The scope of this law is focused on all commercial enterprises, all manufacturing for commercial purposes, importers, exporters and merchants, service providers, advertisers of products, goods, and services; especially regarding the inspection procedures and border control, for the quality and safety of products, goods and services.
The CAM CONTROL Departement of the Ministry of Commerce; the Customs and Excise Department of the Ministry of Economy and Finance; and the Economic Police of the Ministry of Interior are the competent authority for the registration of a petition to request border measures. They are entrusted to inspect goods and prevent commercial fraud and infringement).
Article 31 concerns inspection of products samples. Article 33 concerns inspection and determination of the identity of the goods. Article 35 concerns inspection of source and characteristics of the products. Article 37 concerns the seal and labeling of the products. Article 53 concerns measures of prevention for suspected batches of products and goods. Article 59 concerns the criteria for inspection of goods and products.
Chapter 7 contains provisions for the enforcement of Intellectual Property rights.
NB: The Royal Government of Cambodia has approved the establishment of a Commercial Court separated from the normal court system. The Commercial Court will become an efficient tool to settle both cross commercial and IP disputes.
