'This Regulation updates the Regulation which implements Regulation (EC) No 40/94 on the Community trade mark, due to the accession of the European Community to the Protocol relating to the Madrid Agreement concerning the International Registration of Marks adopted at Madrid on 27 June 1989.'

Article 2 of this Regulation states that it shall enter into force on the date on which the Madrid Protocol enters into force with respect to the European Community.
The Protocol, adopted at Madrid on 27 June 1989, entered into force with respect to the European Community on 1 October 2004. Consequently, this Regulation entered into force on 1 October 2004.
