 1er octobre 1980.
Le Décret sur les brevets (N° 4/68) du 4 janvier 1968 et ses modifications ultérieures sont abrogés par le présent décret.
54. Les demandes de brevet ayant fait l’objet d’une instruction et d’une décision conformément aux dispositions applicables avant l’entrée en vigueur de la Loi modifiant la Loi sur les brevets (N° 407/80) du 6 juin 1980 demeurent régies par l’ancien Décret sur les brevets mentionné à l’article 53, deuxième alinéa.
Les demandes de brevet déposées avant l’entrée en vigueur du présent décret et n’entrant pas dans le cadre des dispositions du premier alinéa sont régies par les articles 2, 9 et 10 de l’ancien Décret sur les brevets en lieu et place des articles 2, 10, 11 et 17 du présent décret.
Nonobstant les dispositions de l’article 24, deuxième alinéa, une demande déposée avant l’entrée en vigueur du présent décret peut être considérée comme résultant d’une division ou d’une séparation.
Les brevets d’addition délivrés avant l’entrée en vigueur de la Loi modifiant la Loi sur les brevets mentionnée au premier alinéa demeurent régis par les dispositions de l’ancien Décret sur les brevets.
Les brevets instruits conformément à l’article 51 de l’ancienne Loi sur les brevets mentionnée au premier alinéa demeurent régis par l’article 45 de l’ancien décret en lieu et place de l’article 41 du présent décret.
