The Law of the People's Republic of China Against Unfair Competition was adopted at the Third Session of the Standing Committee of the Eighth National People’s Congress, promulgated by Order No. 10 of the People's Republic China on September 2, 1993, and entered into force on December 1, 1993.
The Law was revised on November 4, 2017 at the 30th Meeting of the Standing Committee of the 12th National People's Congress, and entered into force on January 1, 2018.
This revised version of the Law of the People’s Republic of China Against Unfair Competition provides for acts of unfair competition, including, inter alia, unauthorized use of trademarks and domain names (Article 6), the obligation of not infringing trade secrets of others (Article 9), the protection of trade secrets gained during the process of supervision and investigation (Article 15), and the penalties for trade secrets infringement (Article 21).
