TUVALU COAT OF ARMS ACT

AN ACT TO PROVIDE FOR THE DECLARATION OF THE OFFICIAL COAT OF ARMS OF TUVALU, TO PROHIBIT THE UNAUTHORISED USE THEREOF AND FOR MATTERS CONNECTED THEREWITH AND INCIDENTAL THERETO1

Commencement [13th November 1981]

1 Short title

This Act may be cited as the Tuvalu Coat of Arms Act.

2 Interpretation

In this Act, unless the context otherwise requires,

the Coat of Arms” means the armorial bearing of Tuvalu as declared in accordance with section 3.

3 The Coat of Arms

The Coat of Arms shall be in the form and design declared by the Minister by notice.

4 Prohibition on Use

(1) Except with the written consent of the Minister, which may be given in general or particular terms and subject to any conditions which the Minister may specify in his consent, no person shall —

(a) in any manner or in connection with any matter whatsoever, display in public or sell or expose for or have in his possession for sale, or for any of those purposes make; or

(b) in connection with any business, trade, calling or profession,

use any copy of the Coat of Arms, or any device or thing resembling the Coat of Arms.

(2)
Any person who contravenes subsection (1) is guilty of an offence and liable on conviction to a fine of $1,000.
(3)
The court before which any person is convicted of an offence under subsection (1) may, in addition to imposing any other punishment, order that any goods or thing by means of which or in respect of which the offence was committed shall be forfeited.

Restriction on proceedings

No proceedings for an offence against section 4 shall be instituted without the consent of the Attorney-General.
