The Proceeds of Crime Act 2002 (POCA) allows UK authorities to confiscate or recover profits derived from criminal activity, including serious intellectual property (IP) offenses such as large-scale counterfeiting or piracy. POCA does not regulate IP rights themselves, but provides a mechanism to recover financial gains obtained illegally from IP crimes that are prosecuted as criminal offenses, complementing substantive IP laws such as the Copyright, Designs and Patents Act 1988 and the Trade Marks Act 1994.
