The patent holders had absolute priority over all other applicants for patent which had been granted in New Zealand before the 1972 Patents Act came into force, provided that they applied for registration in Samoa within one year of the 1972 Act.
There was no automatic protection of a New Zealand granted patent in Samoa if the application for registration of the patent had failed in Samoa.
Patents granted in any overseas country can be registered in Samoa within two years of the original grant overseas (see Section 9).
