This consolidated version of the General Part of the Civil Code takes into account amendments up to 'Law No. 262-VI of July 3, 2019, on Amendments to Certain Laws of the Republic of Kazakhstan on Regulation and Development of Financial Market, Microfinance Activity and Taxation', which entered into force on different dates.
Paragraph 1 under Article 1 of the said amending Law No. 262-VI of July 3, 2019, which entered into force on January 1, 2020 introduced amendments to the following provisions of this consolidated General Part of the Code:
- Section I, Chapter 2, Paragraph II, part II entitled 'Business Partnership', the first part of item 1 of Article 59, the second part of Article 64, the second part of item 2 of Article 74, the second part of Article 78 where the words 'microfinance organizations' were replaced by the words 'organizations carrying out microfinance activities', and the words 'microfinance organizations' for 'microfinance activities';
- Section 3, Subsection I, Chapter 17, Article 282 (in the second part of its item 2, the words 'microfinance organizations' were replaced by the words 'microfinance activities'); and Chapter 18, Paragraph III, Article 328 (see item 1 (revised), item 2 (the word 'claim' is replaced by the word 'the claim, as well as the consent of the guarantor for the extrajudicial transfer of the subject of pledge', item 2-1 (revised) items 5 & 7 were deleted).
These amendments do not relate to intellectual property.
The consolidated General Part of the Code provides recognition of exclusive rights of natural or legal persons for results of intellectual creative activity and means of identification of legal persons and products of natural or legal persons, their works and services, which are referred to in the following provisions:
- Section 1, Chapter 1, Articles 7(5) & 10(5); Chapter 2, Paragraph I, Articles 14, 22(2), (3); Paragraph II, part I, Article 38 and part II, Articles 59(1) & 61(2),3); Chapter 3, Paragraph I, Articles 115(2), 119(2), 125 & 126; Chapter 4, Article 156(4); Chapter 5, Article 166(4);
- Section 3, Subsection 1, Chapter 18, Paragraph 3, Article 303(3); and Subsection 2, Chapter 22, Article 379.
