In the Republic of Korea, new varieties of plants are entitled to protection under the Seed Industry Act and Patent Act.
The Seed Industry Act contains specific provisions on the protection of plant varieties. Chapter II of the law governs the protection of the plant breeder’s rights. Chapter III regulates the variety denominations, and Chapter IX refers to the penal provisions on infringements of plant variety rights.
In particular, the law provides the provisions that specify its relationship with the Patent Act (see Articles 7(1), 10, 48, 86(2), 100, 105, 107, 168, 170(1), 176(3) & (5)).
